SUBJECT: PLANNED DEVELOPMENT PERMIT NO. PD -1051 (Lincoln Property Company)

This Residential Planned Development proposal is for a 136 unit apartment complex
located on the east side of Moorpark Road immediately north of "Park Springs"
a 128 unit condominium project. It is approximately 500 feet north of New Los
Angeles Avenue. Further details of this project are in the attached staff report
to the Planning Commission.
Since there are no dedications for streets or other easements, the net and gross
acreages are the same, and since there are no slopes on the property, the applicant
was able to utilize the total property for maximum development. Thus, the applicant
was able to maximize density (14.87 dwelling units per acre). While at the same
time providing wide separation between buildings and ample Open- Space. Staff
has been very impressed with the professional approach, cooperative attitude of
the applicant (Lincoln Property Company). The Park & Recreation Commission recom-
mendations as to recreational amenities have been incorporated in the conditions
and the applicant has modified his plan accordingly. The applicant prepared the
plans using the then current standard for parking i.e., 2 -1/4 spaces for one bedroom
units and 2 -1/2 spaces for two bedroom units.
Planning Commission Action
The Planning Commission was unanimous in it's support of the project. The only
concern was over the ingress /egress. There was considerable discussion by the
Traffic Engineer for the applicant and the City Engineer pointing out that a joint
driveway for this project and the existing Condominium project to the south would
result in less points of conflict and thus would be safer. The project has been
conditioned to provide a stub to the condominium project in the event that a joint
agreement can be worked out. As of this writing it appears that all parties are
tentatively agreeable to the arrangement (per the current ballot process).

Recommended Action
1. Find that the proposed project will not have a significant effect on the environ-
ment and that this body has reviewed and considered the information contained
in the Mitigated Negative Declaration and approves the attached Mitigated
Negative Declaration as having been completed in compliance with State CEQA
Guidelines issued thereunder and;
2. Adopt the proposed findings and approve PD -1051 subject to the attached conditions.

PLANNING DEPARTMENT CONDITIONS:
1. That unless the use is inaugurated not later than one (1) year
after this Permit'-.is-granted, this permit shall automatically
expire on that date.' The Planning Commission may, at their
discretion, grant one (1) additional year extension for use
inauguration if there have been no changes in the adjacent
areas and if the permittee has diligently worked toward
inauguration of use during the initial one year period.
�. That no later than ten (10) days after any change of property
ownership or of lessee(s) or operator(s) of the subject use,
there shall be filed with the Community Development Department
the name(s) and address(es) of the new owner(s), lessee(s),
or operator(s), together with a letter from any such person(s)
acknowledging and agreeing to comply with all conditions of
this permit. ,
3. That the permittee agrees as a condition of issuance and use
of this permit to defend at his sole expense any action brought
against the city because of issuance (or renewal) of this permit
or in the alternative to relinquish this permit. Permittee will
reimburse the City for any court cost which the City may be
required by court to pay as a result of any such action, but
such participation shall not relieve permittee of his obligation
under this condition.
4. That permittee's acceptance of this permit and /or operation
under this permit shall be deemed to be acceptance by permittee
of all conditions of this permit.
5. That no condition of this entitlement shall be interpreted as
permitting or requiring any violation of law, or any unlawful
rules or regulations or orders of an authorized governmental
agency. In instances where more than one set of rules apply,
the stricter ones shall take precedence.
6. That if any of the conditions or limitations of this permit are
held to be invalid, that holding shall not invalidate any of the
remaining conditions or limitations set forth.
7. That the development is subject to all applicable regulations of
RPD -15 (Residential Planned Development with an allowed density
Of 15 DU /AC) zone and all agencies of the State of California,
County of Ventura, City of Moorpark and any other governmental
entities.
8. That any minor changes may be approved by the Director of
Community Development upon the filing of a Minor Modification
application, but any Major Modification to be considered by the
City Council.

as follows:
4. The improvements sh�ll'.include concrete curb and gutter, sidewalk, street
lights, striping and signing in accordance with the City of Moorpark Road
Standards. The applicable Road Standard Plates are as follows:
a. Sidewalks per plate E -5.
b. Driveways shall be per plate E -2 modified to be 50 feet wide with a
15 foot or greater radius curb return. this driveway shall facilitate
this development as well as the adjacent development to the south and
shall be aligned directly opposite Roberts Avenue. Developer shall
remove existing driveway on the southerly development and replace with
appropriate curb and gutter if agreement can be reached with this prop-
erty woner; driveway curb return shall be constrLmted so as to provide
for handicapped access.
C. Signing and stripping plans shall be prepared for Moorpark Road as
deemed as appropriate and necessary by the City and CalTrans.
d. If any hazardous waste is encountered during any phase of the
construction of this project all work shall be immediately stopped
and the Ventura County Environmental Health Department, Sherrif's
Department and City Inspector shall be notified immediately. Work
shall not be allowed to proceed until clearance has been issued by
all of these agencies through the City Inspector.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
MOORPARK, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL
APPROVAL OF PLANNED DEVELOPMENT PERMIT NO. PD -1051 ON
THE APPLICATIQN OF LINCOLN PROPERTY COMPANY.
WHEREAS, at a duly noticed public hearing on April 9, 1986 and
May 14, 1986, the Moorpark Planning Commission considered the application filed
by Lincoln Property Company requesting approval to construct a 136 residential
rental units. Located on the east side of Moorpark Road, immediately north
of "Park Springs ", a 128 unit condominium project, approximately 500 feet north
of Los Angeles Avenue.
WHEREAS, the Planning Commission, after review and consideration
of the information contained in the Mitigated Negative Declaration, has found
that this project will not have a significant effect of the environment; and
has reached its decision in the matter;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That the findings contained in the staff report dated
May 14, 1986, which report is incorporated by reference as though fully set
forth herein are hereby approved;
SECTION 2. That at its meeting of May 14, 1986, the Planning Commission
took action to request staff to prepare a Resolution with the attached conditions
approving Planned Development Permit No. PD -1051; said Resolution to be presented
for Consent Calendar action at the next regularly scheduled meeting. The action
with the foregoing direction was approved by the following roll call vote:
AYES: Commissioners Holland, Keenan, Claffey, Hartley
and LaPerch;
NOES: None;

