On April 9, 1986, the Planning Commission reviewed the proposed project. The
Commission recommended approval and requested staff to prepare a resolution with
conditions attached.
RECOMMENDATION
1. Find the proposed project will not have a significant effect on the environ-
ment and that this body has reviewed and considered the information contained
in the Negative Declaration as having been completed in compliance with State
CEQA Guidelines issued thereunder; and
2. Adopt the prosed findings and approve Development Plan Permit No. DP -334
subject to the attached conditions.

REQUEST
The applicant is requesting approval for Development Plan to permit an office

BACKGROUND
On April 9, 1986, the Planning Commission reviewed the proposed project. The
Commission recommended approval and requested staff to prepar a resolution with
conditions attached.

ment and that this body has reviewed and considered the information contained
in the Negative Declaration as having been completed in compliance with State

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF MOORPARK, CALIFORNIA, RECOMMENDING AP-
PROVAL OF DEVELOPMENT PLAN PERMIT NO. DP -334 ON
APPLICATION OF BEL AIR SHEET & TUBE. ASSESSOR
PARCEL NO. 511 -0- 062 -085,- 095, -105, -115.
WHERAS, at duly notice public hearing on March 26, 1986,
the Moorpark Planning Commission considered the application filed
by Bel Air Sheet & Tube requesting approval to construct an 97,500
square foot industrial facility - 5 bays totaling 110,000 square feet.
WHEREAS, the Planning Commission, after review and consid-
eration of the information contained in the Negative Declaration, has
found that this project will not have a significant effect on the
environment; and has reached its decision in the matter;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That the findings contained in the staff report
dated March 26, 1986, which report is incorporated by reference as
though fully set forth herein are hereby approved;
SECTION 2. That at its meeting of March 26, 1986, the
Planning Commission took action to request staff to prepare a Resolution
recommending approval with the modified attached conditions for Devel-
opment Plan Permit No. DP -334; said Resolution to be presented for Consent
Calendar action at the next regularly scheduled meeting. the action
with the foregoing direction was approved by the following roll call
vote:
AYES: Commissioner Hartley, Claffey, Holland, LaPerch,
and Keenan;
NOES: None;
ABSENT: None.

8. That if any of the conditions or limitations of this developemnt
plan are held to be invalid, that holding shall not invalidate
any of the remaining conditions or limitations set forth.
9. That prior to construction, a Zone Clearance shall be obtained
from the Planning Division and building permit shall be obtained
from the Building and Safety Division.
10. That prior to the issuance of a Zone Clearance, a landscaping
and planting plan (3 sets), together with specifications and
maintenance program, prepared by a State licensed Landscape
Architect, in accordance with County Guidelines for Landscape
Plan Check, shall be submitted to the Director of Community
Development for approval. The applicant shall bear the total
cost of such review and of final installation inspection.
The landscaping and planting plan shall be accompanied by
a fee specified by the City of Moorpark. All landscaping
and planting shall be accomplished and approved prior to the
inauguration of use of this permit.
11. That the final landscape plans shall provide for a 50% shade
coverage within all parking areas. Shade coverage is described
as the maximum mid -day shaded area defined by a selected specimen
tree at 50% maturity. Landscaping and irrigation shall be
provided to the curb.
12. That all turf plantings associated with this project shall
be drought tolerant, low -water using variety.
13. That the final design of site improvements, including materials
nd colors, is subject to the approval of the Planning Commission.
14. That all roof - mounted equipment (vents, stacks, blowers, air -
conditioning equipment) that may extend above the parapet
wall shall be enclosed on all four sides by suitable screening
or fencing. Said screening material shall be of similar material
used in the construction of the parent building. Prior to
the issuance of a Zone Clearance, the final design and location
of the project must be approved by the City Planning Commission.

