SUBJECT: Consider Adoption of a Resolution Rescinding Resolution
No. 2005 -2282 Pertaining to Establishment of a New
Stormwater Quality Property - Related Fee
BACKGROUND
On January 19, 2005, the City Council adopted Resolution No.
2005 -2282. That Resolution supported efforts of the Ventura
County Watershed Protection District
Property- Related Fee to increase funding Dfor Rthe )Countywide N DES
Programs. That Resolution also approved a new Implementation
Agreement related to the administration of those funds and the
administration of the Countywide NPDES programs, subject to final
language approval by the City Manager and City Attorney.
DISCUSSION
Recent developments have caused the implementation
matters to be delayed. of these
It is recommended below that the City
Council adopt a Resolution rescinding Resolution No. 2005 -2282. It
is the intent of staff to bring this matter back to the City
Council when the various program implementation problems have been
resolved.

RESOLUTION NO. 2005 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, RESCINDING RESOLUTION NO.
2005 -2282 PERTAINING TO THE ESTABLISHMENT OF A
NEW CLEAN STORM WATER FEE AND THE APPROVAL OF THE
RELATED IMPLEMENTATION AGREEMENT
WHEREAS, On January 19, 2005, the City Council adopted
Resolution No. 2005 -2282, supporting the Ventura County Watershed
Protection District's (herein "District ") efforts to establish a
new funding source for storm water quality (NPDES) programs and
approving a new Implementation Agreement related thereto; and
WHEREAS, certain problems have been encountered which
have caused the implementation of these matters to be deferred;
and
WHEREAS, it is the intent of staff to bring to the City
Council at a subsequent date, revised documents pertaining to
these matters; and
WHEREAS, it is therefore, appropriate to rescind the
aforementioned Resolution.
NOW, THEREFORE, THE CITY COUNCIL OF THE MOORPARK DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Resolution No. 2005 -2282 is hereby rescinded.
SECTION 2. The City Clerk shall certify to the adoption of
this Resolution and shall cause a certified resolution to be filed
in the book of original Resolutions.
