A RESOLUTION OF THE MOORPARK PLANNING COMMISSION OF
THE CITY OF MOORPARK, CALIFORNIA, RECOMMENDING THAT
THE CITY COUNCIL AMEND THE CITY'S ZONING CODE TO
ALLOW DAY CARE CENTERS IN COMMERCIAL AND INDUSTRIAL
ZONES.
WHEREAS, on April 5, 1989 the City Council directed the Planning
Commission to set a public hearing to review the Child Day Care Center
requirements and part of said directive was to provide a recommendation
so as to update the City's requirements.
WHEREAS, studies and investigations were made, and a staff report
and recommendations were prepared.
WHEREAS, the Planning Commission, upon giving the notice required
by the provisions of Section 8163 -5 of the Moorpark Municipal Code and
Section 65905 of the Government Code (beginning at Section 65850) did, on
May 1, 1989 conduct a public hearing and adopted staff recommendations dated
the 25th day of April 1989.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK
RESOLVES AS FOLLOWS:
SECTION 1. The Commission hereby recommends to the City Council
allowance for Child Day Care Centers in the expansion of the C -0
(Commercial Office), C -1 (Neighborhood Commercial), C -2 (General
Commercial, CPD (Commercial Planned Development), M -1 (Industrial Park
District), M -2 (Limited Industrial District).
SECTION 2. The Commission hereby recommends to the City
Council the requirement of a Conditional Use Permit for the establishment
of Child Day Care Centers in commercial or industrial zones.
SECTION 3. The Commission hereby recommends to the City
Council amendments to:
Article 10, Section 8128 -1, adding Child Day Care Centers;
Article 11, Section 8129 -1, adding Child Day Care Centers;
Article 12, Section 8130 -1, adding Child Day Care Centers;
Article 21, Section 8139 -1, adding Child Day Care Centers
sponsored by or permitted within the Commercial Office Use
on the same site;
Article 23, Section 8141 -1.4 and Section 8141 -2.4 adding
Child Day Care Centers sponsored by or permitted within the
Industrial Use on the same site;
Article 47, Section 8170 -0 adding a definition for Child Day
Care Centers as follows:
Shall mean an establishment where care or supervision is
provided on less than twenty -four (24) hour per day basis,
limited to children only, which is licensed according to
applicable State law. These terms shall include Nursery
Schools.
PASSED, APPROVED AND ADOPTED THIS 15TH DAY OF MAY 1989.