17. That all parking shall be surfaced with asphalt or concrete
and shall include adequate provisions for drainage, stripping
and appropriate wheel blocks, curbs or posts in parking areas.
18. That signs are subject to the City of Moorpark Ordinance Code,
Article 24, Sign Ordinance. A sign permit is required.
19. Roof design and construction shall include a minimum 18" (inch)
extension of the parapet wall above the highest point of the
roof.
20. That no later than ten (10) days after any change of property
owner or of lessee (s) or operator (s) of the subject use, there
shall be filed with the Director of Community Development
the name (s) and address (es) of the new owned (s) lessee (s)
or operators (s) , together with a letter from any such person(s),
acknowledging and agreeing to comply with all conditions of
this permit.
21. That the permittee agrees as a condition of issuance and use
of this permit to defend at his sole expense any action brought
against the City because of issuance (or renewal) of this permit
or in the alternative to relinquish this permit. Permittee
will reimburse the City for any court cost which the City
may be required by court to pay as a result of any such action.
The City may, at its sole discretion, participate in the defense
of any such action, but such participation shall not relieve
permittee of his obligation under this condition.
22. That*permittee's acceptance of this permit and /or operation
under this permit shall be deemed to be acceptance by permittee
of all conditions of this permit.
23. That disposal of all potentially hazardous wastes shall be
by a means approved by the Ventura County Environmental Health
Division, and to include State and Federal agencies.
24.*Prior to occupancy by tenant or subsequent owner that would
employ or dispose of toxic or hazardous waste a Major Modificaiton
shall be processed and filed.
25. That prior to issuance of a Zoning Clearance for any or all
uses, the applicant must obtain approval from the Ventura
County Environmental Health Department.
26. That at the time water service connection is made, cross - connection
control devise shall be installed on the water system in
accordance with the requirements of the Ventura County Environmental
Health Department.

PLANNING DEPARTMENT CONDITIONS:
27. That the continued maintenance of the permit area and facilities shall
be subject to periodic inspection by the City. The permittee shall be
required to remedy any defects in ground maintenance, as indicated by
the City Inspector within thirty (30) days after notification.
28. That prior to issuance of a zone clearance, a "Unconditional" Will Serve
letter for water and sewer service will be obtained from Ventura County
Water Works District No. 1.
29. That oversized truck and trailer vehicles (20 feet & over) shall be
prohibited from parking overnight on the north side (at Commerce, south
side of the developemnt) of Los Angeles Avenue.
30. That no oversized vehicles shall be permitted on the site other than loading
and unloading.

CITY ENGINEER CONDITIONS
1. That prior to issuance of zoning clearance, the developer shall
submit to the City of Moorpark for review and approval, a grading
plan prepared by a Registered Civil Engineer; shall obtain a
Grading Permit; and shall post sufficient surety guaranteeing
completion.
2. That prior to issuance of zoning clearance, the developer shall submit to
the City of Moorpark for review and approval, a detailed Geotechnical Report.
The grading plan shall incorporate the recommendation of the approved Geo-
technical Report.
3. That prior to issuance of zoning clearance, the developer shall
submit to the City of Moorpark for review and approval, street
improvement plans prepared by a Registered Civil Engineer; shall
enter into an agreement with the City of Moorpark to complete
the improvements; and shall post sufficient surety guaranteeing
the construction of the improvements.
The improvements shall include concrete curb and gutter, and
paving in accordance with the Ventura County Road Standards.
The applicable Road Standard Plates are as follows:
Driveways to be per Plate E -2 rev. C modified to be 30
feet wide with 10 feet radius curb returns.
Driveway locations shall be such that they do not conflict
with all power pole and existing wall locations.
4. That prior to any work being conducted within the State or City
right of way, the developer shall obtain an Encroachment Permit
from the appropriate agency.
5. That prior to issuance of zoning clearance, the developer shall
demonstrate feasible access with adequate protection from a 10
year frequency storm to the satisfaction of the City of Moorpark.
6. That prior to issuance of zoning clearance, the developer shall
deposit with the City of Moorpark a contribution for the Los
Angeles Avenue Improvement Area of Contribution.
The actual deposit shall be the then current Los Angeles Avenue
Improvement Area of Contribution applicable rate at the time
the Building Permit is issued.

