BACKGROUND
Pursuant to the Council's recently adopted policy requiring
Council approval on the removal of 4 -inch diameter or larger
oak trees, the following request is presented to the Council
for consideration.
A 12 -inch diameter oak tree presently exists at the westerly
edge of the proposed parking lot for the Kavlico project.
It is Kavlico's desire to remove this tree to allow for the
construction of the parking lot. (Please refer to the attached
letter dated August 11, 1986 from Kavlico.) This parking
plan was authorized in the recently approved Minor Modification.
RECOMMENDATION
The staff's recommendation in this matter is to approve the
requested tree removal. The reasons supporting the recommendation
are as follows:
1.` Neither the conditions of approval of the Development
Plan Permit nor the Negative Declaration pertaining
to the project require that all on site trees be
protected.

2. A very small negative aesthetic impact would result from the
tree removal. The tree requested to be removed is
at the edge of a large cluster of similar trees.
Its removal would still offer an aesthetic backdrop
of many oak trees beyond the parking lot.
3. It might be impractical to save the tree. The elevation
of the base of the tree is four to five feet below
the proposed finished elevation of the parking lot.
A fairly large amount of land area may have to be
devoted to protect the tree. Tither a "saucer"
would have to be created to allow sufficient soil
exposure at the base of the tree, four to five feet
below average grade, or the parking area be paved
away from the tree at a sufficient distance to exclude
the tree from the site. The amount of area that
may have to be devoted to saving the tree may be
the equivalent of six parking spaces.
4. The original approval of the project required no
grading or tree removals in the area west of the
arroyo behind the building. The approval of the
Minor Modification relocated much of the parking
that was previously visible in front of the building
to the rear. Now grading will be required west
of the arroyo. The new plan approved as a result
of the Minor Modification is a much improved plan.
In any method of saving the tree it appears that a major
effort would be required to work around the tree; the tradeoffs
of saving the tree do not appear to demonstrate that it is
to anyone's benefit to protect the tree.
Should the Council determine that the tree must be saved,
it will be the responsibility of the developer to propose
a design to the City that would adequately protect the tree.

Dear Mayor and Members of the Council:
Pursuant to your decision to require City Council approval for the removal
of oak trees on our project, we are writing to request approval for the
removal of one oak tree which is labeled 12" in our parking lot drawing.
We are going to be able to save one oak tree which was scheduled for removal,
but the one we are herein asking permission to remove sits too low to be
saved. Only approximately one -half of the greenery of the tree would be
sticking up out of the parking lot, and as a result, this tree would detract
from the appearance of the parking lot and the beautiful backdrop of the
hillside which contains numerous beautiful oak trees.
