PC -90 -220 A RESOLUTION OF THE PLANNING COMMISSION, CITY OF MOORPARK, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL THAT THE DRAFT ENVIRONMENTAL IMPACT REPORT BE CERTIFIED WITH RECOMMENDED MODIFICATIONS TO THE CARLSBERG SPECIFIC PLAN. WHEREAS, an application has been made by Carlsberg Financial Corporation to the City of Moorpark for the Carlsberg Specific Plan; and WHEREAS, Environmental Impact Report SCH *90010229 provided an environmental assessment of the proposed Specific Plan in accordance with the California Environmental Quality Act and State CEQA Guidelines; and WHEREAS, the Planning Commission held duly noticed Public Hearings on July 2 and July 16, 1990 to consider evidence and testimony presented by the Moorpark planning staff, project consultants, the applicant and interested members of the public and on July 16, 1990, recommended to the City Council approval of the r Specific Plan and Certification of the Draft EIR subject to recommended changes; and WHEREAS, the proposed Specific Plan is compatible with the objectives, policies and goals specified in the Moorpark General Plan; and WHEREAS, at the Planning Commission hearings of July 2 and July 16, 1990, the Commission opened the public hearing, took testimony of all those wishing to testify, closed the public hearing, and directed staff to prepare a resolution. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. The Planning Commission hereby finds that adoption of the proposed Specific Plan would serve to further protect the public health, safety and welfare of the community. SECTION 2. The Planning Commission hereby finds that adoption of the proposed Specific Plan (Exhibit A) would not result in an inconsistency with the City's General Plan. SECTION 3. The Planning Commission hereby finds that the draft EIR adequately addressed the Specific Plan with the exception of controlling the impact of construction in relation to traffic, grading and dust control; that partial mitigation measures provided for Spring Road traffic circulation, and the premature assumption of the 188/23 Freeway connector should be considered as a mitigation measure without specific information of a completion date. SECTION 4. The Planning Commission recommends to the City Council certification of the EIR with modifications as noted. SECTION 5. The Planning Commission recommends to the City Council adoption of the Carlsberg Specific Plan (Exhibit A) with the following land use changes: (1) Project Area 1 - be changed from 1 dwelling unit per acre to 1 dwelling unit per /2 acres. (2) Project Area 2 - be changed from SF 9,000 to 1 dwelling unit per /2 acres. (3) Project Area 3 - To be shown as the future middle school site. (4) Project Area 5 - Increase density for the multi - family site if needed to off -set loss of units in Planning areas 1 and 2. That the multifamily area should provide affordable housing opportunities. (5 ) Project Area 12 - Be developed with some SF 9,000 sq. ft. lots on the east side of Science Drive. SECTION 6. The Planning Commission recommends to the City Council that modifications to project areas, so as to increase acreage and providing less dwelling units, not be a consideration by the City in providing a balance dwelling unit averaging for the developer. SECTION 7. The Planning Commission recommends to the City Council that the developer not be required to provide the extreme heavily landscaped areas identified as a "gateway ", but to consider heavy landscaping within the Specific Plan itself. SECTION B. The Planning Commission recommends to the City Council that all residential development along Spring Road be setback (eastward) behind the hills, thereby blocking the new houses view of the nearby present residents which would also create more space along Spring Road. SECTION 9. That drought tolerant plants be provided within the landscape plan and along greenbelt areas at Spring Road and Tierra Rejada Road. Passed, approved and adopted by Resolution No. PC -90 -220. -2- s SECTION 10. That at its meeting of July 16, 1990, the Planning Commission took action and recommended to the City Council that the Environmental Impact Report be certified with modifications to the Specific Plan and directed staff to prepare a resolution for consent calendar at their next regular meeting of July 16, 1990. The action with the foregoing direction was approved by the following vote: Ayes: Commissioners Schmidt, Lanahan, Wozniak, Talley; Noes: Commissioner Scullin.