PLANNING DEPARTMENT CONDITIONS:
9. That the design,.maintenance and operation of the permit are
and facilities tWvreon shall comply with all applicable require-
ments and enactments* of Federal, State, County, and City authorities,
and all such requirements and enactment shall, by reference,
become conditions of this permit.
10. That prior to the issuance of zone clearance, a landscaping
and planting plan (3 sets), together with specifications and
maintenance program, prepared by a State licensed Landscape Architect
in accordance with ounty Guidelines for Landscape Plan Check,
shall be submitted to the Director of Community Development for
approval. The applicant shall bear the total cost of such review
and of final installation inspection. The landscaping and planting
shall be accomplished and approved prior to the - inauguration of
this permit. Shall be as follows: -
a. The final landscape plans shall provide for a 50% shade coverage
within all parking areas. shade coverage is described as the
maximum mid -day shaded area defined by a selected specimen
tree at 50% maturity. Landscaping and irrigation shall be
provided to the curb.
b. That all turf plantings associated with this project shall
be of a drought tolerant low -water using variety.
C. Landscaping shall not cover any exterior door or window.
d. Landscaping at entrances /exits or at any intersection within
the parking lot shall not block or screen the view of a seated
driver from another moving vehicle or pedestrian.
e. Landscaping (trees) shall not be placed directly under any overhea.
lighting which could cause a loss of light at ground level.
f. There shall not be any easy exterior access to the roof area,
i.e., ladders, trees, high walls, etc.
9. Open Space - Shrubbery along and around the interior walkways
shall be low so that visibility is not obstructed.
h. That the continued landscape maintenance of the permit area
and facilities shall be subject to periodic inspection by the
City. The permittee shall be required to remedy any defects
in ground maintenance, as indicated by the City inspector with-
in 30 days after notification.

be used.
20. That three - sixteenths (3/16) inch glass or windows, with a
sound transmission class (STC) rating of 25 or greater; shall

29 That the developer shall provide low -flush toilets as required
by Section 17921.3 of the Health and Safety Code.
30. That the developer shall provide low -flow showers and faucets
as required by California Administrative Code, Title 24, Part 6,
Article 1, T20- 1406F.
31. That the developer shall insulate hot water lines in water
recirculating systems as required by the California Energh
Commission regulations.

shall submit to the city for review and approval by the Director
Of Community Development a fencing plan indicating a 8 foot block
wall to be constructed between the 8 foot carport wall on the north
boundary line. In additions, a 6 foot block wall on the east

35. That prior to issuance of zone clearance, an "Unconditional Will
Serve" letter for water and sewer service will be obtained from
Ventura County Waterworks District No. I.
36. That prior to recordation, the applicant shall pay all fees pursuant
to the City of Moorpark Municipal Code, Sections 8279 -4 et seq.,
for the purpose of providing fees in lieu of land dedication for
local park acquisition and /or development of park facilities for
the future residents of the subdivision.

1. That prior to zone clearance the developer shall submit to the City of Moorpark
for review and approval, a grading plan prepared by a Registered Civil Engineer;
shall obtain a Grading Permit and shall post sufficient surety guaranteeing
completion.
2. That prior to zone clearance the developer shall submit to the City of Moorpark
for review and approval, a detailed Soils Report certified by a registered
professional Civil Engineer in the State of California. The grading plan
shall incorporate the recommendations of the approved Soils Report.
3. That prior to zone clearance the developer shall submit to the City of Moorpark
for review and approval, street improvement plans prepared by a Registered
Civil Engineer; shall enter into an agreement with the City of Moorpark to
complete the improvements; and shall post sufficient surety guaranteeing
the construction of the improvements.
4. The improvements shall include concrete curb and gutter, sidewalk, street
lights, striping and signing in accordance with the City of Moorpark Road
Standards. The applicable Road Standard Plates are as follows:
a. Sidewalks per plate E -5.
b. Driveway shall be per plate E -2 modified to be 50'
wide with 10' radius curb returns. This driveway
shall facilitate this development as well as the
adjacent development to the south and shall be
aligned directly opposite Roberts Avenue. Developer
shall remove existing driveway on the southerly develop-
ment and replace with appropriate curb and gutter;
driveway curb returns shall be constructed so as to
provide for handicapped access.
5. That prior to any work being conducted within the State or City right -
of -way, the developer shall obtain an Encroachment Permit from the appropriate
Agency.
6• That prior to zone clearance the developer shall demonstrate feasible access
with adequate protection from a 10 year frequency storm to the satisfaction
of the City of Moorpark.
That prior to zone clearance the developer shall deposit with the City of
moorpark a contribution for the Los Angeles Avenue Improvement Area of
Contribution. The actual deposit shall be the then current Los Angeles
Avenue Improvement Area of Contribution applicable rate at the time the
Building Permit is issued.

8. That prior to zone clearance the developer shall indicate in writing to the
City of Moorpark, the disposition of any water well(s) and any other water
that may exist within the site. If any wells are proposed to be abandoned,
or if they are abandoned and have not been properly sealed, they must be
destroyed per Ventura County Ordinance No.2372.
9. That prior to zone clearance the developer shall submit to the City of Moorpark
for review and approval, drainage plans, hydrologic, and hydraulic calculations
prepared by a Registered Civil Engineer; shall enter into an agreement with
the City of Moorpark to complete the improvements and shall post sufficient
surety guaranteeing the construction of the improvements. The drainage plans
and calculations shall indicate the following conditions before and after
developme

and patterns, diversions, collection systems, flood hazard areas, sumps and

1-1. That prior to zone clearance, the developer shall submit to the City of Moorpark
for review and approval, evidence that all the buildable sites in the subdivision
will be protected from flooding.
Developer shall pay all energy costs associated with street lighting for
a period of one year from the initial energizing of the street lights.

-14. Developer shall construct a bus turnout per Plate D -13 with transition and
bus bay lengths each being 60 feet. The transition into the bus bay shall
begin at the main driveway end of curb return.

