On June 3, 1985, the City Council approved Resolution No. 85 -204, modifying
Condition No. 19 of PD -851. This condition is concerned with the obligation of
Pacifica for the improvement of Peach Hill Park.
As indicated in Section 2 of the Resolution, Pacifica was limited to 62 dwelling
unit occupancies until an agreement for improvement of the park was signed
by the City. Upon the signing of the agreement, Pacifica was permitted a
total of 108 occupancies.
As a result of other work demands, the City has not completed its review of
the agreement. It is expected to be presented to the City Council on
October 7, 1985.
In fairness to Pacifica, additional occupancies should be granted, both at this
time (prior to execution of the agreement) and prior to the start of the
twelve (12) month maintenance period.
It is recommended that Pacific be granted the following modification to condition
No. 19:
That Pacifica be permitted 90 dwelling uinit occupancies at
this time. Upon the approval by the City of agreement defining
Pacifica's park improvement obligation, they be permitted a total
of 153 occupancies and upon the start of •the twelve (12) month
maintenance period, all occupancies for the Pacifica portion of
pd -851 be permitted.

The 90 dwelling units is based upon the additional occupancies projected
by Pacifica through October 7, 1985. The 153 dwelling units is the total
nuimber of building permits issued for Phases 4 and 5 of Tract 2865 as of
June, 1985.
RECOMMENDED ACTION
Concur with staff recommendation and adopt Reolution No. 85- modifying
Resolution No. 85 -204.

RESOLUTION NO. 85-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, AMENDING SECTION 2 OF
RESOLUTION NO. 85 -204, PERTAINING TO CONDITION
NO. 19 OF RESIDENTIAL PLANNED DEVELOPMENT PERMIT
NO. PD -851 (PACIFICA CORPORATION) .
WHEREAS, at its meeting of June 3, 1985, the Moorpark City Council
adopted Resolution No. 85 -204, entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, APPROVING APPEAL NO. 9,
FILED BY PACIFICA CORPORATION REGARDING PLANNED
DEVELOPMENT PERMIT NO. PD -851; and
WHEREAS, the granting of Appeal No. 9 approved the modification
of Condition No. 19 of said Planned Development Permit No. PD -851; and
WHEREAS, Pacifica Corporation has requested, and it is deemed by
the City Council to be in the City's best interests to approve a further
modification of said Condition No. 19;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
DOES RESOLVE AS FOLLOWS:
SECTION 1. Section 2 of Resolution No. 85 -204, adopted by the
Moorpark City Council on June 3, 1985, and entitled as set forth in the preamble
to this Resolution, is hereby amended to read as follows:
"SECTION 2. That said approval is hereby granted, with the
modification of Condition No. 19 as follows:
"That Pacific be permitted 90 dwelling unit occupancies at this
time. Upon the approval by the City of the agreement defining
Pacifica's park improvement obligation, they be permitted a total
of 153 occupancies and upon the start of the twelve (12) month
maintenance period, all occupancies for the Pacifica portion of
PD -851 be permitted."
SECTION 2. That this resolution shall take effect immediately.

RESOLUTION NO. 85- 204
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, APPROVING APPEAL NO. 9,
FILED BY PACIFICA CORPORATION, REGARDING PLANNED
DEVELOPMENT PERMIT NO. PD -851
WHEREAS, on September 14, 1978, the Board of Supervisors
of Ventura County approved Planned Development Permit No. PD -851;
and
WHEREAS, on April 23, 1985, the Director of Community
Development of the City of Moropark rendered an administrative
decision not to grant occupancy of residential units in said
PD -851 beyond the 30th unit, pursuant to Condition No. 19 of said
permit; and
WHEREAS, on April 24, 1985, Pacifica Corporation filed
Appeal No. 9, appealing the decision of the Director of Community
Develpment; and
WHEREAS, at a legally noticed public hearing on May 6, 1985,
the City Council heard said appeal and has fully considered the
matter and reached its determination;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That Appeal No. 9 is hereby approved, based
upon the following facts and considerations:
(1) Appellant has diligently pursued his attempts to comply
with Condition No. 19 of PD -851, but has been unsuccessful in com-
plying with these requirements owing to circumstances beyond his
control.
(2) Enforcement of the conditions would result in undue
financial hardship on both the appellant and homebuyers within
PD -851.
SECTION 2. That said approval is hereby granted, with the
modification of Condition No.19 as follows:

end of this week. Because of the buyers' loan commitments
and moving schedules, we will appreciate your giving us an
exemption on these two lots so we may close on schedule.