7. That prior to issuance of zoning clearance, the developer shall
indicate in writing to the City of Moorpark, the disposition
of any water well(s) and any other water that may exist within
the site. If any wells are proposed to be abandoned, or if
they are abandoned and have not been properly sealed, they must
be destroyed per Ventura County Ordinance No. 2372.
8. That prior to issuance of zoning clearance, the developer shall
submit to the City of Moorpark for review and approval, drainage
plans, hydrologic, and hydraulic calculations prepared by a
Registered Civil Engineer; shall enter into an agreement with
the City of Moorpark to complete the improvement and shall post
sufficient surety guaranteeing the construction of the improve-
ments. The drainage plans and calculations shall indicate the
following conditions before and after development:
Quantities of water, water flow rates, major water courses,
drainage areas and patterns, diversions, collection systems,
flood hazard areas, sumps and drainage courses.
9. That prior to issuance of zoning clearance, the developer shall
submit to the City of Moorpark for review and approval, evidence
that all the buildable sites in the subdivision will be protected
from flooding.

COUNTY SHERIFF DEPARTMENT CONDITIONS
1. A licensed security guard is recommended during the construction
phase, or a 6 foot high chainlink fence will be erected around
the construction site.
2. Construction equipment, tools, etc., will be properly secured
during nonworking hours.
3. If an alarm system is used, it should be wired to all exterior
doors and windows and to any roof vents or other roof openings
where access may be made.
4. Lighting devices will be high enough as to eliminate anyone
on the ground from tampering with them. All parking areas shall
be provided with a lighting system capable of illuminating the
parking surface with a minimum of 1 -foot candle of light and
shall be designed to minimize the spillage of light onto adjacent
properties. All exterior lighting devices shall be protected
by weather and breakage- resistant covers.
5. Some night lighting should be placed within the interior parking
( lot area which is located between the buildings.
6. Landscaping will not cover any exterior door or window.
7. Landscaping at entrances /exits or at any intersection within
the parking lot will not block or screen the view of a seated
driver from another moving vehicle or pedestrian.
8. Landscaping (trees) will not be placed directly under any overhead
lighting which could cause a loss of light at ground level.
9. Address will be clearly visible to approaching emergency vehicles
and mounted against a contrasting color.
10. Address numbers will be a minimum of 6 inches in height and
illuminated during the hours of darkness.
11. Front door entrances will be visible from the street or parking
lot when possible.
12. Directory boards indicating locations of the various buildings
and individual units will be displayed at each entrance to the
complex.
13. All entrances /exit driveways will be a minimum of 30 feet in
width with radius curb returns.

COUNTY SHERIFF DEPARTMENT CONDITIONS
14. All exterior doors will be constructed of solid wood core minimum
of 1 and 3/4- inches thick or of metal construction.
15. Doors utilizing a cylinder lock shall have a minimum five (5)
pintumbler operation with the locking bar or bolt extending
into the receiving guide a minimum of 1 inch.
16. All exterior sliding glass doors or windows will be equipped
with metal guide tracks at the top and bottom and be constructed
so that the window cannot be lifted from the tract when in the
closed or locked position.
17. There will not be any easy exterior access to the roof area,
i.e., ladders, trees, high walls, etc.
18. Upon occupancy by the owner or proprietor, each single units
in a tract or commercial development, constructed under the
same general plan, shall have locks using combinations which
are interchange free from locks used in all other separate dwellings,
proprietorships, or similar distinct occupancies.

