A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF MOORPARK RECOMMENDING THE
RESIGNATION OF ORDINANCE NUMBER 154 AND
ZONE CHANGE ON ASSESSOR'S PARCEL NUMBER
512 -0- 150 -380 (MCDONALD'S CORPORATION PROJECT
PARCEL - CPD 92 -21 LDM 92 -1, ZC 92 -4)
FROM C -2 (GENERAL COMMERCIAL) TO
CPD (COMMERCIAL PLANNED DEVELOPMENT)
WHEREAS, on November 4, 1992, the City Council adopted
Ordinance Number 154 changing the zoning designation on Assessor's
Parcel Number 512 -0- 150 -380 from Residential Planned Development
(RPD) to C -2 (General Commercial); however, the intended zoning
designation was Commercial Planned Development (CPD); and
WHEREAS, it was determined by staff that the zoning on the
subject site would need to be modified; and
WHEREAS, at a duly notice public hearing on April 5, 1993 the
Planning Commission opened the public hearing, received public
testimony, and closed the public hearing; and
WHEREAS, the proposed zone change would modify the zoning on
Assessor's Parcel Number 512 -0- 150 -380 from C -2 (General
Commercial) to CPD (Commercial Planned Development); and
WHEREAS, the proposed zoning of CPD would be consistent with
the General Plan land use designation of C -2 on the subject parcel.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARR,
CALIFORNIA, DOES RESOLVE As FOLLOWS$
SECTION 1. The Mitigated Negative Declaration (comprised
of Commercial Planned Development 92 -2, Land Division Map 92 -1 and
Zone Change 92 -4) prepared address the impacts of the development
project, including the Zone Change.
SECTION 2. That based upon the information set forth, it
is determined that the zone change is justifiable in terms of
public convenience, general welfare, and good zoning practice. It
has been ascertained that the zone change is consistent with the
Moorpark General Plan.
SECTION 3. That the official Zoning Map of the City of
Moorpark is hereby amended, changing the zone and zone boundaries
shown on a portion of said Zoning Map so that such portion of said
Zoning Map shall be as shown on Attachment A, hereto and made a
part hereof.

SECTION 4. That the Planning Commission recommends to the
City Council the resignation of Ordinance Number 154 and adoption
of the zoning on Assessor's Parcel Number 512 -0- 150 -380 as CPD.
The action with the foregoing direction was approved by the
following roll call vote:
