Gilbert, Director of Public Works DATE: May 21, 1999 (Council Meeting 6-2-99) SUBJECT: Consider Resolution No. 99- Approving Program Supplement No. M003 to City / State Agreement No. 07- 5436 Related to the 1999 Asphalt Overlay Project Background As a separate matter, on June 2, 1999, the City Council will consider the award of a contract for the construction of the 1999 Asphalt Overlay Project . This report pertains to a Federal grant partially funding that project. Discussion The arterial streets to be resurfaced by the 1999 Asphalt Overlay Project are to be partially funded by a Surface Transportation Program (STP) grant . The STP program is one of the many highway programs which comprise the Federal TEA-21 (Transportation Efficiency Act for the Twenty-First Century) program. The amount of this grant is limited to 88 .5% of the construction costs, not to exceed $663 , 999 [$750, 281 x 88 . 5% = $663, 999] . In that the total price for eligible items of the contract will exceed $750, 281, the City will receive the full amount of the grant . The procedures pertaining to the administration of these funds require the City and Caltrans to execute the attached Program Supplement Agreement . Caltrans also requires that the City Council adopt a resolution (also attached) authorizing execution of this Supplement Agreement . Acovrly_sup_agre OOO54J Spring Road Bridge Program Supplement May 21, 1999 Page 2 RECOMMENDATION Replacement Agreement Staff recommends that the City Resolution approving the subject authorizing the Mayor to execute City Council. spgbr92 Council adopt the attached Supplemental Agreement and said document on behalf of the 000 "IJ RESOLUTION NO. 99 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING A SUPPLEMENTAL AGREEMENT BETWEEN THE CITY OF MOORPARK AND THE STATE OF CALIFORNIA DEPARTMENT OF TRANSPORTATION PERTAINING TO THE 1999 ASPHALT OVERLAY PROJECT [DBMAL- 5436(004); EA NO. 07- 9313101 WHEREAS, the City has applied for and has received approval of Federal Surface Transportation Program (STP) funds for the partial funding of the 1999 Asphalt Overlay Project; and WHEREAS, it is necessary and appropriate to document the receipt of said grant funding through the execution of a Supplemental Agreement to City / State Agreement pertaining to Federal -Aid Projects. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That Program Supplement No. M003 to Agreement No. 07 - 5436 is hereby approved. SECTION 2. That the Mayor of the City of Moorpark is hereby authorized to execute said Program Supplement on behalf of the City. SECTION 3: The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. Number : 07- 931310 This Program Supplement is hereby incorporated into the Agency -State Agreement for Federal Aid which was entered into between the Agency and the State on 03/01/96 and is subject to all the terms and conditions thereof. This Program Supplement is adopted in accordance with Article I of the aforementioned Master Agreement under authority of Resolution No. approved by the Agency on (See copy attached). The Agency further stipulates that as a condition to payment of funds obligated to this project, it accepts and will comply with the covenants or remarks setforth on the following pages. The Local Agency will furnish a qualified Resident Engineer for the contract. 2. The Local Agency will reimburse the State for their share of costs for work requested to be performed by the State. 3. The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the'Federal Highway Administration in the Federal -Aid Project Agreement (PR -2) /Detail Estimate, or its modification (PR -2A) or the FNM -76, and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Office of Local Programs Project Implementation. 4. The Local Agency will advertise, award and administer this project in accordance with the current Local Assistance Procedures Manual. 5. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article III MAINTENANCE of the aforementioned Master Agreement will be the responsibility of the Local Agency and shall be performed at regular intervals or as required for efficient operation of the completed improvements.