1. That a street width of 25 feet to provide two way traffic with
off street parking provided on both sides.
2. That the applicant shall provide sufficient proof of the ability
to prevent vehicle parking in "no parking" areas and that enforce-
ment can be secured in order that access by emergency vehicles
will not be obstructed.
3. That access roads shall be installed with an all- weather surface,
suitable for access by fire department apparatus.
4. That all drives shall have a minimum vertical clearance of 13
feet, 6 inches (1316 1%).
5. That prior to construction, the applicant shall submit plans
to the Ventura County Bureau of Fire Prevention for approval
of the location of fire hydrants. Show existing hydrants on
plan within 300 feet of the development.
6. That fire hydrants shall be installed and in service prior to
combustible construction and shall conform to the minimum standards
of the Ventura Water Works Manual.
a. Each hydrant shall be a 6 inch wet barrel design and shall
have two 4" and one 2 1 " outlet (s) .
b. The required fire flow shall be achieved at no less that
20 psi residual pressure.
C. Fire hydrants shall be spaced 300 feet on center, and so
located that no structure will be farther than 150 feet
from any one hydrant.
d. Fire hydrants shall be recessed in from curb face 24 inches
at center.
7. That the minimum fire flow required is determined by the type
of building construction, proximity to other structures, fire
walls, and fire protection devices provided, as specified by
the I.S.O. Guide for Determining Required Fire Flow. Given
the present plans and information, the required fire flow is
approximately 4500 gallons per minute. The applicant shall
verify that the water purveyor can provide the required quantity
at the project.

VENTURA COUNTY FIRE DEPARTMENT CONDITIONS:
8. That a minimum individual hydrant flow of 1750 gallons per minute
shall be provided at this location.
9. That address numbers, a minimum of 6 inches high, shall be installed
prior to occupancy, shall be or contrasting color to the background;
and shall be readily visible at night. Where structures are,
setback more than 250 feet from the street, larger numbers will
be required so that they are distinguishable from the street.
In the event a structure(s) is not visible from the street,
the address number(s) shall be posted adjacent to the driveway
entrance.
10. That a plan shall be submitted to the Ventura County Bureau of
Fire Prevention for review indication the method in which build-
ings are to be identified by address numbers.
11. That building plans of all "H" occupancies shall be submitted to
the Ventura County Bureau of Fire Prevention for review.
12. That fire extingushers shall be installed in accordance with
National Fire Protection Association, Pamphlet #10. The place-
ment of extinguishers shall be reviewed by the Fire Prevention
Bureau.
13. That if any buildings(s) are to be protected by an automatic
sprinkler system, plans shall be submitted, with payment for
plan check, to the Ventura county Bureau of Fire Prevention
for review.
14. That plans for the installation of an automatic fire extinguishing
system (such as, halon or dry chemical) shall be submitted to the
Ventura county Bureau of Fire Prevention for review to insure
proper installation.
15. That plans shall be submitted for any hazardous operation for
approval by the Ventura County Bureau of Fire Prevention.
16. That any structure greater than 5,000 square feet in area and /or
5 miles from a fire station shall be provided with an automatic
fire sprinkler system in accordance with Ventura County Ordinance
#14.

The applicant is requesting approval to construct an 97,500 square
foot industrial facility - 5 bays totaling 110,000 square feet. No
specific tenant has been identified.
STAFF TESTIMONY AND PROPOSED FINDINGS:
1. Location and Parcel Number:
The proposed project is located at the northeast corner of Los
Angeles Avenue and Gabbert Road. The site is retangular in shape.
Assessor Parcel No. 511 -0- 062 - 085,- 095,- 105, -115.
2. Description of Request:
The applicant is requesting approval to construct a 110,000 square
foot facility containing 5 separate bays at 22,000 square feet each.
The site contains 4.3 acres which will be developed with a low
profile structure. Access to the site will be Gabbert Road.
Each bay will total approximately 22,000 square feet i.e. 22,000
square feet manufacturing and 2,000 square feet of office.
Front entrance to all bays is located north on project off
Commerce Avenue while rear and passage door will be constructed
to the south of the project facing Los Angeles Avenue. However,
the negative impact - visually will be mitigated by an existing six
foot split face block wall along with landscaping. Parking as
indicated on the site plan is sufficient for the proposed project.
The architecture of the building is a low- profile with a maximum
height of 25 feet.

