SUBJECT: Consider Authorization of Recordation of the Notice of
Completion for the Arroyo Vista Community Park Phase II
Project
BACKGROUND
On March 19, 2003, the City Council awarded the Arroyo Vista
Community (AVCP) Park Phase II Improvement Project to Ecology
Construction Inc. for $1,779,318. Ecology has substantially
completed its work and staff is requesting that the City Council
authorize the recordation of the Notice of Completion.
The AVCP Phase II project included the construction of a fourth
softball field, approximately 12 acres of newly hydroseeded turf
area to serve as multipurpose sports fields, installation of two
playlots with equipment and a large pavilion, construction of a new
parking lot and undergrounding overhead utility lines at the east
end of the park, and improvements to an existing parking lot
adjacent to the multipurpose court.
The work began in May, 2003, and was expected to be completed in
November, 2003. However, the contractor experienced significant
problems with getting the Bermuda seed to germinate during the fall
of 2003. The City required the company to reseed areas in the
spring of 2004. Staff is satisfied with the quality of the newly
hydroseeded turf and is recommending that the Council authorize the
filing of the Notice of Completion.

DISCUSSION
Notice of Completion
As stated above, construction of the Project has been substantially
completed pursuant to the approved plans and specifications, less
minor "punch" list items. There were nine approved Change Orders,
summarized as follows:
Change Order #1 (Cost - Add $39,704.08) Install Tennis Court
pavilion, asphalt removal and 17 tree removals.
Change Order #2 (Cost - Add $8,799.45) Additional concrete
work, relocate 6" irrigation mainline, and parking lot design
changes.
Change Order #3 (Cost - Add $8,000.00) Additional electrical
work required by Edison, two additional electrical outlets, 12
additional valve boxes, and construction modifications to the
trash enclosure.
Change Order #4 (Cost - Add $169.69) Add domestic waterline to
drinking fountain.
Change Order #5 (Cost - Add $21,782.20) Construct a blow -off
sump, service road required by Edison, modifications to well
3, and irrigation modifications.
Change Order #6 (Cost - Add $2,806.80) Install automatic relay
at well 3, stripe speed bumps and install signs.
Change Order #7 (Cost - Add $5,787.40) Install speed bumps,
additional chain link fence at dug -outs, playlot
modifications.
Change Order #8 (Cost - Add $1,882.00) Install gate valve at
well 3.
Change Order #9 Cost - Add $21,124.76) Domestic water cost for
three months ($14,837), upgrade sections of waterline to water
well #3, and adjust shade structure footings.
At the completion of the construction work, the total cost of the
construction contract awarded to Ecology Construction, including
the aforementioned Change Orders is $1,889,374.06. With the
Council's authorization to record the Notice of Completion, the
Contractor will receive the balance of the payment (retention) due

35 days after the recordation and fulfillment of all contractual
obligations as determined by the City. Additionally, the City
Clerk's Office will be authorized to release the project bonds in
accordance with the contract provisions and upon the approval of
the Community Services Director.
STAFF RECOMENDATION
Authorize the City Clerk to file the Notice of Completion, release
of the balance of payment thirty -five (35) days after Notice of
Completion records, and release of bonds consistent with the
contract.
