PC -88 -174 A RESOLUTION OF THE MOORPARK PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA RECOMMENDING TO THE CITY COUNCIL URGING ADOPTION OF A MOORPARK LOCAL PLANNING ORDINANCE. A. This Commission, upon giving the notice required by the provisions of Section 8163 of the Moorpark Municipal Code and Section 65905 of the Government Code, did, on May 16, 1988; May 23, 1988; June 6, 1988; June 20, 1988; and June 27, 1988, conduct public hearings as prescribed by law in order to review and consider the draft proposal of a document commonly referred to as the "Comprehensive Planning ordinance" (COP). B. The City of Moorpark, a municipality which incorporated in July of 1983, inherited a community plan prepared under the auspices of the County of Ventura and adopted the community plan as the City's first and only General Plan. C. The City of Moorpark has endeavored to review and update its General Plan, including the mandatory elements of the General Plan, and the City's land use regulations, policies, and programs while at the same time continuing to process development entitlements for individual projects within the City. In attempting to accomplish these competing tasks, the review of the City's planning functions have been virtually ignored while the City, due to statutory requirements of State law, concentrated its limited resources on the review and processing of individual development entitlements. D. The orientation of the City has tended to be primarily reactive; responsive solely to individual development proposals. The City has generally failed to achieve a proactive orientation and the City has not fully appreciated or anticipated the impacts of specific development proposals on the community. E. The City has experienced a rapid rate of growth resulting in a tripling of the population of the City since incorporation. This rapid growth has resulted in a significant alteration in the character of the community. F. During this period of rapid and intense residential development , the City has experienced a gradual deterioration in the quality of life within the City. Factors contributing to this deterioration in the quality of life for residents of the City are as follows: 88286 /CHRONI - Traffic congestion; - Loss of open space land; - Overburdening of necessary or desirable services and facilities of the City of Moorpark, including but not limited to, sewer, water, schools, streets, public parking, parks, recreation services, caC libraries and library services, police services, fire services, and paramedic services; Higher utility rates to subsidize growth; Increased air, groundwater, and noise pollution; - Crowding, congestion, and increased crime. G. It is the desire of the Planning Commission that the planning process of the City include, to the maximum extent possible, the participation, involvement, and contribution of each member of the community. It is the further desire of the Planning Commission that the planning process emphasize the formulation, evolution, and renewal of community goals, policies, and programs. Planning decisions should be derived, discussed, and determined on a community -wide basis, with a community -wide emphasis, and where appropriate, confirmed through the election process. H. It is the option of the Planning Commission that the General Plan of the City should be reviewed and renewed on a regular and periodic basis. It is further the opinion of the Planning Commission that plan amendments, on an incremental basis, should be discouraged. The establishment of the plans and policies of the City should be community oriented, with full community involvement and participation, with complete understanding, appreciation, and disclosure of the impacts and effects of these plans and policies on the community. The Planning Commission of the City of Moorpark resolves as follows: ,-, SECTION 1. The Planning Commission of the City of Moorpark recommends that the City Council direct the City Attorney to prepare specific text amendments to the City's Zoning Ordinance to be known as the Moorpark Local Planning Ordinance which will establish a Local Planning process whereby the City will: A. Complete regular and periodic updates /renewals to its General Plan to be scheduled every four (4) years; and B. Prohibit General Plan Amendments between updates /renewals except when, (1) The proposed amendment is initiated by unanimous vote of the City Council; and (2) The proposed amendment would not: (a) Increase population by more than 350 persons, or (b) Increase vehicle trips by more than 1,000 vehicle trips per day. C. Require voter confirmation of the General Plan Update /Renewal when such update /renewal would result in an increase or decrease of the estimated -2- 88286 /CHRONI total population of the City by five percent (5 %) or more. D. Result in a General Plan which shall consist of: (1) All mandatory elements specified in State law; and (2) A Public Facilities Element for the City to assure the adequate provision of public facilities identified as being essential or desirable for the public health, safety, and welfare of the citizens of Moorpark. The City would be able to ensure adequate public facilities and improvements thereon or development would be halted until all provisions to correct inadequacies had been made. The Public Facilities Element would consist of the following components: (a) Identification of the existing level of development in the City and a projection of the ultimate future built -out based upon all controls placed upon development as specified in the City's General Plan and Zoning Ordinance. (b) Identification of all public facilities necessary to accommc future demands for specified in the Land City's General Plan. current and future and improvements date existing and the land uses Use Element of the (c) Establishment of ongoing service requirements for public facilities and the adoption of specific performance standards for each of the following public facilities and improvements: - Circulation and traffic improvements - City Administrative facilities - Drainage - Fire - Flood Control facilities - Paramedic service - Parks and Recreation facilities - Police - Waste water treatment capacity - Water distribution system - Schools - Sewer collection system - Location, construction, and undergrounding of public utilities. (d) Identificaiton of potential financing method(s) for each public facility and improvement. -3- 88286/CHRONI (e) An informational data based system which would- - Forecast demand for public facilities and improvements. - Aid in the preparation of any appropriate local facility management plans. - Provide a mechanism to monitor the adequacy of public facilities on an ongoing basis. - Provide a mechanism for monitoring budget and finance methods used for funding public facilities and improvements. SECTION 2. The Planning Commission of the City of Moorpark recommends that the City Council initiate a complete revision of the City's Zoning Ordinance, including all aspects of design and development standards, commencing with the process by which various applications and projects are reviewed and evaluated by the City. The process by which the City reviews and evaluates various applications and projects shall involve procedures and policies which maximize public input, yet provides timely consideration to an application. SECTION 3. That at its meeting of June 27, 1988, the Planning Commission took action to direct staff to prepare a resolution. the action with the foregoing direction was approved by the following roll call vote: AYES: Montgomery, Lawrason, Butcher Wozniak and Holland; NOES: None; ABSENT: None.