VENTURA COUNTY SHERIFF'S DEPARTMENT CONDITIONS
1. A licensed security guard is recommended during the construction
phase, or a 6 food high chainlink fence shall be erected around
the construction site. Drive thru security has not been successful
for similar construction projects.
2. Construction equipment, tools, etc., shall be properly secured
during nonworking hours.
3. All appliances (microwave ovens, dishwashers, trash compactors,
etc.) shall be properly secured prior to installation during
nonworking hours. All serial numbers shall be recorded for
identification purposes.
4. If an alarm system is used, it should be wired to all exterior
doors and windows and to any roof vents or other roof openings
where access may be made.
5. Condition No. 4 would apply to any construction trailer that
would house valuable property and could be utilized on models or
at locations where articles of value ( #3) might be kept.
6. Lighting devices shall be high enough as to eliminate anyone on
the ground form tampering with them. All parking areas shall be
provided with a lighting system capable or illuminating the parking
surface with a minimum of 1 -foot candle of light and shall be
designed to minimize the spillage of light onto adjacent properties.
All exterior lighting devices shall be protected by weather and
breakage- resistant covers.
7. Lighting plans showing type and location of all lighting devices
shall be submitted to the Sheriff's Department for review and
approval.

9. All exterior doors shall be constructed of solid wood core
minimum of 1 and 3/4 inches thick or of metal construction.
10. Doors utilizing a cylinder lock shall have a minimum five (5)
pintumbler operation with the locking bar or bolt extending into
the receiving guide a minimum of 1 inch.
11. All exterior sliding glass doors or windows shall be equipped
with metal guide tracks at the top and bottom and be constructed
so that the window cannot be lifted from the tract when in the
closed or locked position.
12. There shall not be any easy exterior access to the roof area, i.e.,
ladders, trees, high walls, etc.

VENTURA COUNTY SHERIFF'S DEPARTMENT CONDITIONS:
13. Each single unit Constructed under the same general plan shall have
locks using combinations which are interchange free from locks used
in all other separate dwellings, proprietorships, or similar distinct
occupancies.
14. Walkways - All walkways will be well lighted and situated so that
surrounding residents will have a clear view of all pedestrian
travels.
15. Fences - Wrought iron fences to be errected around swimming pool
area for safety reasons. Should be 6 feet in height for security.

VENTURA COUNTY FIRE DEPARTMENT CONDITIONS:
1. Any gates, to control vehicle access, are to be located to allow,
a vehicle waitin4,f6r entrance to be completely off the public
roadway. If applicable, it is recommended that the gate(s) swing
in both directions. the method of gate control shall be subject
to review by the Bureau of Fire Prevention.
2. That prior to construction, the applicant shall submit plans
to the Ventura County Bureau of Fire Prevention for the approval
of the location of fire hydrants. show existing hydrants on plan
within 300 feet of the development.
3. That fire hydrants shall be installed and inservice prior to
combustible construction and shall conform to the minimum standards
of the County Water Works Manual.
° Each hydrant shall be a 6 inch wet barrel design
and shall have one 4 inch and two 2 -1/2 inch outlet.
° The required fire flow shall be achieved at no less
than 20 psi residual pressure.
° Fire hydrants shall be spaced 300 feet on center
and so located that no structure will be farther
than 150 feet from any one hydrant.
Fire hydrants shall be 24 inch on center, recessed in
from the curb face.
4. That the minimum fire flow required shall be determined by the
type of building construction, fire walls, and fire protection
devices provided, as specified by the I.S.O. Guide for Determining
Required Fire Flow.
5. That a minimum individual hydrant flow of 1250 gallons per minute
shall be provided at this location.
6. That all grass or brush exposing any structures shall be cleared
for a distance of 100 feet prior to framing, according to the
Ventura County Weed Abatement Ordinance.
7. That address numbers, a minimum of 6 inches high, shall be installed
prior to occupancy, shall be of contrasting color to the background,
and shall be readily visible at night. Where structures are set-
back more that 150 feet from the street, larger numbers will be
required so that they are distinguishable from the street. In
the event a structure is not visible from the street, the address
numbers shall be posted adjacent to the driveway entrance.
Individual dwelling units shall have 4 inch numbers.
8. That a plan shall be submitted to the Ventura County Bureau of I
Fire Prevention for review indicating the method in which buildings !
are to be identified.

VENTURA COUNTY FIRE DEARTMENT CONDITIONS:
9. That building plaids of public assembly areas, which have an
occupant load of 50 of more, shall be submitted to the Ventura
Bureau of Fire Prevention for review.

according to National Fire Protection Association, Pamphlet X10.
The placement of extinguishers shall be subject to the review of
the Fire Chief.

1. The applicant shall submit engineering data, satisfactory to the
District, that demgnstrates sufficient fireflow is available to
all parcels.
2. The applicant shall submit engineering data satisfactory to the
district showing that sewers are designed to carry the peak flow
rates from all areas tributary to them, including future developed
areas. The construction of off -site water and sewer mains may be
required to extend to the District's existing trunklines.
Note:
the District is in the early stages of planning a sewage treatment plant
expansion project. Since the cumulative increase of-flow into the existing
plant is directly related to the rate at which new connections to the
sewerage system are made, the currently available plant capacity could
be consumed prior to completion of any plan expansion. This could cause
a delay in issuance of a "Will Serve" letter to the applicant to insure
the plan expansion will be complete when sewer service begins.

PARKS & RECREATION ADDITIONAL CONDITIONS:
1. Increase the size ,of the pool to approximately 25' x 601.
2. Increase the size of the spa to comfortably accommodate 12 to
14 people.
3. Increase the deck area around the pool and spa proportionally to
the existing deck area to accommodate the increase in the size
of the pool and spa.
4. Add a tot lot just north of the open play area between buildings
2 and 3. Tot lot area should encompass 31000 square feet with
50 percent of the area dedicated to play equipment to be selected
by the developer with staff approval Tot lot shall be fenced and

of the project, complete with a wood trellis cover (gazebo)
and concrete benches, subject to staff approval.
7. Amount of open space to remain at the originally presented
design except for the increased size of decking and inclusion
of the tot lot.

