r A RESOLUTION OF THE MOORPARK PLANNING COMMISSION OF
THE CITY OF MOORPARK, CALIFORNIA, APPROVING TENTATIVE
PARCEL MAP NO. 4449 ON THE APPLICATION OF LAWANDA J.
REED.
WHEREAS, at a duly noticed public hearing on April 18, 1988, the
Planning Commission considered the application filed by Lawanda J. Reed,
requesting approval of a subdivision under the Tentative Parcel Map No. 4449 to
subdivide the 16,200 sq.ft. into two separate lots of record. Located at 80 and
90 Fremont Street (R -1 Residential). Assessor Parcel No. 506 -0- 020 -290.
WHEREAS, the Planning Commission, after review and consideration
of the information contained in the staff report dated April 13, 1988, and the
Negative Declaration, has found that this project will not have a significant
effect on the environment; and has reached its decision in the matter;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to the provisions of the California
Environmental Quality Act (Division 13 of the Public Resources Code of the State
of California [beginning at Section 21000}) the Planning Commission of the City
of Moorpark approves the Negative Declaration;
SECTION 2. That the findings contained in the staff report dated
April 13, 1988, which report is incorporated by reference as though fully set
forth herein with conditions as modified by said Commission, are hereby
approved;
SECTION 3. That at its meeting of April 18, 1988, the Planning
Commission took action to direct staff to prepare a resolution with attached
staff recommended conditions, does hereby approve Tentative Parcel Map No.
4449, said resolution to be presented for Consent Calendar action at the next
regular scheduled meeting. The action with the foregoing direction was
approved by the following roll call vote:
AYES: Commissioner
Montgomery;
NOES: None;
ABSENT: Commissioner
Butcher, Lawrason, Holland, and
Wozniak.
PASSED, APPROVED AND ADOPTED this 2nd day of May 1988.

I HEREBY CERTIFY that the foregoing resolution was duly adopted

COMMUNITY DEVELOPMENT DEPARTMENT CONDITIONS:
GENERAL REQUIREMENTS
The conditions of approval of this tentative parcel map supersedes all
conflicting notation, specifications, dimensions, typical sections and the
like which may be shown on said map and that all of the provisions of the
Subdivision Map Act, City of Moorpark Subdivision Ordinance, and adopted
County Policies apply.
2. All requirements of any law or agency of the State, Ventura County, and
City of Moorpark and any other governmental entity shall be met, and all
such requirements and enactment shall, by reference, become conditions of
this entitlement.
3. No condition of this entitlement shall be interpreted as permitting or
requiring any violation of law, or any lawful rules or regulations or
orders of an authorized governmental agency. In instances where more
than one set or rules apply, the stricter ones shall take precedence.
4. If any of the conditions or limitations of this entitlement are held to be
invalid, that holding shall not invalidate any of the remaining conditions
or limitations set forth.
5. The applicant agrees as a conditions of issuance (or renewal) and use of
this pert, to defend, at his sole expense, any action brought against the
City because of issuance (or renewal) of this permit or, in the
alternative, to relinquish this permit. Applicant will reimburse the City
for any court costs and /or attorney's fees which the City may be required
by a court to pay as a result of any such action City may, at its sole
discretion, participate in the defense of any such action, but such
participation shall not relieve applicant of his obligations under this
condition.
6. The applicant's recordation of this map shall be deemed to be acceptance by
applicant of all conditions of this map.
As of the date of recordation of the final parcel map, the parcels depicted
thereon shall meet the requirements of the zoning ordinances and General
Plan then applicable to the property. Compliance with this condition shall
be required even if the zoning and General Plan requirements in effect as
of the date the tentative map as conditionally approved have changed.
Conditional approval of the tentative map shall neither limit the power of
the legislative body to amend the applicable zoning ordinances and /or
general plan nor compel the legislative body to make any such amendments.
8. In accordance with Section 8251 (Expiration of Tentative Map) of the
Moorpark Municipal Code, the tentative map shall expire 36 months from the
n date of City approval. By this time the final map must be approved by the
City and recorded with the County Recorder. No time extensions shall be
permitted.

CITY ENGINEER'S CONDITIONS
PRIOR TO APPROVAL OF THE FINAL PARCEL MAP, THE FOLLOWING CONDITIONS
SHALL BE SATISFIED:
DURING CONSTRUCTION THE FOLLOWING CONDITIONS SHALL APPLY:
9. If any hazardous waste is encountered during the constructing of this
project, all work shall be immediately stopped and the Ventura County
Environmental Health Department, the Fire Department, the Sheriff's
Department, and the City Inspector shall be notified immediately. Work
shall not proceed until clearance has been issued by all of these agencies.
10. No trees with a trunk diameter in excess of 4 inches shall be trimmed or
removed without prior approval of the City Council.
VENTURA COUNTY FIRE DEPARTMENT CONDITIONS
11. That prior to recordation, the applicant shall provide to the Fire
Department, verification from the water purveyor that the purveyor that
the purveyor can provide the required fire flow for the project. The
required fire flow is 1000 GPM at 20 PSI.
(� 12. That the existing wet barrel hydrant across the street fromm 90 Fremont
shall be adequate for the hydrant location.
