TO THE MEMBERS OF THE MOORPARK CITY COUNCIL:
NOTICE IS HEREBY GIVEN that a Special Meeting of the City
Council of the City of Moorpark is hereby called to be held on
Wednesday, March 5, 2003, commencing at 6:00 p.m. Said meeting
will convene in the Moorpark Community Center located at 799
Moorpark Avenue, Moorpark, California.
Said Special Meeting shall be for the purpose of

SUBJECT: Consider Ordinance Amending Title 10, Vehicles and
Traffic, by Adding New Chapter 10.20, Skateboard,
Motorized Skateboard, Motorized Scooter, Roller Skate
and In -Line Skate Regulations
BACKGROUND AND DISCUSSION
Staff has prepared the attached draft ordinance in response to a
request by Mayor Hunter. The ordinance, if approved, would add
a new chapter to Title 10 of the Municipal Code and would permit
prohibition of the use of skateboards, motorized skateboards,
motorized scooters, roller skates and in -line skates on both
public and private property where notice has been provided
through the use of stenciled signage on sidewalks or other paved
surfaces and the use of posted signs at all entrances to a
property. The minimum size specified for the notice sign in the
draft ordinance is based on the size required by the Vehicle
Code when a city or county finds and declares that there are
privately owned and maintained off - street parking facilities for
which the Vehicle Code will be enforced. The intent was to
provide signage consistency so as to ensure enforcement
consistency.
The attached ordinance has been drafted with similar language to
existing code sections for the cities of Camarillo and Thousand
Oaks. If the ordinance is introduced for first reading at the
March 5 Special Meeting, second reading could be scheduled for
the regular City Council meeting on March 19, 2003.

AN ORDINANCE OF THE CITY OF MOORPARK,
CALIFORNIA, AMENDING TITLE 10, VEHICLES AND
TRAFFIC, BY ADDING NEW CHAPTER 10.20,
SKATEBOARD, MOTORIZED SKATEBOARD, MOTORIZED
SCOOTER, ROLLER SKATE AND IN -LINE SKATE
REGULATIONS
WHEREAS, the City Council has determined that regulations
are needed to allow prohibition of skateboarding, motorized
skateboarding, motorized scooter operation, roller skating and
in -line skating use on posted public and private property; and
WHEREAS, the City Council considered first reading of an
ordinance amending Title 10, Vehicles and Traffic, by adding new
Chapter 10.20, Skateboard, Motorized Skateboard, Motorized
Scooter, Roller Skate and In -line Skate Regulations, at its
special meeting on March 5, 2003.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES ORDAIN AS FOLLOWS:
SECTION 1. Chapter 10.20 is hereby added to Title 10,
Vehicles and Traffic, to read as follows:

10.20.010 Definitions.
Whenever any words or phrases used in this chapter are
not defined in this chapter, but are defined in the State
of California Vehicle Code, such definitions are

incorporated in this chapter and shall be deemed to apply
to such words and phrases as used in this chapter as though
set forth herein in full.
10.20.020 Skateboarding, motorized skateboarding,
motorized scooter operation, roller skating and
in -line skating prohibited where posted -- Public
property.
A. No person shall ride, propel or in any manner operate
a skateboard, motorized skateboard, motorized scooter,
roller skate or in -line skates on, along, or over any
public street, on any bikeway, bicycle path or trail, or
hiking or recreational trail, sidewalk, right -of -way or
other public property of the city and its Redevelopment
Agency where the City Council has prohibited the same by
resolution.
B. The prohibition set forth in this section shall not
apply until notice has been provided in accordance with
this section.
1. Notices shall be provided in and about the area where
the activity is to be prohibited. Notices shall be placed
in locations and in sufficient numbers so that they are
reasonably likely to be seen by those engaging in the
prohibited activities. The notice may be stenciled
directly onto the sidewalk or other paved surfaces and
shall be provided on a sign that is displayed, in plain
view, at each entrance to the area where the activity is to
be prohibited.
2. Each notice stenciled directly onto the sidewalk or
other paved surfaces shall identify in uppercase letters at
least two (2) inches in height, which activities are
prohibited, and underneath shall provide in, print at least
one (1) inch in height, "Moorpark M.C. 10.20.020."
3. Each notice placed on a sign shall be not less than
seventeen (17) by twenty -two (22) inches in size, with
lettering not less than one (1) inch in height, and shall
identify which activities are prohibited and "Moorpark M.C.
10.20.020."

manager, or other person in charge has prohibited the same.