4. The improvements shall include concrete curb and gutter, sidewalk, street
lights, striping and signing in accordance with the City of Moorpark Road
Standards. The applicable Road Standard Plates are as follows:
a. Sidewalks per plate E -5.
b. Driveways shall be per plate E -2 modified to be 50 feet wide with a
15 foot or greater radius curb return. this driveway shall facilitate
this development as well as the adjacent development to the south and
shall be aligned directly opposite Roberts Avenue. Developer shall
remove existing driveway on the southerly development and replace with
appropriate curb and gutter if agreement can be reached with this prop-
erty woner; driveway curb return shall be constructed so as to provide
for handicapped access.
C. Signing and stripping plans shall be prepared for Moorpark Road as
deemed as appropriate and necessary by the City and CalTrans.
d. If any hazardous waste is encountered during any phase of the
construction of this project all work shall be immediately stopped
and the Ventura County Environmental Health Department, Sherrif's
Department and City Inspector shall be notified immediately. Work
shall not be allowed to proceed until clearance has been issued by

Discussion IN
The proposed project consists of nine 2 -story structures containing both one and
two bedroom units. The one and two bedroom units will be combined into (3) typical
building types with the nine total structures. There will be 56 one bedroom units
and 80 two bedroom units. The one bedroom units are 638 square feet and the two
bedroom units are 880 square feet.
The architecture is classified as contemporary Early California Monterey style and
is detailed with wood trimming, concrete mission tile, wood facial, bronze window
frame, horizontal wood siding and stain wood doors.
The entire site encompasses 9.14 acres with 50% open -space consisting of landscaping
and recreational facilities. There is an existing block wall -along the common boundary
line with the condominium project to the south. The proposed conditions require
that an 8 foot block wall be constructed between the 8 foot carport walls on the
north boundary line so that there will be a continuous 8 foot high wall. separation between
this proposed residential project and the industrial facilities. To complete the
fencing, a 6 foot block wall will be constructed on the east property line.
Site amenities include: a one story recreational building of approximately 2,50C
square feet, along with a tennis court, volleyball court, pool, spa and bar -b -ques,
plus another bar -b -que area at the eastern end of the project. To the extreme east
of the site, the developer has provided a car -wash facility which is an additional
amenity for an apartment complex.
On April 2, 1986, the Parks & Recreation Commission met and reviewed the proposed
project. There recommended conditions on the project are as follows:
1. Increase the size of the pool to approximately 25' x 60'.
2. Increase the size of the spa to comfortably accommodate 12 to 14 people.
3. Increase the deck area around the pool and spa proportionally to the
existing deck area to accommodate the increase in the size of the pool
and spa.
4. Add a tot lot just north of the open play area between buildings 2 and
3. Tot lot area should encompass 3,000 square feet with 50% of the
area dedicated to play equipment to be selected by the developer with
staff approval. Tot lot shall be fenced and have adequate security
lighting subject to staff approval.
5. Add a half -court basketball court with a concrete surface with location
subject to staff approval.

6. Increase the number of bar -b -ques to the following:
a. Two gas bar -b -ques shall be provided at the office/
recreation building area around the pool.
b. One gas bar -b -que shall be provided near the tot
lot with circular concrete picnic table with
benches, subject to staff approval.
C. One gas bar -b -que pit shall be provided at the east
end of the project, complete with a wood trellis cover
(gazebo) and concrete benches, subject to staff approval.
7. Amount of open -space to remain at the originally presented design
except for the increased size of decking and inclusion of the tot
lot.
The applicant has agreed to the conditions listed for approval.
The original plan for the proposed project was to create a driveway in the middle of
the project; however, staff felt it would be more desirable to combine the driveways,
less points of conflict. The second set of plans for the proposed project was to
combine the driveways opposite Roberts Avenue. In addition, the applicant, Lincoln
Properties was going to install a traffic signal at roberts Avenue and Moorpark Road.
The adjacent property owner's representatives (Members of the Board), Park Springs
Condominium, 128 units, expressed tentative approval with the concept of combined
driveway opposite Roberts Avenue and Moorpark Road with the traffic signal. The
applicant did have a traffic study completed which revealed inadequate warrants for
a traffic signal. In other words, the traffic warrants did not justify the install-
ation of a signal at Roberts Avenue and Moorpark Road. Thereafter, staff met with
Park Springs representatives who expressed a concern with joint driveway if a traffic
signal was not installed at Roberts Avenue and Moorpark Road. Thus, the plans are
shown with a driveway opposite Roberts Avenue with a stub at a common property line.
In the event, a mutual agreement can be reached with Park Spring Condominium, they
can connect with the joint driveway. Analysis of the traffic situation is contained
in Lincoln Properties Engineer's Report.
Staff comments
Staff feels the architectural style - Early California Monterey is detailed to provide
an attractive project along Moorpark Road. The separation among the 9 structures
also gives the feeling of adequate open- space. In addition, open- space, site amenities
and density per acre, all contribute to an overall excellent plan. Lastly, the City
is in need of adequate well- designed apartment structures for our citizens.

Recommended Action:
1. Find that the proposed project will not have a significant effect
on the environment and that this body has reviewed and considered
the information contained in the Mitigated Negative Declaration
and approve the attached Mitigated Negative Declaration as having
been completed in compliance with State CEQA Guidelines issued
thereunder; and
2. Adopt the proposed findings and recommend to the City Council
that PD -1051 be approved, subject to the attached conditions.

PLANNING DEPARTMENT CONDITIONS:
1. That unless the use is inaugurated not later than one (1) year
after this permit' %is granted, this permit shall automatically
expire on that date. The Planning Commission may, at their
discretion, grant one (1) additional year extension for use
inauguration if there have been no changes in the adjacent
areas and if the permittee has diligently worked toward
inauguration of use during the initial one year period.
�. That no later than ten (10) days after any change of property
ownership or of lessee (s) or operator (s) of the subject use,
there shall be filed with the Community Development Department
the name (s) and address (es) of the new owner(s), lessee(s),
or operator(s), together with a letter from any such person(s)
acknowledging and agreeing to comply with all conditions of
this permit.
3. That the permittee agrees as a condition of issuance and use
of this permit to defend at his sole expense any action brought
against the city because of issuance (or renewal) of this permit
or in the alternative to relinquish this permit. Permittee will
reimburse the City for any court cost which the City may be
required by court to pay as a result of any such action, but
such participation shall not relieve permittee of his obligation
under this condition.
4. That permittee's acceptance of this permit and /or operation
under this permit shall be deemed to be acceptance by permittee
of all conditions of this permit.
5. That no condition of this entitlement shall be interpreted as
permitting or requiring any violation of law, or any unlawful
rules or regulations or orders of an authorized governmental
agency. In instances where more than one set of rules apply,
the stricter ones shall take precedence.
6. That if any of the conditions or limitations of this permit are
held to be invalid, that holding shall not invalidate any of the
remaining conditions or limitations set forth.
7. That the development is subject to all applicable regulations of
RPD -15 (Residential Planned Development with an allowed density
of 15 DU /AC) zone and all agencies of the State of California,
County of Ventura, City of Moorpark and any other governmental
entities.
8. That any minor changes may be approved by the Director of
Community Development upon the filing of a Minor Modification
application, but any Major Modification to be considered by the
City Council.

