Traffenstedt, ATCM /City Cl k S t BY: La -Dell VanDeren, Deputy City Clerk 7,6 DATE: January 8, 2002 (Special CC Meeting of 1/9/02) SUBJECT: Consider Rejection Of Claim: Robynn Tholander BACKGROUND On November 26, 2001, the City received the above referenced claim for damages. The claim was forwarded to the City's claims adjuster for review. DISCUSSION This referenced claim describes an incident that occurred on November 8, 2001. Robynn Tholander is claiming property damage to her motor vehicle due to her failure to stop at the intersection of Tierra Rejada and Miller Parkway and her collision with another vehicle. The claimant states that the traffic signals were not operational at that location and that there were no stop signs posted at the intersection. Our preliminary field investigation found that a contractor was working on the traffic signals at that location and had placed the traffic controls (stop signs) in the intersection.. The police report filed states that stop signs were in place at the intersection at the time of the incident and that the claimant was cited for failure to stop for inoperative traffic lights. The City's claims adjuster has recommended that a standard rejection letter be sent to the claimant. STAFF RECOMMENDATION Reject the claim and direct staff to send a standard rejection letter to the claimant.
