PC -87 -133 A RESOLUTION OF THE MOORPARK PLANNING COMMISSION OF THE CITY OF MOORPARK RECOMMENDING TO THE CITY COUNCIL AMENDMENTS TO THE MOORPARK MUNICIPAL CODE RELATING TO CHAPTER 50 OF TITLE 9 PERTAINING TO THE SIGN CODE. WHEREAS, the Planning Commission of the City of Moorpark has directed staff to prepare an amendment to the Zoning Ordinance clarifying the Zoning Ordinance with regard to Tract Pole Flags and Temporary Commercial Window /Wall Signs; and WHEREAS, studies and investigations were made, and staff reports and recommendations were submitted; and WHEREAS, pursuant to the requirements of the provisions of the California Environmental Quality Act [Division 13 of the Public Resources Code of the State (beginning at Section 21000)], and environmental assessment has been made in accordance with the City's adopted Environmental Guidelines and it has been determined that this amendment to the zoning ordinance qualifies for a Negative Declaration and the Negative Declaration will be filed in the office of the Clerk of the County of Ventura in accordance with the City's adopted Environmental Guidelines; and WHEREAS, the Planning Commission has found and determined that the proposed amendment is consistent with the General Plan; and WHEREAS, this Commission, upon giving the notice required by the provisions of Article 2 of chapter 4 of Title 7 of the Government Code (beginning at Section 65855), did, on the 16th day of March , 1987, conduct a public hearing as prescribed by —law in over to consider said amendment to the City's Municipal Code. NOW, THEREFORE, THE MOORPARK PLANNING COMMISSION OF THE CITY OF MOORPARK RESOLVES AS FOLLOWS: SECTION 1. This Commission hereby recommends to the City Council that the proposed Sign Code amendments attached to this resolution as Exhibit A, incorporated herein by reference as though fully set forth at this point and as amended orally at the public meeting, be adopted. SECTION 2. A finding is hereby made that these amendments to the Moorpark Municipal Code will not have a significant effect on the environment and that a Negative Declaration has been completed in compliance with C.E.Q.A. and the State EIR Guidelines issued thereunder, and that this body has reviewed and considered the infor- mation contained in the Negative Declaration SECTION 3. The Recording Secretary is instructed to forward a copy of this resolution to City Council for its attention in the manner prescribed by law. SECTION 4. Said resolution to be presented at the Commission next regularly scheduled meeting. The action with the foregoing direction was approved by the following roll call vote: AYES: Commissioners Montgomery, Butcher, Wozniak, Schmidt and Chairman Holland; NOES: None; ABSENT: None. ATTEST: Acting Secretary Resolution No.PC -87 -133 EXHIBIT "A" ADD TO: Section 9.50 - 040 CLASS OF SIGNS (C -1) Model Tract Pole Flags A series of metal poles installed securely in the ground with a height greater than six (6) feet which displays a pennant or flag of cloth material which is suspended only from the upper portion of the pole to attract attention to the location of the model sales units within the residential tract. DELETE FROM: Section 9.50 - 060 PERMITS "........except that temporary signs to be displayed not to exceed 15 days in any 6 month period and not exceeding 12 square feet in area, that otherwise conforms to the provisions of this code, and signs painted on walls or windows of buildings, and change of copy on legally existing sign structures, do not require a permit..........." ADD TO: Section 9.50 - 080 SIGNS PERMITED ........and Section 9.50 - 095" - SEE CHART Temporary Signs - Temproary signs relating to window and wall area may be permitted up to twenty -five percent (25X) of the total window or wall elevation; such signs to be placed in predesignated area(s) of the window or wall elevation as approved by the Director of Community Development or his designee. In no event shall the aggregate area of temporary signs exceed one hundred fifty (150) feet. Temporary signs to promote special sales or events shall be allowed without a permit and shall be dated upon posting and shall not be displayed for more than fifteen (15) days. Any sign not displaying a date shall be removed immediately upon request by the Code Enforcement Officer. SEE CHART ADD TO: Section 9.50 - 100 CONSTRUCTION. MAINTENANCE. AND REMOVAL (h) Model tract pole flags shall be permitted providing that a plot plan shall be submitted and approve which complies with the following requirements: 1. A plot plan shall show the location of all proposed poles, setbacks, height, spacing dimensions, number and size.