PLANNING DEPARTMENT CONDITIONS:
9. That the design, maintenance and operation of the permit are
and facilities thereon shall comply with all applicable require-
ments and enactments'of Federal, State, County, and City authorities,
and all such requirements and enactment shall, by reference,
become conditions of this permit.
10. That prior to the issuance of zone clearance, a landscaping
and planting plan (3 sets), together with specifications and
maintenance program, prepared by a State licensed Landscape Architect
in accordance with ounty Guidelines for Landscape Plan Check,
shall be submitted to the Director of Community Development for
approval. The applicant shall bear the total cost of such review
and of final installation inspection. The landscaping and planting
shall be accomplished and approved prior to the inauguration of
this permit. Shall be as follows:
a. The final landscape plans shall provide for a 50% shade coverage
within all parking areas. shade coverage is described as the
maximum mid -day shaded area defined by a selected specimen
tree at 50% maturity. Landscaping and irrigation shall be
provided to the curb.
b. That all turf plantings associated with this project shall
be of a drought tolerant low -water using variety.
C. Landscaping shall not cover any exterior door or window.
d. Landscaping at entrances /exits or at any intersection within
the parking lot shall not block or screen the view of a seated
driver from another moving vehicle or pedestrian.
e. Landscaping (trees) shall not be placed directly under any overhear
lighting which could cause a loss of light at ground level.
f. There shall not be any easy exterior access to the roof area,
i.e., ladders, trees, high walls, etc.
g. Open Space - Shrubbery along and around the interior walkways
shall be low so that visibility is not obstructed.
h. That the continued landscape maintenance of the permit area
and facilities shall be subject to periodic inspection by the
City. The permittee shall be required to remedy any defects
in ground maintenance, as indicated by the City inspector with-
in 30 days after notification.

PLANNING DEPARTMENT CONDITONS:
11. That the final design of site improvements, including materials,
colors, and fencing, is subject to the approval of the Planning
Commission.
12. That all roof - mounted equipment (vents, stacks, blowers, air -
conditioning equipment) shall be enclosed on all four sides by
suitable screening or fencing. Said screening material shall
be of similar material used in the construction of the parent
building. Prior to the issuance of zone clearance, the final
design and location of equipment and screening must be approved
by the Planning Commission.
13. That signs are subject to the City of Moorpark Ordinance Code,
Article 24, Sign Ordinance. A sign permit is required.
14. That at the time water service connection is made, cross - connection
control device shall be installed on the water system in accord-
ance with the requirements of the Ventura County Environmental
Health Department.
15. Trash disposal areas shall be provided in locations which will not
interfere with circulation, parking or access to the building and
shall be screened with a six (6) foot high, solid wall enclosure.
Prior to issuance of a zone clearance, the final design of said
enclosure shall be subject to the approval of the Director of
Community Development.
16. That all utilities be underground.
17. That all parking areas and driveways shall be surfaced with
asphalt or concrete and shall include adequate provisions
for drainage, striping and appropriate wheel blocks, and (or)
curbs in parking areas adjacent to landscape areas.
18. That it is the contractor's responsibility to use watering, or
other methods as directed by the city to control dust through-
out the project.
19. That all windows on the west elevations of buildings facing
Moorpark Road, shall be inoperable double sash windows; i.e.,
two windows separated by a 2.5 - 3 inch airspace. In one
pane, 3/16 inch glass, and in the other, 1/8 inch glass should
be used.
20. That three - sixteenths (3/16) inch glass or windows, with a
sound transmission class (STC) rating of 25 or greater; shall
be used on buildings which face west onto Moorpark Road.

PLANNING DEPARTMENT CONDITIONS:
21. That all other windows and all other elevations may be standard
single strength gXass (SSB) .
22. That no balconies are allowed to face west onto Moorpark Road.
23. That subject to final review by the Park and Recreation Commission
the developer shall provide:
a. An 2500 square foot recreational structure, located near the
west of the project.
b. A pool, spa, volleyball court, paddle tennis, and tennis court.
C. An additional bar -b -que facility towards the east of the site.
d. A car -wash facility along the eastern boundary line of the
site.
24. That the developer shall assure adequate provisions to protect the
safety of children by fencing and gating pool areas, and safety
buffering any tot lots proposed to be located adjacent to a pool
area.
25. That the project shall incorporate meandering sidewalks.
26. That storage lockers are to be provided in carports or garages
or attached to the exterior of each unit.
27. That the developer shall provide solar heating for all spas.
28. That irrigation shall be regulated so as not to occur at times
of high evaporation; i.e., during high winds or extreme high
heat.
29 That the developer shall provide low -flush toilets as required
by Section 17921.3 of the Health and Safety Code.
30. That the developer shall provide low -flow showers and faucets
as required by California Administrative Code, Title 24, Part 6,
Article 1, T20- 1406F.
31. That the developer shall insulate hot water lines in water
recirculating systems as required by the California Energh
Commission regulations.
32. Fencing Plan - Prior to issuance of zone clearance the developer
shall submit to the city for review and approval by the Director
of Community Development a fencing plan indicating a 8 foot block
wall to be constructed between the 8 foot carport wall on the north
boundary line. In additions, a 6 foot block wall on the east
property line shall be constructed.

34. That prior to construction, zone clearance shall be obtained from
the Community Development Department and a building permit shall

35. That prior to issuance of zone clearance, an "Unconditional Will
Serve" letter for water and sewer service will be obtained from
Ventura County Waterworks District No. I.
36. That prior to recordation, the applicant shall pay all fees pursuant
to the City of Moorpark Municipal Code, Sections 8279 -4 et seq.,
for the purpose of providing fees in lieu of land dedication for
local park acquisition and /or development of park facilities for
the future residents of the subdivision.

