HomeMy WebLinkAboutRES 1997 338 0609RESOLUTION N0, PC -97 -338 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA DETERMINING THAT THE VACATION OF PEDESTRIAN EASEMENTS ON LOTS 64 AND 65 OF TRACT 4342 -3 AT THE EAST END OF SAGEWOOD DRIVE IS IN CONFORMANCE WITH THE GENERAL PLAN OF THE CITY OF MOORPARK AND RECOMMENDING TO THE CITY COUNCIL THAT THE AREA TO BE VACATED IS NOT REQUIRED AS A NON- MOTORIZED TRANSPORTATION FACILITY. WHEREAS, State law requires that no public easements shall be vacated until the location, purpose and extent has been reported upon by the planning agency of the city as to conformity with the General Plan, and; WHEREAS, the City Council of the City of Moorpark is about to consider the matter of vacating pedestrian easements at the east end of Sagewood Drive the locations and extent of which is generally shown as "10' Pedestrian Access Easement to the City of Moorpark" Attachment "A ", and; WHEREAS, State law requires that rights -of -way shall not be abandoned unless the City Council of the City of Moorpark determines that such rights of way are not useful as a non - motorized transportation facility. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK DOES HEREBY RESOLVE: Section 1. That the vacation of pedestrian easements on the east end of Sagewood Drive as generally shown on Attachment "A ", as the "10' Pedestrian Access Easement to the City of Moorpark ", is in conformance with the adopted General Plan of the City of Moorpark. Section 2. To recommend to the City Council that pedestrian easements at the east end of Sagewood Drive, to be vacated, as generally shown on Attachment "A" as the "10' Pedestrian Access Easement to the City of Moorpark ", is not required for a non- motorized transportation facility.