2. Description of Request: continued
The building will be white concrete - tilt -up which is detailed with
alternating bands of grey. In addition, black glazed windows will
be utilized as further detail. Access to the rear of each bay
will be provided by either roll up doors or passage door.
Parking adheres to the new industrial development standard
which states that warehousing requires: one parking space
per each 1,000 square feet of gross floor area for the first
20,000 square feet (20,000/1,000) and one parking space per 2;000
square feet of gross floor area for over 20,000 square feet
(77,500/2,000), while office space requires one parking space
per each 300 square feet of gross floor area (12,500/300) which
equates to 42 parking spaces. The site plan indicates sufficient
parking in both areas. The building setbacks also conform to the
new industrial standards. This particular project faces on 3
corners. Thus it requires front yard set requirement on all 3
corners. The requirement on Oabbert Road (major front street)
setback is 30 feet which the plan illustrates, while the require-
ment for a front yard setback on a minor street requires 20 feet
which the plans also delineates. Under the old code the required
front yard setback (major street) requirement for the "M -2" zone
would be 15% of the lot width or 81 feet; however, the code further
provides for a 30 foot maximum. On Los Angeles Avenue the require -
ed front yard setback would be 52 feet or again a maximum of 30
feet. Under landscape guides, a landscaping strip shall be provided
along property lines adjacent to and public right of way. Said
plant strip shall not be less than 10 feet wide for industrial
lots. Although this plan only illustrates a 4 foot strip along
Los Angeles Avenue, staff supports such a request due to the
existing 5 feet split -face block wall which will mitigate visual
impacts on said project. In addition, the property lines transit-
ion to give a less abstrusive view.
3. Existing Land Use:
The subject site is vacant. No specific tenant has been identified.
4. Adjacent land Use:
North: Industrial - Medium (M -2)
South: Residential
East: Industrial - Medium (M -2)
West: Power Station
Therefore, as conditioned, the proposed project would be compatible
with adjacent land uses;
5. Existing Natural Features:
The subject site is flat.

6. Zoning:
Existing zoning for the project site is "M -2 ".
As conditioned, the project would be compatible with existing
zoning;
7. General Plan:
The Land Use Element of the Moorpark General Plan designates
the site as "I -2" (Medium Industrial).
The project, as proposed is consistent with the objectives,
policies, general land uses and programs of the General Plan;

9. Services:
a) Water and Sanitation:
The Ventura County Waterworks District No. 1 has indicated
that adequate service can be provided at this time.
However, the District is in the process of studying the next
expansion to the plant in order to serve all approved and
proposed projects.
Therefore, with appropriate conditioning, there are adequate
water and sanitation services for the project.
b) Police and Fire Protection:
According to responses submitted by the Police and Fire
Department, this project would not have a significant
effect on law enforcement of fire protection services;
Therefore,with appropriate conditioning, there are adequate
provisions for police and fire services;

10. Traffic Circulation:
Access to the site would be from Commerce and Gabbert. The
applicant under Parcel Map No. PM -3192 on which the proposed
project is located had previously bonded toward the Los
Angeles Avenue Area of Contribution and therefore no such
mitigation measures are necessary for the proposed project.
Therefire, as conditioned, there are adequate provisions for
access to the project site;
11. Environmental Review:
Since no specific use has been proposed for this building,
potential use related impacts (re use of hazardous materials)
have not been evaluated as part of this review. This review
pertains only to the construction of the building and associated
impacts.
Based upon an initial review, the proposed project would not
have a significant effect on the environment and a Negative
Declaration has been prepared (Exhibit "3 "). The public review
was from February 24 - March 9, 1986, no comments have been
received.
12. Public Comments:
To date, the Department of Community Development has received
no public comments regarding this project.
13. Development Advisory Committee:
On March 19, 1986 , the applicant's representative
met with City staff to review the recommended conditions of
approval.
14. Ordinance Compliance:
Based upon the information and findings set forth above
it is determined that this application with the attached
conditions meets the requirements of Moorpark Ordinance
Code Section 8163 -3, in that:
a) The proposed uses would be consistent with the purpose,
intent, guidelines, standards, policies and provisions
of the General Plan;
b) The proposed uses would not impair the integrity and
character of the zone in which they are located;