10.20.040 Violation -- Penalty.
Violation of any provision of this chapter shall be
deemed a misdemeanor /infraction and shall be punishable in
accordance with Chapter 1.12 of this code."

SECTION 2. If any section, subsection, sentence, clause,
phrase, part or portion of this Ordinance is for any reason held
to be invalid or unconstitutional by any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance. The City Council declares
that it would have adopted this Ordinance and each section,
subsection, sentence, clause, phrase, part or portion thereof,
irrespective of the fact that any one or more section,
subsections, sentences, clauses, phrases, parts or portions be
declared invalid or unconstitutional.
SECTION 3. This Ordinance shall become effective thirty (30)
days after its passage and adoption.
SECTION 4. The City Clerk shall certify to the passage and
adoption of this ordinance; shall enter the same in the book of
original ordinances of said City; shall make a minute of the
passage and adoption thereof in the records of the proceedings of
the City Council at which the same is passed and adopted; and
shall, within fifteen (15) days after the passage and adoption
thereof, cause the same to be published once in the Moorpark Star
a newspaper of general circulation, as defined in Section 6008 of
the Government Code, for the City of Moorpark, and which is hereby
designated for that purpose.

Request for Proposals: Santa Monica Mountains Conservancy
Proposition 40 Matching Grant Program
Dear Local Governments and Non - profit organizations:
The Santa Monica Mountains Conservancy is pleased to invite you make an application for
its Proposition 40 Matching Grant Program. The Conservancy recently adopted criteria
for grants to local governments and non- profit organizations, funded by a portion of the
Conservancy's available Proposition 40 funds. The Conservancy set aside up to $2 million
of its current year appropriation for the grant program, and expects to continue the
program for Fiscal Year 03/04. Applicants may submit proposals to the Natural Resources
and Planning Division for consideration.
Eligible applicants are limited to local government entities (i.e., cities, counties, special
districts, joint powers agencies) and 501(c)(3) non - profit organizations. Eligible projects
include land acquisition and park improvement projects that implement the adopted
Conservancy Workprogram, and which include a 50 percent cash match (see definition
below). There is no limit to the size of a potential grant award. However, projects
requesting grants greater than $200,000 are expected to provide a larger cash match of 75
percent. Each entity can submit up to three applications.
All applications must meet the minimum criteria set forth below. Grants will be rated on
a merit basis. No numeric scoring system will be used. Staff will weigh the information in
the proposals and follow up with the applicants for additional information as necessary.
For the sake of equity, once proposals are in, no additional information can be
independently submitted by applicants. Projects would then be recommended to the
Conservancy for funding.
Proposals will be accepted until the available funds are awarded. Up to three projects can
be approved for funding at the Conservancy's March 24, 2003 meeting. Additional grants
will be considered at subsequent Conservancy meetings through the end of 2003.
For projects to be considered at the March 24, 2003 meeting a complete proposal must be
received by mail or overnight delivery no later than 5 pm on Wednesday, March 12, 2003.
For projects to be considered at the Conservancy's April 28, 2003 meeting a complete
proposal must received by mail or overnight delivery no later than 5 pm on April 16, 2003.

