PC -94 -287 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, FINDING THAT THE PROPOSED ACQUISITION AND VISPOSITION OF PROPERTY BY THE CITY AND CONSTRUCTION AND AUTHORIZATION OF A PUBLIC' BUILDING OR STRUCTURE RELATED TO A NEW CALTRANS MAINTENANCE STATION (INDUSTRIAL PLANNED DEVELOPMENT PERMIT NO. IPD -93 -2) IS IN CONFORMITY WITH THE GENERAL PLAN OF THE CITY OF MOORPARK WHEREAS, California Government Code Section 65402(a) requires that no real property shall be acquired by dedication or otherwise for street, square, park or other public purposes, and no real property shall be disposed of, and no public building or structure shall be constructed or authorized, if the adopted general plan or part thereof applies thereto, until the location, purpose and extent of such acquisition or disposition, or such public building or structure have been submitted to and reported upon by the planning agency as to conformity with said adopted general plan or part thereof; and WHEREAS, California Government Code Section 65402(a) also requires the planning agency to render its report as to conformity with said adopted general plan or part thereof within 40 days after r, the matter was submitted to it, or such longer period of time as may be designated by the legislative body; and WHEREAS, at its meeting of January 18, 1994, the Planning Commission reviewed a staff report, and discussed the location, purpose and extent of the proposed acquisition and disposition of a 4.15 -acre property located east of the Minor Street and Fitch Avenue intersection (Assessor's Parcel Number 512 -0- 150 -515), zoned Industrial Park, and designated Light Industrial in the General Plan, for the purposes of construction of a California Department of Transportation (Caltrans) Maintenance Station, and reached its decision on General Plan conformity; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. Pursuant to Section 65402(a) of the California Government Code, the Planning Commission has reviewed the location, purpose and extent of the proposed acquisition and disposition of a property located on Fitch Avenue (Assessors Parcel Number: 512 -0- 150 -515) for the purposes of construction of a Caltrans Maintenance Station, and has determined that the proposed acquisition and disposition of the property and the construction and authorization of a public building or structure (IPD -93 -2) are in conformity with the General Plan of the City of Moorpark.
