✓"`, A RESOLUTION OF THE MOORPARK PLANNING COMMISSION
OF THE CITY OF MOORPARK, CALIFORNIA, RECOMMENDING
TO THE CITY COUNCIL DENIAL OF THE APPLICATION OF
ROBERT W. AND PAULETTE S. BURNETTE ON THE REQUEST
OF ZONE CHANGE NO. 2812. ASSESSOR PARCEL NO. 506 -
02 -48, -11.
WHEREAS, at a duly notice public hearing on March 2, 1987
the Planning Commission considered the application filed by Robert
W. and Paulette S. Burnette for approval of Zone Change No. 2812,
a zone change of a 9.25 acre parcel of property from "R -1 ", Residential
Single Family to "RPD -15U ", Residential Planned Development 15
Units per Acre Maximum.
WHEREAS, the Planning Commission has reviewed said application,
has reviewed and considered the information contained in the Negative
Declaration prepared for the request, and has reached it decision
in the matter; and
WHEREAS, the Planning Commission indicated that the traffic
volumes resulting from a multiple family residential development
at the requested density of fifteen (15) units per acre may be
intolerable, and the pending _update of the City's Land
Use and Circulation Elements of the General Plan may set a different
course for development for this area than is presently recognized;
and
WHEREAS, it is unknown at this time regarding the future
location, and design of a collector street parallel to and south
of Los Angeles Avenue, (Majestic Court), its ability to serve this
site, and how in a comprehensive manner this street would relieve
the potential traffic burden on Los Angeles Avenue; and
WHEREAS, at its meeting of March 2, 1987, the Planning
Commission took the following action:and requested staff to prepare
a resolution recommending denial of Zone Change No. 2812, said
resolution to be presented for Consent Calendar action at the next
regularly scheduled meeting.
NOW, THEREFORE, THE MOORPARK PLANNING COMMISSION OF THE
CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That the findings cannot be made that are
contained in the staff report prepared for the Planning Commission
meeting of March 2, 1987, which report is incorporated by reference
though full set forth herein.
SECTION 2. That the Planning Commission does hereby
recommend to the City Council the following:
a. That Zone Change No. 2812 be denied and in lieu
of the requested change of zone, that the more
restrictive zone of RPD -7U be applied to the subject
property.
b. That zone Change No. 2812 be denied as requested.
C. That the Planning Commission recommends to the City
Council a change of zone on the subject site from
"R -1" (7000) to "RPD -7U ".
SECTION 3. That the Planning Commission finds that a
change of zone to RPD -7U on the subject site is consistent with
the General Plan, Land Use Element as identified under Table 9
of said Element.
The action with the foregoing direction was approved
by the following roll call vote:
AYES: Commissioners Montgomery, Butcher, Wozniak
and Schmidt;
NOES: None;
ABSENT: Commissioner Holland.