1. That prior to zone clearance the developer shall submit to the City of Moorpark
for review and approval, a grading plan prepared by a Registered Civil Engineer;
shall obtain a Grading Permit and shall post sufficient surety guaranteeing
completion.
2. That prior to zone clearance the developer shall submit to the City of Moorpark
for review and approval, a detailed Soils Report certified by a registered
professional Civil Engineer in the State of California. The grading plan
shall incorporate the recommendations of the approved Soils Report.
3. That prior to zone clearance the developer shall submit to the City of Moorpark
for review and approval, street improvement plans prepared by a Registered
Civil Engineer; shall enter into an agreement with the City of Moorpark to
complete the improvements; and shall post sufficient surety guaranteeing
the construction of the improvements.
4. The improvements shall include concrete curb and gutter, sidewalk, street
lights, striping and signing in accordance with the City of Moorpark Road
Standards. The applicable Road Standard Plates are as follows:
a. Sidewalks per plate E -5.
b. Driveway shall be per plate E -2 modified to be 50'
wide with 10' radius curb returns. This driveway
shall facilitate this development as well as the
adjacent development to the south and shall be
aligned directly opposite Roberts Avenue. Developer
shall remove existing driveway on the southerly develop-
ment and replace with appropriate curb and gutter;
driveway curb returns shall be constructed so as to
provide for handicapped access.
5. That prior to any work being conducted within the State or City right -
of -way, the developer shall obtain an Encroachment Permit from the appropriate
Agency.
6. That prior to zone clearance the developer shall demonstrate feasible access
with adequate protection from a 10 year frequency storm to the satisfaction
of the City of Moorpark.
7. That prior to zone clearance the developer shall deposit with the City of
moorpark a contribution for the Los Angeles Avenue Improvement Area of
Contribution. The actual deposit shall be the then current Los Angeles
Avenue Improvement Area of Contribution applicable rate at the time the
Building Permit is issued.

8. That prior to zone clearance the developer shall indicate in writing to the
City of Moorpark, the disposition of any water well(s) and any other water
that may exist within the site. If any wells are proposed to be abandoned,
or if they are abandoned and have not been properly sealed, they must be
destroyed per Ventura County Ordinance No.2372.
9. That prior to zone clearance the developer shall submit to the City of Moorpark
for review and approval, drainage plans, hydrologic, and hydraulic calculations
prepared by a Registered Civil Engineer; shall enter into an agreement with
the City of Moorpark to complete the improvements and shall post sufficient
surety guaranteeing the construction of the improvements. The drainage plans
and calculations shall indicate the following conditions before and after
development:
10. Quantities of water, water flow rates, major water courses, drainage areas
and patterns, diversions, collection systems, flood hazard areas, sumps and
drainage courses.
11. That prior to zone clearance, the developer shall submit to the City of Moorpark
for review and approval, evidence that all the buildable sites in the subdivision
will be protected from flooding.
12. Developer shall pay all energy costs associated with street lighting for
a period of one year from the initial energizing of the street lights.
13. Developer shall construct a bus turnout per Plate D -13 with transition and
bus bay lengths each being 60 feet. The transition into the bus bay shall
begin at the main driveway end of curb return.

VENTURA COUNTY SHERIFF'S DEPARTMENT CONDITIONS
1. A licensed security guard is recommended during the construction
phase, or a 6 foots high chainlink fence shall be erected around
the construction site. Drive thru security has not been successful
for similar construction projects.
2. Construction equipment, tools, etc., shall be properly secured
during nonworking hours.
3. All appliances (microwave ovens, dishwashers, trash compactors,
etc.) shall be properly secured prior to installation during
nonworking hours. All serial numbers shall be recorded for
identification purposes.
4. If an alarm system is used, it should be wired to all exterior
doors and windows and to any roof vents or other roof openings
where access may be made.
5. Condition No. 4 would apply to any construction trailer that
would house valuable property and could be utilized on models or
at locations where articles of value ( #3) might be kept.
6. Lighting devices shall be high enough as to eliminate anyone on
the ground form tampering with them. All parking areas shall be
provided with a lighting system capable or illuminating the parking
surface with a minimum of 1 -foot candle of light and shall be
designed to minimize the spillage of light onto adjacent properties.
All exterior lighting devices shall be protected by weather and
breakage- resistant covers.
7. Lighting plans showing type and location of all lighting devices
shall be submitted to the Sheriff's Department for review and
approval.
8. Driveways or streets within the parking lot area shall be wide_
enough to keep the circulation moving smoothly.
9_ All exterior doors shall be constructed of solid wood core
minimum of 1 and 3/4 inches thick or of metal construction.
10. Doors utilizing a cylinder lock shall have a minimum five (5)
pintumbler operation with the locking bar or bolt extending into
the receiving guide a minimum of 1 inch.
11. All exterior sliding glass doors or windows shall be equipped
with metal guide tracks at the top and bottom and be constructed
so that the window cannot be lifted from the tract when in the
closed or locked position.
12. There shall not be any easy exterior access to the roof area, i.e.,
ladders, trees, high walls, etc.

VENTURA COUNTY SHERIFF'S DEPARTMENT CONDITIONS:
13. Each single unit constructed under the same general plan shall have
locks using combinations which are interchange free from locks used
in all other separate dwellings, proprietorships, or similar distinct
occupancies.
14. Walkways - All walkways will be well lighted and situated so that
surrounding residents will have a clear view of all pedestrian
travels.
15. Fences - Wrought iron fences to be errected around swimming pool
area for safety reasons. Should be 6 feet in height for security.

