Traffenstedt, ATCM /City Clerk March 31, 2004 (CC Meeting of 4/7/04) Consider Resolution Updating Miscellaneous City Fees and Charges and Rescinding Resolution No. 98 -1506 BACKGROUND AND DISCUSSION Staff is recommending adoption of an updated Miscellaneous Fees and Charges Resolution. Revisions include new language pertaining to the cost for a colored copy; cost for use of City plotter for Geographic Information System (GIS) maps; duplication of electronic records; clarification of the cost when a private copy company is utilized (such as for aerial photography, base maps, and plans and specifications); and updated General Plan document charges. A draft resolution is attached (the prior resolution adopted in August 1998 would be rescinded). An update of the Miscellaneous Fee Schedule was originally scheduled for adoption in September 2001, but was removed from the meeting calendar after Councilmember Mikos expressed concern with retaining the copy charge of $.25 per page for a standard size page. Due to other priorities and the need for further research, no additional work was done on revising the fee schedule until recently. Staff was directed to meet with Councilmember Mikos, which has occurred, and she has reviewed a preliminary draft of the revised fee schedule that is attached to this report. Staff has reviewed several surveys of other cities, and the copy charge varies, but must be based on the direct cost of producing the record, not including staff time. Staff is recommending no change to the City's copy charge of $.25 for a standard 81--�" x 11" page at this time. The City of Moorpark has not increased its copy charges since incorporation in 1983. Private copy companies can produce the copy at a lower cost for various reasons; therefore, staff's intent is to continue to encourage use of private copy companies for production of large documents. In addition, having a cost per diskette and per CD on the fee schedule (as is currently proposed) will allow an even less expensive option in many cases, 000163 Honorable City Council April 7, 2004, Regular Meeting Page 2 as will increasing access to certain files via the City's Home Page. E- mailing files at no cost will continue to be done by staff when the file size is manageable and will not adversely impact the storage space on the City's server; there is no data compilation, extraction, or programming required to produce the record; and there is an overall staff time savings. STAFF RECOMMENDATION Adopt Resolution No. 2004- Attachment: Draft Resolution 000164 RESOLUTION NO. 2004- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ESTABLISHING MISCELLANEOUS CITY FEES AND CHARGES AND RESCINDING RESOLUTION NO. 98 -1506 WHEREAS, it is appropriate for the City to establish fees and charges for City services; and WHEREAS, the City Council has determined that the miscellaneous fees and charges adopted in Resolution No. 98 -1506 should be updated. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. All miscellaneous fees and charges shall be reviewed annually by each City department and the City Clerk shall schedule an updated fee schedule for City Council consideration when needed to insure that such fees and charges are current and are related to actual cost. SECTION 2. The City Council hereby approves the fee schedule attached as Exhibit A - Miscellaneous Fees and Charges. SECTION 3. Resolution 98 -1506 is hereby rescinded. SECTION 4. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. PASSED AND ADOPTED this 7th day of April, 2004. Reproduction Work A. Reproduction Work Done by City Staff 1. Copy charge - standard size 8 1/2" x 1111 page $0.25 - Black $1.00 - Color 2. Copy charge - per page cost for reports and $0.10 statements filed pursuant to the Political Reform Act (Government Code Section 81008) 5. Copy Retrieval Fee - for copies of reports and $5.00 statements, filed pursuant to the Political Reform Act, which are five or more years old. A request for more than one report or statement at the same time shall be considered a single request. 6. Reproduction Work by Private Copy Company A private copy company option may be chosen when the number of pages to be copied exceeds a fee of $10.00, and will be required for any copy that exceeds the copy size capability of the City's copiers and /or printers. Selection of this option may result in a delay in completion of the copy work. The copy charge for all reproduction work by private copy company vendors shall be the actual private vendor cost (direct cost), and will include a City administrative fee of 15 %, when the City pays the private copy company directly and is then reimbursed for copy charges. Original City file documents will only be loaned for copying to a private copy company with a bond or other surety on file with the City Clerk's Department, and as approved by the City Clerk. This private vendor reproduction option is not available for Political Reform Act records. Section 6253.9 (b) provides that the requester shall bear the cost of producing a copy of the record, including the cost to construct a record, and the cost of programming and computer services necessary to produce a copy of the record when either of the following applies: (1) In order to comply with the provisions of subdivision (a), the public agency would be required to produce a copy of an electronic record and the record is one that is produced only at otherwise regularly scheduled intervals; (2) The request would require data compilation, extraction, or programming to produce the record.
