PC -86 -107 " A RESOLUTION OF THE MOORPARK PLANNING COMMISSION OF THE CITY OF MOORPARD RECOMMENDING TO THE CITY COUNCIL APPROVAL TO ALLOW TEMPORARY PRODUCE STANDS BY REQUIRING A CONDITIONAL USE PERMIT IN THE EIGHT (8) EXISTING ZONES. WHEREAS, at a duly noticed public hearing on June 11, 1986, June 23, 1986, July 9, 1986, July 23, 1986 and August 13, 1986, to consider amending the Zoning Ordinance to Permit Produce Stands (tempor- ary) in the City, subject to Conditional Use Permit procedures in the following zones: Zone Section Deleted RA Sec.8121 -0.24 and all subsections thereunder. RE Sec.8123 -0.15 and all subsections thereunder. RO Sec.8124 -0.6 and all subsections thereunder. R1 Sec.8125 -0.7 and all subsections thereunder. TPD Sec.8135 -0.1.2 and all subsections thereunder. APD Sec.8136 -0.1.5 and all subsections thereunder. RPD Sec.8137 -0.2.4 and all subsections thereunder. OS Sec.8143 -4.11 in accordance with Sec. 8121 -0.24 and thereunder. WHEREAS, the Planning Commission, after review and consid- eration of the information contained in the staff report dated June 11, 1986, and bcased upon an initial review, it has been found that a signifi- cant effect would not occur; therefore this body has reached its decision in the matter; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That the Planning Commission hereby recommends to the City Council that the Zoning Ordinance be amended to allow Tem- porary Produce Stands by requiring a Conditional Use Permit in the eight (8) existing zones contained herein -be amended to read as follows: "All temporary stands established or maintained for the sale of agricultural or horticultural products, grown on the premises, as permitted by this Article shall conform to the following conditions and limitations. 1. The floor areas of such stands shall not exceed four hundred (400) square feet each; 2. Such stands shall not be located or maintained within twenty (20) feet of any public road, street or highway; 3. Owners thereof shall remove such stands when not in use for a period of thirty (30) days; 4. Building specifications shall be submitted for approval; 5. Land area must be one 91) acre or more. The existing temporary produce stand would be Grandfathered in. SECTION 2. That at its meeting of August 13, 1986, the Planning Commission took action to request staff to prepare a resolution recommending the the City Council amendment to the Zoning Ordinance to allow Temporary Produce Stands by requiring a Conditional Use Permit in the eight (8) existing zones contained herein; said resolution to be presented at the next regularly scheduled meeting. The action with the foregoing direction was approved by the following roll call vote; AYES: Commissioner Keenan, Rosen, LaPerch, Claffey and Holland.
