A RESOLUTION OF THE MOORPARK PLANNING COMMISSION OF THE
CITY OF MOORPARK, CALIFORNIA, DENYING THE APPLICATION OF
G.H. PALMER & ASSOCIATES FOR A PARCEL MAP (LDM -9). ASSESS-
OR PARCEL NO. 511- 08 -19, -20, -21, -24, -25, -26, -31, and
-32.
WHEREAS, pursuant to the provisions of Division 8 Planning and
Development, Chapter 2 - Subdivions of the Moorpark Municipal Code, the applicant,
G.H. Palmer & Associates, has requested a Parcel Map approval; and
WHEREAS, studies and investigations were made, and staff reports
and recommendations were submitted; and
WHEREAS, pursuant to the requirements of Article 5, of Chapter
3 of Title 7 (beginning at Section 65300) of the Government Code of the State
of California ( "The Planning and Zoning Law ") the City of Moorpark has adopted
a General Plan; and
WHEREAS, it has been previously determined that an Environmental
Impact Report is required for consideration of the proposed Parcel Map, and
an Environmental Impact Report has been prepared pursuant to the provisions
of the California Environmental Quality Act [ Division 13 of the Public Resources
Code of the State (beginning at Section 21000)]; and
WHEREAS, this Commission, upon giving the notice required by the
provisions of Article 2 of Chapter 4 of Title 7 of the Government Code (beginning
at Section 65850), did on the 3rd of December, 1986, conducted a public hearing
as prescribed by law in order to consider said application for a Parcel Map.
NOW, THEREFORE, THE MOORPARK PLANNING COMMISSION OF THE CITY OF
MOORPARK, RESOLVES AS FOLLOWS:
SECTION 1. This Commission hereby recommends to the City Council
that the Final Environmental Impact Report (EIR) for Planned Development Permit
No. 1014 and LDM -9 not be certified for the following reasons:
A. The EIR does not adequately address traffic impacts
inasmuch as it has identified the project as having
insignificant impact although traffic studies indicate
that five intersections will be negatively and permanently
affected by the project.
E. The EIR does not fully address the negative economic
and blighting impacts the project may have on the adjacent
single family residences, which are located between the project
site and westerly industrial development.
SECTION 2. This Commission enjoins the findings contained in the
staff report dated December 3, 1986, which report is incorporated herein by
reference as though fully set forth at this point and as amended orally at
the public meeting.

SECTION 3. This application is hereby denied for the following
The design and improvement of the proposed subdivision is not consis-
tent with the General Plan. Improvement of the proposed subdivision
consistent with the site plan for the residential project does
not comply with the City's parking standards. Further, the sub-
division does not provide for any dedication of parkland, as
required under the City's parkland dedication ordinance and does
not meet Recreation Goal 2 and Policy 6 of the Land Use Element.
These provide for appropriately located neighborhood parks in areas
accessible to population concentrations.

by the Moorpark Planning Commission of the City of Moorpark, California, at
a regular meeting held the 10th day of December, by the following vote:
AYES: Commissioners Montgomery, Butcher, Perez, Wozniak and Holland;
