SUBJECT: Acceptance and Recordation of Deeds and Easements

Under our present procedure a grant of land to the City must be
approved by the City Council by formal resolution, which must then
be recorded along with the deed. In order to streamline the pro-
cedure (cut down on paperwork for ourselves as well as the County
Recorder), the attached resolution would enable us to implement the
following procedure:
1. The City Council would approve and accept
the grant by minute action;
2. The City Clerk then would merely affix the
Certificate of Acceptance (copy attached)
to the deed and send the document to the
County Recorder.
In all cases the City Council would still review and accept all
land grants.
RECOMMENDED ACTION:
Adopt the attached resolution.

Re: Recording of Deeds
Dear Mayor and Councilpersons:

State Law requires that before the County may
accept for recordation any deed granting land to the City, a
resolution of acceptance by the City Council must be attached
to or printed on the deed. If this procedure is followed,
the Council must approve by formal resolution every grant
deed to the City.
Alternatively, the enclosed resolution allows the
City to take advantage of Government Code Section 27281,
which allows the Council to authorize the City Clerk to
accept deeds on behalf of the City. Adoption of this
resolution does not mean the Council would not have an
opportunity to approve all land grants. The Council still
must approve the grant; however, a formal resolution of
acceptance is not necessary. Instead, after the Council
approves the grant, the City Clerk may simply stamp over
the deed a certificate of acceptance so that it may be
recorded. This is very similar to the procedure on subdivi-
sion maps, where the City Clerk certifies that Council has
previously approved the map so that the map may be recorded
and the City may receive the land dedicated.

RESOLUTION NO. 85 -163
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF MOORPARK AUTHORIZING THE
CITY CLERK TO ACCEPT DEEDS
WHEREAS, Section 27281 of the Government Code of
the State of California provides that political corporations
and governmental agencies, by a general resolution, may
authorize an officer or agent to accept and consent to
deeds or grants of interest in real property offered to the
City; and
WHEREAS, it is in the public interest that this
City comply with the provisions of said section.
NOW, THEREFORE, be it resolved by the City Council
of the City of Moorpark as follows:
Section 1. That the City Clerk is hereby authorized
as agent of the City of Moorpark to accept and consent to
the recordation of any deed or grant conveying any interest
in or easement upon real property to said City which the
City Council has approved. The City Clerk is hereby authorized
and directed to execute certificates of acceptance in the
form as provided for in Section 27281 of the Government Code
of the State of California, as amended.
Section 2. The City Clerk of the City is hereby
authorized and directed to certify a copy of this resolution
and record the same with the County Recorder of Ventura
County.
