HARE City Treasurer By EMORANDUM TO: The Honorable City Council FROM: Susan Cauldwell, Administrative Assists DATE: January 29, 1990 SUBJECT: Villa Campesina Assessment District Charges (FY88-89 and FY89-90) Karen Flock, Cabrillo Economic Development Corporation, recently requested (letter attached) that the City recalculate lighting and landscaping assessments for FY88-89 and lighting and landscaping and parks assessments for FY89-90 for Tract 4147 (Villa Campesina) because the assessments appeared to be in error. A staff review indicated that the assessments were in fact too high. For your information, the County has granted Cabrillo an exemption from property taxes on Tract 4147 because the organization is developing low income housing and because the land is vacant. Ownership of many of the parcels had been transferred from Cabrillo to individual property owners since the calculation of the assessments and the issuance of the tax bills. Payment of the December 1989 tax installments has been made (in some cases) partially by Cabrillo and partially by the new property owners. Since many of the residents will be eligible for a rebate of the assessments, the question of how to refund assessments paid by multiple parties has arisen. Staff believes the most efficient way to resolve the above two issues is to waive all assessments for Tract 4147 for the FY88-89 and FY89-90. Since the assessments for FY88-89 have already been paid, it would be appropriate to process a refund to Cabrillo immediately. The total landscaping and lighting assessments paid on the 62 lots in FY88-89 was $7969.48. Proof of payment has been submitted to staff. The correct assessment of these properties as residential vacant would have resulted in total assessments of $1382.60. The rebate will be made payable to the owner of record as listed on the property tax bill. No refunds for FY89 -90 assesments will be made until both installments of the tax bill have been paid and no rebates will be made on delinquent tax bills. A notice will be sent to all current property owners advising them of the rebate. In those instances where the property had been transferred and more than one party had paid the assessment, it will be Cabrillo's responsibility to pass the prorated portion of the rebate on to the new owners, since Cabrillo is listed as the owner of record. It is suggested that the City Council permit the City Manager or his designee the right to review the distribution of rebates by Cabrillo. The total landscaping and lighting and parks assessments due on 42 parcels in FY89 -90 is $12;989.20. The breakdown is $4596.40 for AD84 -2 and $8311.80 for AD85 -1. The correct assessment of these parcels as residential vacant would have resulted in total assessments of $892.92 ($21.26 for AD84 -2 and $0.00 for AD85 -1). This revenue loss can be covered by anticipated cost savings in AD84 -2 and AD85 -1 for FY89 -90 or made up in future years' assessments. Staff recommends that the City Council waive all assessments for Tract 4147 for FY89 -90 and direct staff to process rebates in amounts not to exceed $4586.40 for AD84 -2 and $8311.80 for AD85 -1 in accordance with the procedures outlined above. 3.
