PC- 2001 -404 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA RECOMMENDING TO THE CITY COUNCIL APPROVAL OF ZONE CHANGE NO. 99 -01 FOR A CHANGE IN THE ZONING DESIGNATION FROM RE -5 ACRE MINIMUM LOT SIZE TO RESIDENTIAL PLANNED DEVELOPMENT (RPD) 1.80 DWELLING UNITS PER ACRE AND OPEN SPACE (OS) ON NINE PARCELS (APN'S 500 -260- 025, -045, -075, -085, AND -095; 500 -270- 090, -140, -155, AND -165) TOTALING APPROXIMATELY 350 GROSS ACRES OF LAND LOCATED WEST OF WALNUT CANYON ROAD AND APPROXIMATELY ONE -HALF MILE NORTH OF CASEY ROAD ON THE APPLICATION OF WEST POINTE HOMES, INC. WHEREAS, at a duly noticed Public Hearing on February 26, 2001, the Planning Commission considered Zone Change No. 99 -01 filed by West Pointe Homes, Inc. for a change in the Zoning from RE -5 acre minimum lot size to Residential Planned Development (RPD) 1.80 dwelling units per acre and Open Space (OS) on nine �^ (9) parcels (APN'S 500- 260 -025, -045, -075, -085, and -095; 500 - 270 -090, -140, -155, and -165) totaling approximately 350 gross acres of land located west of Walnut Canyon Road and approximately one -half mile north of Casey Road. WHEREAS, at its meeting of February 26, 2001, the Planning Commission opened the public hearing, received public testimony, and continued this item to March 12, 2001, at which time the Planning Commission closed the public hearing; and WHEREAS, the Planning Commission of the did hold a public hearing on October 23, 2000, and continued the public hearing to November 13, 2000; November 27, and December 11, 2000; at which time the public hearing was closed and the Planning Commission did adopt Resolution No. 2000 -401 recommending to the City Council certification of EIR -SCH- 94081075 which provides an evaluation and mitigation measure for the proposed project; and WHEREAS, the Planning Commission, after review and consideration of the information contained in the Planning Commission staff report, and testimony received, has made a decision in this matter. ! PC- 2001 -404 West Pointe Zone Change 99 -01 Page 2 NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. The Planning Commission does hereby find that Zone Change No. 99 -01 is consistent with the General Plan. SECTION 2. The Planning Commission does hereby find that Zone Change No. 99 -01 is consistent with the approved EIR. SECTION 3. That the Planning Commission adopts the following additional findings: California Environmental Quality Act (CEQA) Findings 1. That EIR SCH- 94081075, prepared for West Pointe Homes and its ancillary applications, approved by the Planning Commission and recommended for certification to the City Council on December 18, 2000, in Resolution No. PC 2000 -401 r^ serves as the environmental document for Zone Change No. 99 -01 as permitted by Section 15182 of the Guidelines to implement CEQA as adopted by the California Resources Agency. 2. In order to reduce the potential adverse impacts of this project, mitigation measures discussed in the approved EIR have been incorporated and shall apply to Zone Change No. 99 -01. 3. A Mitigation Reporting and Monitoring Program prepared in compliance with Assembly Bill 3180 and considered in the various decisions regarding these projects applies to Zone Change No. 99 -01. SECTION 4. That the Planning Commission recommends to the City Council approval of: Zone Change No. 99 -01 for a change in Zone District Designation on the City of Moorpark Zoning Map and the City of Moorpark Municipal Code Title 17; Zoning, from RE -5 acre minimum lot size to Residential Planned Development (RPD 1.80 dwelling units per acre and Open Space (OS) as further described in Exhibit A. That the approval of Zone Change No. 99 -01 is contingent upon final approval of General Plan Amendment No. 99- 01 by the City Council. The action of the foregoing direction was approved by the following roll call vote: AYES: Commissioner DiCecco, Haller, Landis, Otto and Parvin. NOES: ABSTAIN: ABSENT: PASSED AND ADOPTED THIS 12th DAY OF MARCH 2001.
