A RESOLUTION OF THE MOORPARK PLANNING COMMISSION
OF THE CITY OF MOORPARK, CALIFORNIA, RECOMMENDING
A DENIAL TO THE CITY COUNCIL OF A REQUEST TO MODIFY
AN APPROVED GRADING PLAN (TR- 4170/3070 -4) ON THE
APPLICATION OF U.S. CONDOMINIUM CORPORATION.
WHEREAS, pursuant to the request of the City Council a
public hearing was held January 19, 1987 regarding a request by U.S.
Condominium Corporation to amend the approved grading plan for Tracts
4170 and 3070 -4; and
WHEREAS, studies and investigations were made, staff reports,
and recommendations were submitted; and
WHEREAS, pursuant to the requirements of Article 5 of Chapter
3 of Title 7 (beginning at Section 65300) of the Government Code of
the State of California, the City of Moorpark has adopted a General
Plan, which plan contains each and every element required to be
included in such a plan by Section 65302 of the Government Code.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
MOORPARK, CALIFORNIA RESOLVES AS FOLLOWS:
SECTION 1. This Commission finds that:
a. The City is under no responsibility to resolve an
error made by the developer; and
b. The developer should live up to the approved plan
without modification; and
c. There is no benefit to the City in approving the
modification.
d. The proposed plan would have an adverse impact to
the canyon adjacent to Happy Camp Park.
SECTION 2. This Commission hereby recommends to the City
Council that they deny the request to modify an approved grading
plan for Tracts 417 and 3070 -4.
SECTION 3. That this body, after review and consideration
contained in the staff report dated January 19, 1987, the Planning
Commission took action to request staff to prepare a resolution
recommending denial of TR- 4170/3070 -4; said resolution to be presented
at the next regularly scheduled meeting. The action with the foregoing
direction was approved by the following roll call vote:
AYES: Commissioners Montgomery, Hol d, Wozniak, and
Perez; n
NOES: None;
ABSENT: Commissioner Butcher.
