A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
MOORPARK, CALIFORNIA, RECOMMENDING THAT INDUSTRIAL
PLANNED DEVELOPMENT PERMIT NO. IPD -88 -2 AND VARIANCE NO.
V -88 -2 ON THE APPLICATION OF ROBERT AND SHARON RIDDLE BE DENIED
WITHOUT PREJUDICE.
WHEREAS, at a duly noticed public hearing on June 19, 1989, the
Planning Commission considered the application filed by Robert and Sharon
Riddle requesting approval to construct a 24,000 square foot automotive
center on a 1.35 -acre site located at 13840 East Los Angeles Avenue
(Highway 118), approximately one - fourth mile east of the intersection of
Spring Road, High Street, and Los Angeles Avenue; and
WHEREAS, the Planning Commission reviewed and considered the
information contained in the Staff Report dated May 30, 1989, and the
Mitigated Negative Declaration; and
WHEREAS, at the Planning Commission's meeting of June 19, 1989, the
Commission opened the public hearing, took testimony from all those wishing
to testify, closed the public hearing, and directed staff to prepare a
F ^ Resolution for the Planning Commission's decision;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. The Planning Commission hereby adopts the findings
contained in the Staff Report dated May 30, 1989, which report is
incorporated herein by reference as though fully set forth.
SECTION 2. The Planning Commission hereby recommends that the City
Council deny the requested Industrial Planned Development Permit and
Variance based on the findings contained in the Staff Report dated May 30,
1989, and based on the following reasons:
The applicant has not agreed to all mitigation measures which are
proposed to reduce project environmental impacts to an
insignificant level.
The project requires zoning code variances which are not
justified and for which the required "showings" cannot be made.
An alignment study for all of East Los Angeles Avenue (Highway
118) should be completed prior to project approval.
SECTION 3. At the Planning Commission's meeting of June 19, 1989, the
Commission took action to direct staff to prepare a Resolution to recommend
to the City Council that Industrial Planned Development Permit No. IPD -88 -2
and Variance No. V -88 -2 be denied without prejudice; said Resolution to be
presented for consent calendar approval at the next regular scheduled
meeting. That action with the foregoing direction was approved by the
following roll call vote:
AYES: Commissioners Wozniak, Lanahan, and Chairman Holland
NOES: Commissioners Schmidt and Scullin
ABSENT: None
PASSED, APPROVED AND ADOPTED THIS 17TH DAY OF JULY 1989.
