PC -99 -364 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA RECOMMENDING TO THE CITY COUNCIL APPROVAL OF ZONE CHANGE NO. 97 -7 TO CHANGE THE ZONING DESIGNATION ON UNDEVELOPED LAND LOCATED ON APPROXIMATELY 19.2 ACRES OF LAND LOCATED SOUTHERLY OF LOS ANGELES AVENUE BORDERED BY THE FLOOD CONTROL CHANNEL TO THE SOUTH, UNDEVELOPED LAND ON THE WEST AND MOORPARK AVENUE TO THE EAST (APN. 506 -0- 050 -275) FROM COMMERCIAL PLANNED DEVELOPMENT PERMIT (CPD) TO RESIDENTIAL PLANNED DEVELOPMENT PERMIT (RPD) 16.2 UNITS PER ACRE), WITH THE EXCEPTION OF THE AREA ALONG THE SOUTHERLY PORTION OF THE PROPERTY REQUIRED TO BE DEDICATED TO THE VENTURA COUNTY FLOOD CONTROL DISTRICT WHICH IS TO BE REZONED TO OS (OPEN SPACE), ON THE APPLICATION OF ARCHSTONE COMMUNITIES (SECURITY CAPITAL PACIFIC TRUST) WHEREAS, at a duly noticed public hearing on January 25, 1999, the Planning Commission considered the application filed by Archstone Communities (Security Capital Pacific Trust) for approval of Zone Change No. 97 -7 for a change in the Zoning Designation on the property from Commercial Planned Development (CPD) to Residential Planned Development (RPD) 16.2 units per acre), with the exception of the area along the southerly portion of the property required to be dedicated to the Ventura County Flood Control District which is to have a Zoning Designation of OS (Open Space); and WHEREAS, at its meeting of January 25, 1999, the Planning Commission opened the public hearing, took testimony from all those wishing to testify and continued the hearing to February 8, 1999, closed the public hearing on February 8, 1999; WHEREAS, the Planning Commission, after review and consideration of the information contained in the staff report dated January 25, 1999 and staff report dated February 8, 1999, and testimony, has made a decision in the matter. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. The Planning Commission determines that the Mitigated Negative Declaration/ Initial Study prepared for the Zone Change is complete, has been prepared in compliance in CEQA, and City policy, and the contents in the Mitigated Negative Declaration/ Initial Study have been considered in the various decisions on the proposed Zone Change. In order to reduce the potential for adverse impacts, mitigation measures discussed in the Mitigation Monitoring Program have been imposed as conditions of project approval. SECTION 3. A Mitigation Reporting and Monitoring Program has been prepared in compliance with Assembly Bill 3180 and considered in the various decisions regarding the proposed project. SECTION 4. The City Council adopts the Mitigated Negative Declaration and Mitigation Monitoring Program. SECTION S. That the City Council determined that the impacts for the proposed General Plan Amendment would not have a significant adverse effect on the environment. SECTION 6. The Planning Commission recommends to the City Council approval of a change in Zoning Designation to Residential Planned Development (RPD) 16.2 units per acre), with the exception of the area along the southerly portion of the property required to be dedicated to the Ventura County Flood Control District which will have the Zoning Designation of OS (Open Space), on approximately 19.2 acres of land located southerly of Los Angeles Avenue bordered by the flood control channel to the south, Moorpark Avenue on the east, and undeveloped land on the west (APN. 506 -0- 050 -275) on the application of Archstone Communities (Security Capital Pacific Trust) PASSED, APPROVED, AND ADOPTED THIS 8t° DAY OF FEBRUARY 1999.