delivery are not acceptable. Applications must be addressed to Paul Edelman at the above address in Ramirez
Canyon Park. "Three copies of the grant proposal must be included.
The definition of "cash match" for this program is straightforward. Any cash match, no
matter the source(s), that will directly contribute to the defined project qualifies as dollar for
dollar match. Cash matches for planning, surveys, construction drawings, appraisals, title
reports and other direct costs are limited to fifteen percent of the total project cost. All such
costs and expenditures must be individually described and accounted for in each proposal. In
kind services are too difficult to define and shall not qualify as direct matching funds.
Bargain sales for land acquisitions shall not qualify as cash match but shall be given strong
consideration in the evaluation of proposals.
Staff also recommends that eligible projects must be on either the Conservancy's adopted
Land Acquisition Workprogram or Park Improvements Workprogram. Consideration would
only be made to add a project to either Workprogram if the project's merits and feasibility
were outstanding and it was accompanied by a minimum cash match of seventy -five percent.
Minimum Requirements
An applicant must be either a 501(c)(3) non - profit organization or a local government entity.
Projects must be located in either the Santa Monica Mountains Zone or the Rim of the Valley
Trail Corridor.
Applications must demonstrate a minimum of fifty percent cash match as defined above.
Projects must be on the Conservancy's adopted Acquisition or Improvement Workprograms.
These two Workprograms are blended into a unified list on the Conservancy's web page at
www.smmc.ca.,ov If a proposed project is not contained in either of these documents, the
proposal must include a detailed rationale making the case to add the project to either
Workprogram. Any project added to either Workprogram must include a seventy -five
percent cash match.
The applicant's organization must submit a resolution stating that it will fully comply with
the Santa Monica Mountains Comprehensive Plan if the said project is located in the original
Santa Monica Mountains Zone. This resolution can be submitted later but is a prerequisite to
the preparation of a grant agreement.
The applicant must be willing to enter into a grant agreement with the Conservancy. Such
agreement will include conditions both requiring acknowledgment of the Conservancy's
contribution on project signage and incorporating any other State conditions of Proposition
40 such as signage and audits.
Both improvement projects and acquisition projects must include all the Assessor's Parcel
Numbers of any properties involved in the project.

Proposals must include a detailed discussion of how the project will be maintained.
Other Information
There is no set format on how the proposals should be organized. Project readiness will be looked upon
favorably. The possession of a completed current appraisal, a signed purchase and sale
agreement, site renderings, or construction ready plans all pertain to project readiness. The
extent to which this information can be included in the packages would be advantageous.
Proposals should focus on how the project will guarantee delivery of recreational, ecological,
historical, cultural and /or environmental educational resources and will advance the
Conservancy's mission.
Cash matches greater than fifty percent are encouraged.
Proposals may include the use of up to seven percent of the grant award for administrative
purposes.

RESOLUTION NO. 2003-
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF MOORPARK, CALIFORNIA, SUPPORTING
APPLICATION TO SANTA MONICA MOUNTAINS
CONSERVANCY (CONSERVANCY) FOR PROPOSITION
40 MATCHING GRANT PROGRAM FOR OPEN SPACE
ACQUISITION
WHEREAS, the City Council strongly supports and encourages
efforts to preserve and protect the Tierra Rejada Greenbelt area
located within the Moorpark Area of Interest; and
WHEREAS, enhancement of open space and greenbelt areas is
included as one of the top ten priorities adopted by the City
Council for Fiscal Year 2002 -2003; and
WHEREAS, the City Council intends to move forward with open
space preservation efforts within the Moorpark Area of Interest;
and
WHEREAS, the City Council supports an application for the
Proposition 40 Matching Grant Program for acquisition of open
space land within the Tierra Rejada Greenbelt area; and
WHEREAS, acquisition of land within the Tierra Rejada
Greenbelt is consistent with the Conservancy's adopted
Acquisition Workprogram for the Simi Hills (Project Name: Tierra
Rejada Road to Olsen Road).
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:

SECTION 2. The City Council approves the filing of an
application for the Proposition 40 Matching Grant Program for
the acquisition of open space land in the Tierra Rejada

as required by the Conservancy for the Proposition 40 Matching
Grant Program.

by the Conservancy, the City Council hereby agrees to fully
comply with the Santa Monica Mountains Comprehensive Plan, if
applicable.

this resolution and shall cause a certified resolution to be
filed in the book of original resolutions.