c) The proposed uses would be compatible with land uses
permitted within the General Plan land designations
and the zones in the general area where the uses are
to be located;
d) The proposed uses would not be obnoxious or harmful or
impair the utility of the property itself or neighboring
property or uses; and
e) The proposed uses would not be detrimental to the public
interest, health, safety, convenience or welfare.
RECOMMENDED ACTION:
1. Find that the proposed project will not have a significant effect
on the environment and that this body has reviewed and considered
the information contained in the Negative Declaration and approves
the attached Mitigated Negative Declaration as having been completed
in compliance with State CEQA Guidelines issued thereunder; and
2. Adopt the proposed findings and recommend to the City Council
that DP -334 be approved, subject to the attached conditions.

plan are held to be invalid, that holding shall not invalidate,

from the Planning Division and building permit shall be obtained

The City may, at its sole discretion, participate in the defense
of any such action, but such participation shall not relieve
permittee of his obligation under this condition.

under this permit shall be deemed to be acceptance by permittee
of all conditions of this permit.

plan prepared by a Registered Civil Engineer; shall obtain a
Grading Permit; and shall post sufficient surety guaranteeing
completion.
2. That prior to issuance of zoning clearance, the developer shall
submit to the city of Moorpark for review and approval, a detailed
Geotechnical Reposrt.
3. That prior to issuance of zoning clearance, the developer shall
submit to the City of Moorpark for review and approval, street

COUNTY SHERIFF DEPARTMENT CONDITIONS
1. A licensed security guard is recommended during the construction
phase, or a 6 foot high chainlink fence will be erected around
the construction site.
2. Construction equipment, tools, etc., will be properly secured
during nonworking hours.
3. If an alarm system is used, it should be wired to all exterior
doors and windows and to any roof vents or other roof openings
where access may be made.
4. Lighting devices will be high enough as to eliminate anyone
on the ground from tampering with them. All parking areas shall
be provided with a lighting system capable of illuminating the
parking surface with a minimum of 1 -foot candle of light and
shall be designed to minimize the spillage of light onto adjacent
properties. All exterior lighting devices shall be protected
by weather and breakage- resistant covers.
5. Some night lighting should be placed within the interior parking
lot area which is located between the buildings.

14. All exterior doors will be constructed of solid wood core minimum
of 1 and 3/4- inches thick or of metal construction.
15. Doors utilizing a cylinder lock shall have a minimum five (5)
pintumbler operation with the locking bar or bolt extending
into the receiving guide a minimum of 1 inch.
16. All exterior sliding glass doors or windows will be equipped
with metal guide tracks at the top and bottom and be constructed
so that the window cannot be lifted from the tract when in the

2. That the applicant shall provide sufficient proof of the ability
to prevent vehicle parking in "no parking" areas and that enforce-
ment can be secured in order that access by emergency vehicles
will not be obstructed.
3. That access roads shall be installed with an all- weather surface,
suitable for access by fire department apparatus.
4. That all drives shall have a minimum vertical clearance of 13
feet, 6 inches (13'6 ").
5. That prior to construction, the applicant shall submit plans
to the Ventura County Bureau of Fire Prevention for approval
of the location of fire hydrants. Show existing hydrants on
plan within 300 feet of the development.
6. That fire hydrants shall be installed and in service prior to
combustible construction and shall conform to the minimum standards
of the Ventura Water Works Manual.

8. That a minimum individual hydrant flow of 1750 gallons per minute
shall be provided at this location.

and shall be readily visible at night. Where structures are

We would like to see a detailed traffic study which examines
existing and future average daily traffic volumes (ADT), traffic
generation (including peak hour), traffic distribution, ICU
analysis, and current and projected capacities of all affected
highway and freeway routes. The cumulative impacts of this and
other projects planned for the area should also be addressed.
Provisions for alternatives to single occupant commute trips
should be encouraged. Mitigation measures that might be
considered to reduce traffic related effects should include
public transit, rideshare programs and bicycle use. Coordination
steps taken to ensure the implementation of proposed mitigation
should be documented.
