A RESOLUTION OF THE MOORPARK PLANNING
COMMISSION OF THE CITY OF MOORPARK,
CALIFORNIA, APPROVING CONDITIONAL USE PERMIT
NO. CUP -89 -2 ON THE APPLICATION OF FRANZ WOLF.
Whereas, at a duly noticed public hearing on June 4,
1990, June 11, 1990, the Planning Commission considered the
application filed by Franz Wolf requesting approval to allow office
and other uses permitted under Sections 8141- 2.4.1, 8141 - 2.4.5,
8141 -2.4.6 and 8141 -2.4.7 of the City of Moorpark Zoning Ordinance.
Located at 5301 Commerce Avenue, Moorpark, CA.
Whereas, the Planning Commission after review and
consideration of the information contained within Section 21084 of
the Public Resources Code which requires that the CEQA Guidelines
include a list of classes and projects which have been determined
not to have a significant effect on the environment and which
shall, therefore, be exempt from the provisions of CEQA. This
projects is exempt from CEQA pursuant to Section 15301 of the CEQA
Guidelines - Class 1 Exemption - which consists of the operation
of existing facilities involving negligible expansion of use beyond
that previously existing. The Planning Commission has reached
their decision in the matter;
Now, therefore, the Planning Commission of the City of
Moorpark, California, does resolve as follows:
Section 1. That the findings contained in the staff
report dated June 4, 1990, which report is incorporated by
reference as though fully set forth herein are hereby approved;
Section 2. That at its meeting of June 11, 1990, the
Planning Commission took action to direct staff to prepare a
resolution with the attached recommended conditions, approving
Conditional Use Permit No. CUP -89 -2; said resolution to be
presented for Consent Calendar action at the next regularly
scheduled meeting. The action with the foregoing direction was
approved by the following roll call vote;
Ayes: Commissioner Schmidt, Scullin, Talley and
Lanahan;
Nones: None;
Absent: John Wozniak.
Passed, approved and adopted this day of July 2, 1990.

GENERAL REQUIREMENTS:
1. That this Conditional Use Permit is approved only for the
second floor of Building B -1 as shown on the Plot Plan and is
granted to allow the applicant to rent 6,000 square feet of
leasable floor space to the following types of users:
Professional offices of engineering, architectural,
industrial design, or similar activities, and
administrative offices of commercial or financial
establishments pursuant to Section 8141 -2.4.5 of the City
of Moorpark Zoning Ordinance.

4. Prior to tenant occupancy and any subsequent change in tenant
occupancy, the owner of the subject building, or the owner's
representative shall apply for a Zoning Clearance and a
Business Registration Permit from the Community Development
Department.
