A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
MOORPARK, CALIFORNIA, DENYING WITH PREJUDICE CUP 92 -2 ON THE
APPLICATION OF ALLIANCE CHEMICAL AND ENVIRONMENTAL, INC.,
ASSESSOR'S PARCEL NO. 511 -07 -71
Whereas, at a duly noticed public hearing on June 1 and 15,
1992, the Planning Commission considered the application filed by
Alliance chemical and Environmental, Inc. requesting approval of a
Conditional Use Permit to allow an existing industrial building to
be used as a metal anodizing plant and a research and development
facility to solve environmental development problems in the metal
finishing industry; and
Whereas, at its meeting of June 1, 1992, the Planning
Commission opened the public hearing, took testimony from all those
wishing to testify, and continued the public hearing to June 15,
1992; and
Whereas, the Planning Commission has received information
contained in the staff reports and testimony; and has found that
the proposed use would not meet the Permit Standards as found in
Section 8111 -2.1.2 of the City's Zoning Ordinance; and
Whereas, the Planning Commission has received information that
denial with prejudice of the Conditional Use Permit is necessary
because testimony at the public hearings provided sufficient
evidence that the proposed use would be detrimental to the public
interest and convenience, is not compatible with the residential
uses to the east of the proposed site and may impair the utility of
the neighboring residential uses;
Whereas on June 15, 1992, the Planning Commission reached its
decision on this matter.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. The Planning Commission hereby adopts the
following findings for Conditional Use Permit No. 92 -2 in that the
proposed use:
a. Would not be compatible with the residential uses located
to the east of the proposed project.
b. May impair the utility or use of the neighboring
residential properties.
C. Would be detrimental to the public interest and
convenience.
d. Is not compatible with the existing residential uses

SECTION 2. The Planning Commission hereby denies with
prejudice Conditional Use Permit No. 92 -2 on the application of
Alliance Chemical and Environmental, Inc.
The action of the foregoing direction was approved by the following
roll vote:
AYES: Brodsky, May, Miller;
NOES: Wesner, Torres.
PASSES, APPROVED, AND ADOPTED THIS 6TH DAY OF JULY 1992.