VENTURA COUNTY FIRE DEPARTMENT CONDITIONS:
1. Any gates, to control vehicle access, are to be located to allow,
a vehicle waitingf,for entrance to be completely off the public
roadway. If applicable, it is recommended that the gate(s) swing
in both directions. the method of gate control shall be subject
to review by the Bureau of Fire Prevention.
2. That prior to construction, the applicant shall submit plans
to the Ventura County Bureau of Fire Prevention for the approval
of the location of fire hydrants. show existing hydrants on plan
within 300 feet of the development.
3. That fire hydrants shall be installed and inservice prior to
combustible construction and shall conform to the minimum standards
of the County Water Works Manual.
Each hydrant shall be a 6 inch wet barrel design
and shall have one 4 inch and two 2 -1/2 inch outlet.
° The required fire flow shall be achieved at no less
than 20 psi residual pressure.
Fire hydrants shall be spaced 300 feet on center
and so located that no structure will be farther
than 150 feet from any one hydrant.
° Fire hydrants shall be 24 inch on center, recessed in
from the curb face.
4. That the minimum fire flow required shall be determined by the
type of building construction, fire walls, and fire protection
devices provided, as specified by the I.S.O. Guide for Determining
Required Fire Flow.
5. That a minimum individual hydrant flow of 1250 gallons per minute
shall be provided at this location.
6. That all grass or brush exposing any structures shall be cleared
for a distance of 100 feet prior to framing, according to the
Ventura County Weed Abatement Ordinance.
7. That address numbers, a minimum of 6 inches high, shall be installed;
prior to occupancy, shall be of contrasting color to the background,
and shall be readily visible at night. Where structures are set-
back more that 150 feet from the street, larger numbers will be
required so that they are distinguishable from the street. In
the event a structure is not visible from the street, the address
numbers shall be posted adjacent to the driveway entrance.
Individual dwelling units shall have 4 inch numbers.
8. That a plan shall be submitted to the Ventura County Bureau of
Fire Prevention for review indicating the method in which buildings
are to be identified.

VENTURA COUNTY FIRE DEARTMENT CONDITIONS:
9. That building plans of public assembly areas, which have an
occupant load of 50 of more, shall be submitted to the Ventura
Bureau of Fire Prevention for review.
10. That fire extinguishers shall be installed in apartment buildings
according to National Fire Protection Association, Pamphlet #10.
The placement of extinguishers shall be subject to the review of
the Fire Chief.
�1. That any structure greater than 5,000 square feet in area and /or 5 miles from
a fire station shall be provided with an automatic fire sprinkler system in,
except when the structure is divided into areas of less than 5,000 square feet
with a two hour fire separation wall in accordance with Ventura County Ordinance
#14.

1. The applicant shall submit engineering data, satisfactory to the
District, that demgnstrates sufficient fireflow is available to
all parcels.
2. The applicant shall submit engineering data satisfactory to the
district showing that sewers are designed to carry the peak flow
rates from all areas tributary to them, including future developed
areas. The construction of off -site water and sewer mains may be
required to extend to the District's existing trunklines.
Note:
the District is in the early stages of planning a sewage treatment plant
expansion project. Since the cumulative increase of flow into the existing
plant is directly related to the rate at which new connections to the
sewerage system are made, the currently available plant capacity could
be consumed prior to completion of any plan expansion. This could cause
a delay in issuance of a "Will Serve" letter to the applicant to insure
the plan expansion will be complete when sewer service begins.

by the developer with staff approval Tot lot shall be fenced and
have adequate security lighting subject to staff approval.
5. Add a half -court basketball court with a concrete surface with
location subject to staff approval.
6. Increase the number of barbecues to the following:
a. Two gas barbecues shall be provided at the office /recreation
building area around the pool.
b. One gas barbecue shall be provided near the tot lot with
circular concrete picnic table with benches, subject to
staff approval.
C. One gas barbecue pit shall be provided at the east end
of the project, complete with a wood trellis cover (gazebo)
and concrete benches, subject to staff approval.
7. Amount of open space to remain at the originally presented
design except for the increased size of decking and inclusion
of the tot lot.

CONCLUSION
Traffic signals are not warranted at the intersection of
Moorpark Road with Roberts Avenue.
BACKGROUND INFORMATION
PD -1051 is a 136 unit apartment development proposed by
Lincoln Property Company. The project location would be
east of Moorpark Road opposite Roberts Avenue, and
immediately north of an existing 1.28 unit condominium
development. The purpose of the subject study was to
determine if traffic signals would be warranted if the
condominium development and the apartment development shared
a common driveway to be aligned opposite Roberts Avenue.
STUDY METHODOLOGY
Peak hour intersection hand counts and 24 -hour side street
machine counts were obtained, and observed volumes were
compared with expected volumes derived from trip generation
methods. Reliable machine counts were impossible to obtain
at the condominium complex driveway due to geometries and
motorist driving behavior. After weighing various factors,
it was determined that the most valid method of compensating
for this lack of data was to utilize modified ITE trip
generation rates to estimate the daily traffic volume
generated by the condominium development. This volume was

then combined with the projected traffic volume associated
with PD -1051, and the resulting volume was compared with the
traffic signal warrant threshold volumes. This comparison
revealed that no traffic signal warrants are satisfied for
this location.

Dear Mr. Luedtke,
This letter is our evaluation and recommendation of the traffic
issues related to the development of your property. It was
prepared at your request to help satisfy the City of Moorpark's
requirement for an additional analysis of the traffic impacts
created by the development of your project. This report is based
upon traffic data supplied by the City of Moorpark and an
evaluation of your Detailed Site Plan and aerial photograph.
EVALUATION .
Your project of 136 residential rental units (apartments) is
proposed to connect to Moorpark Road opposite the existing
Roberts Avenue intersection and is located on the east side of
Moorpark Road immediately north of Park Spring, a 128 -unit
condominium project. Your site is approximately 720 feet north
of New Los Angeles Avenue, and 1,810 feet south of High Street.
The aerial photograph shows the condominium project (Park Spring)
gains access to Moorpark Road at an offset intersection with
Roberts Avenue. To the north of your project is the tee
intersection of Flinn Avenue. You propose to combine the Park
Spring access with yours to provide a collinear driveway with
Roberts Avenue thereby creating a fourway intersection. This
realignment of the intersection is similar to the intersection
approved by the City of Moorpark for the Kavli property at it's
intersection with Condor Drive (near Princeton Avenue) on Los
Angeles Avenue at the northeasterly end of the city.
The Moorpark City Engineer and the Moorpark Unified School
District supplied us with traffic data for the intersection
turning movements and the pedestrians at Roberts Avenue, Park
Spring driveway and Moorpark Road. To these existing

