HomeMy WebLinkAboutRES 1995 314 1113r''1` 1tl,*7, RESOLUTION NO. 95 -314 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA RECOMMENDING TO THE CITY COUNCIL THE PROPOSED AMENDMENT TO THE MOORPARK MUNICIPAL CODE THE ADDITION OF SECTION NO. 17.32.011 REGARDING SECOND DRIVEWAYS IN RESIDENTIAL ZONES Whereas, the City Council may initiate proceedings to consider amendments to the Zoning Code by the adoption of a resolution of intention requesting the Planning Commission to set the matter for study, public hearing, and recommendation within a reasonable time; and Whereas, on October 4, 1995, the City Council authorized the initiation of proceedings to consider amendments to revise the Zoning Ordinance for the purpose of considering the amendment to the City's Zoning Ordinance regarding 2nd driveways in residential zones and adopted a resolution directing the Planning Commission to study, set a public hearing and provide a recommendation to the ,,-,,..,City Council pertaining to the addition of Section 17.32.011 regarding second driveways in residential zones; and Whereas, That the Planning Commission at a duly noticed public hearing on November 13, 1995 opened the public hearing, took testimony and closed the public hearing; and whereas, the Planning Commission provided a recommendation to the City Council pertaining to the addition of Section 17.32.011 regarding second driveways in residential zones. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. The Planning Commission recommends to the City Council the addition of Section 17.32.011 regarding second driveways in residential zones to the Moorpark Municipal Code - City of Moorpark Zoning Ordinance as shown in Section 2. SECTION 2. 17.32.011 Second Driveways in Residential Zones Second driveways and driveway approaches for residential structures are only permitted on corner lots or lots with a street frontage of more than 100 feet. PP10106i95110i13aM: \13N0V95.PC NO.1 A. Maximum Number No more than two driveway approaches per street frontage shall be allowed. B. Minimum Setbacks 1. Driveway approaches shall have a minimum setback of 60 feet from the corner radius (as measured from the end of the radius to full curb height). 2. Driveway approaches shall have a minimum setback of 40 feet from any other driveway approach on the same property frontage (as measured from full curb height to full curb height). 3. Driveway approaches shall have a minimum setback of 10 feet from any other driveway approach on an adjacent property (as measured from full curb height to full curb height). C. Required Development Standards 1. If a gate is to be used over the driveway, and if said gate is less than 20 feet from the curb, the gate shall swing inward or be a sliding /rolling type parallel to the property line. 2. Second driveways shall be located a minimum of 5 feet from the property line. 3. The second driveway shall have a maximum width ''" J lw of 12 feet. D. Approval Process Construction of a second driveway for a residence requires approval of an Administrative Permit as described in Section 17.44.030. PASSED, APPROVED, AND ADOPTED THIS 13TH DAY OF NOVEMBER, 1995.
