Borchard, Administrative Services September 14, 2004 (CC Meeting of 9/15/04) Director ��� SUBJECT: Consider an Ordinance Amending Sections 3.08.010 and 3.08.030 of the Municipal Code Establishing Informal Bidding Procedures for Certain Public Projects BACKGROUND /DISCUSSION Section 3.08.010 of the Moorpark Municipal Code currently authorizes the City to utilize informal bidding procedures in accordance with the State Public Contract Code for public projects up to $50,000. Section 3.08.030 also provides for the notice and mailing requirements for said projects. Public Contracts Code (PCC) Section 22030 (formerly PCC 21200) provides that a local agency that has elected by governing board resolution to become subject to the uniform construction cost accounting procedures and has notified the State Controller is subject to bidding procedures under the Uniform Public Construction Cost Accounting Act (the Act). The City Council passed Resolution No. 86 -286 on March 3, 1986, electing to become subject to the Act and Ordinance No. 66 on March 17, 1986 to establish the bidding procedures. Changes in the bid limits are governed by PCC sections 22020, 22032 and 22034 which are part of the Act. PCC 22020 provides that every five years the Commission may increase the monetary limits and that any adjustment is effective 60 days after the State Controller notification to the affected agencies. The Commission increased the monetary limits for informal bidding procedures for projects up to $100,000 in April 2000 and the City's Ordinance needs to be amended to reflect the revised limit and code section reference. W00 "toI Honorable City Council September 15, 2004 Page 2 It is also proposed to include a section to automatically change the dollar amounts specified as of the effective date of any amendments to the Public Contract Code without further amendment to the Ordinance. In accordance with adopted procedure, the proposed ordinance has been reviewed by the City Attorney. STAFF RECOMMENDATION Introduce Ordinance No. for first reading. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING SECTION 3.08.010 AND SECTION 3.08.030 OF CHAPTER 3.08 OF TITLE 3 OF THE MOORPARK MUNICIPAL CODE, ESTABLISHING INFORMAL BIDDING PROCEDURES FOR CERTAIN PUBLIC PROJECTS WHEREAS, per Resolution No. 86 -286, the City has elected to become subject to the provisions of the uniform construction accounting procedures to govern the selection of contractors to perform public projects pursuant to Public Contract Code Section 22032; and WHEREAS, Public Contract Code Section 22032 identifies the procedures and dollar limitations that the City may follow to enter into contracts for the construction of public projects; and WHEREAS, the bid limits specified in Section 22032 have increased and the municipal code section(s) referenced need to be amended; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Sections 3.08.010 and 3.08.030, and no other code sections of Chapter 3.08 of the Moorpark Municipal Code, are hereby amended in their entirety to read as follows: "Section 3.08.010 Applicability of provisions. The provisions of this chapter shall apply to construction on public projects of more than twenty five thousand dollars ($25,000.00) but not more than one hundred thousand dollars ($100,000.00). These dollar amounts shall be deemed to automatically increase or decrease, without further amendment to this Ordinance, as of the effective date of any amendments to Public Contract Code Section 22030 et seq. or its successor sections." "Section 3.08.030 Mailed notice of bids. All contractors on the list for the category of work being bid and /or all construction trade journals specified by the 000003 Ordinance No. Page 2 commission pursuant to Public Contracts Section 22036 shall be mailed a notice inviting informal bids unless the product or service is proprietary. All mailings of notices to contractors and construction trade journals pursuant to this section shall be completed not less than ten (10) calendar days before bids are due." SECTION 2. If any section, subsection, sentence, clause, phrase, part or portion of this Ordinance is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase, part or portion thereof, irrespective of the fact that any one or more section, subsections, sentences, clauses, phrases, parts or portions be declared invalid or unconstitutional. SECTION 3. This Ordinance shall become effective thirty (30) days after its passage and adoption. SECTION 4. The City Clerk shall certify to the passage and adoption of this ordinance; shall enter the same in the book of original ordinances of said City; shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council at which the same is passed and adopted; and shall, within fifteen (15) days after the passage and adoption thereof, cause the same to be published once in the Moorpark Star, a newspaper of general circulation, as defined in Section 6008 of the Government Code, for the City of Moorpark, and which is hereby designated for that purpose.
