A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF MOORPARK, CALIFORNIA REGARDING A DEVELOP-
MENT AGREEMENT BETWEEN THE CITY OF MOORPARK AND
URBAN WEST COMMUNITIES MOORPARK INVESTORS FOR
PLANNED COMMUNITY NO. 3.
WHEREAS, at a duly noticed public hearing on March 26,
1986, the Moorpark Planning Commission considered the proposed
development agreement between the City of Moorpark and Urban West
Communities, Moorpark Investors (the "Development Agreement ") for
the project commonly known as Planned Community No. 3 (the "project ");
and
WHEREAS, the Moorpark Planning Commission has reviewed
said Development Agreement has reviewed and considered the information
contained in the Environmental Impact Report prepared for the project,
has considered the information presented at said public hearing and
has reached its decision in the matter.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS:
that:
SECTION 1. That the Planning Commission hereby finds
a. The environmental effects discussed in the EIR prepared
for PC -3 and the development agreement are similar
enough to warrant the same treatment in an EIR, and
certify that the PC -3 Final Environmental Impact
Report adequately covers the impacts of the develop-
ment agreement, and pursuant to State CEQA Guidelines,
that this body has reviewed and considered the informa-
tion contained therein; and
b. The provisions of the agreement are consistent with
the General Plan and City Ordinance No. 59.
SECTION 2. That the Planning Commission hereby recommends
to the City Council approval of the Development Agreement subject
to the modifications attached to this resolution and made a part
hereof.

Planning Commission Modification to DEVELOPMENT AGREEMENT CITY OF MOORPARK
UWC MOORPARK INVESTORS MOUNTAIN MEADOWS PROJECT
Planning Commission Resolution No. PC- 86 -92, adopted March 26, 1986.
Paragraph 1.G be amended as follows:
G. Fees for the Improvement of the Community Park
Site. For each of the last seventeen hundred and seventy -nine
(1.779) dwelling units in the Project, the Developer shall pay to
the City seven hundred and seventy -five dollars ($775), which
money shall be used only for the improvement at- the- eemunity
Park -site- and /or construction of community related Park facilities as
determined by the City Council. Said fees shall be paid in two
installments: (i) six hundred thousand dollars ($600,000) shall
be paid, without interest, within fifteen (15) days after demand
by the City given at any time after three (3) years after the
Effective Date of this Agreement, and (ii) the balance shall be
paid, without interest, within fifteen (15) days after demand by
the City given at any time after six and one -half (6 1/2) years
after the Effective Date of this Agreement.