(background) traffic volumes, we added and distributed the trips
expected to be generated by your 136 residential- rental units.
Our distribution uses the same directional distribution as the
Park Spring project. We then made an analysis to determine the
need for traffic signals. Using seven seperate procedures
established by the State of California, Department of
Transportation ( CALTRANS), a traffic signal is not warranted at
this intersection.
The reason signals are not warranted is that there are not enough
vehicles entering the intersection from the side streets,
although there are sufficient volumes using the intersection from
Moorpark Road. There are also not enough pedestrians using this
intersection to satisfy either the minimum pedestrian volume
warrant or the school crossing warrant. For example, the school
crossing warrant requires 70 students at the peak hour; the
maximum number supplied by the Moorpark Unified School District
count was 43.
Traffic Signal Warrant Number 5 accounts for progressive movement
of traffic, and in laymen's terms means if there is a signal
within a thousand feet, a traffic signal is not warranted. Since
your proposed intersection is approximately 700 feet from the
existing signalized intersection of Moorpark Road at New Los
Angeles Avenue, that warrant is not satisfied either.
In addition, CALTRANS does not allow signals to be installed at
intersections in rural areas at spacings closer than one -half
mile. Since you are between two existing traffic signals
slightly less than one -half mile apart, they will not allow a
traffic signal at your driveway. CALTRANS and good traffic
engineering practice holds that traffic signals are the last
resort. If Moorpark requires a traffic signal at this location,
the State would not allow the construction.
Moreover, as was found with the Princeton Avenue -Los Angeles
Avenue signal, the delay between the actual requirement for the
signal and the construction is significant. At that
intersection, the signal has been warranted for approximately ten
years and paid for since the early 1980's, and yet will not be
constructed until late this year or early next. At the same
schedule, a signal at your driveway would not be installed until
after the freeways are connected (1991 or 1992) and the heavy
morning directional traffic problem goes away.
The most significant improvement you propose to the intersection
of Roberts Avenue and Moorpark Road, is the merger of'the Park
Springs driveway to create a fourway intersection. Not only will

this be an aesthetic improvement but it is a major traffic
improvement. Our analysis (attached hereto) shows that the
existing intersection has 20 points of conflict between vehicles
entering the intersection. If your earlier proposal to have a
mid -lot entrance for PD -1051 had been allowed to stand, that
entrance would have added 8 more points of conflict within 200
feet of Roberts Avenue. Therefore, the creation of the new
driveway and the existing intersection would have provided 28
points of conflict within 200 feet on a high speed, heavily
traveled roadway. Your proposed intersection, on the other hand,
has 16 points of conflict rather than the 28 previously described

significantly reduces the potential for accidents, and increases
the operating capacity of Moorpark Road. It reduces the
potential for nearly all types of accidents associated with an
intersection. In addition, this work also makes the school
crosswalk a safer facility for school age pedestrians.
CONCLUSION
The analysis described herein shows there is no traffic signal
required for the realignment intersection of your driveway at
Roberts Avenue. The realignment to a fourway intersection is the
most significant benefit you can offer. Your project reduces the
number of conflicts along Moorpark Road.
RECOMMENDATION
It is therefore recommended that you combine the access for Park
Springs and your PD -1051 to Moorpark Road so that it is collinear
with Roberts Avenue as shown on the Detailed Site Plan. In view
of this analysis and these conclusions, a suggested condition is
attached to replace City Engineer's Conditions 11 and 12 in the
Staff Report.

Discussion:
(Lincoln Properties)
The proposed project consists of nine 2 story structures containing
both one and two bedroom units. Two of the buildings will contain
twelve units, while the remaining seven buildings will contain 16 units.
There will be 72 one bedroom units and 64 two bedroom units. The one
bedroom units are 618 square feet and the two bedroom units are 880
square feet. The architecture is classified as contemporary Early
California Monterey style and is detailed with wood trimming, concrete
mission tile, wood facial, bronze window frame, horizontal wood siding
and stain wood doors.
The existing driveway of the condominium project to the south will-be
closed and a common driveway opposite Roberts Drive will provide ingress
and egress for both projects. Both owners have agreed to this provision.
The entire site encompasses 9.14 acres with 50% open space consisting
of landscaping and recreational facilities. There is an existing block
wall along the common boundary line with the condominium project to the
south. The proposed conditions require that an 8 foot block wall be
constructed between the 8 foot carport walls on the north boundary line
so that there will be a continuous 8 foot separation between this pro-
posed residential project and the industrial facilities. To complete
the fencing, a 6 foot block wall will be constructed on the east property
line. Site amenities include: a one story recreational building of
approximately 2500 square feet, along with a tennis court, volleyball
court, pool, spa and bar -b -que area plus another bar -b -que area at the
eastern end of the project. To the extreme east of the site the develop-
er has provided a carwash facility which is an additional amenity for
an apartment complex. This car wash is for the use of tenants only.
Park and Recreation Comments:
This project will be reviewed by the Parks and Recreation Commission
on April 2, 1986. Their comments will be forwarded to your Commission.
Sta f f Comments:
This development is well designed with good separation between units
and a considerable amount of useable open space, landscaping and recreat-
ional facilities. In addition, it will help alleviate an existing traffic
problem should the traffic signal be installed. The overall effect
will be a benefit to the community.

1. Find that the proposed project will not have a significant effect
on the environment, and that this body has reviewed and considered
the information contained in the Mitigated Negative Declaration

I I . STATEMENT OF ENVIRONMENTAL, FINDINGS:
_An initial study was conducted by the Department of Community Development
to evaluate the potential effects of this project upon the environment.
Based upon the findings contained in the attached initial study it has
been det rmined
e that this project could, could not, have a significant
effect upon the environment.
MITIGATED NEGATIVE DECLARATION ONLY:
These potentially significant impacts can be satisfactorily mitigated
through adoption of the following identified measures as conditions of
approval.
MITIGATION MEASURES INCLUDED TO AVOID POTENTIALLY SIGNIFICANT EFFECTS:
(IF APPLICABLE)
That prior to issuance of a Zone Clearance the developer shall
-participate, by depositing funds with the City of Moorpark,
a contribution for the Los Angeles Area of Contribution-applicable
rate at the time the building permit is issued.
