PD -1044 (Calprop) Environmental Review At the last regular meeting of the City Council (9/2/86), questions were raised as to the processing of the environ- mental documents for the above tract. The following is provided for the Council's information. 1. On May 8, 1985 an Initial Study, pursuant to CEQA, was completed on the environmental impacts of Tentative Tract Map No. 4037. It was determined that based on the Initial Study the EIR for Tract 2964 essentially addressed the same project on the same site as Tract 4037 and areas east of present site. A summary of the projects is provided (see Attachment "A -1 "). A notice of an environmental review period of 30 days was mailed to property owners within the required radius of the project site and notice in the Moorpark News. The review period was from June 15 - July 1-5-,--1785 (see Attachment "A -2 "). The public notice did not mention that a portion of Tract 2964 was on the same site as Tract 4037. 2. The above notice mentioned a public hearing on the subsequent use of the EIR and the project itself before the Planning Commission would be held on July 11, 1985. The hearing was held and continued to August 8, 1985. In addition a second notification for Tract 4037, though not required was mailed and published. This notice also covered Tract 4069 which subsequently became the future site of the Presbyterian Church (see Attachment "B "). 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 THE HONORABLE CITY COUNCIL p. 2 - September 11, 1986 SUBJECT: TRACT NO. TR- 4037 /PLANNED DEVELOPMENT PERMIT NO. PD -1044 (Calprop) Environmental Review 3. On August 8, 1985, the hearing was immediately continued to August 29, 1985. 4. On August 29, 1985, the hearing on the EIR and project was conducted and the Commission recommended approval of the Subsequent use of the EIR for Tract 2964 for this project and directed that a resolution recommending approval of Tract 4037/PD -1044 be prepared for consideration at its next regular meeting of September 12, 1985. 5. On September 12, 1985, the resolutions were placed on the Commission's agenda. However, they were not adopted until the next meeting of September 26, 1985. (Resolution Nos. PC -85 -55 & 56, see Attachments "C" & "D "). Prior to the August 29th hearing date the staff report incorrectly referred a Mitigated Negative Declaration for the proposed project. This was an error which was corrected at the Commission's August 29, 1985 meeting to correctly refer to the subsequent use of an EIR for this project. The staff report makes a statement that the environmental issues were identified in the EIR for Tract 2964. The resolutions correctly refer to the subsequent use of an EIR. (This may explain the confusion that was expressed at the Council's September 2nd meeting as to whether there was a negative declaration, or an EIR, or both. 6. The items appeared on the Council's October 7, 1985 agenda for a public hearing and were duly noticed. (See Attachment "E ") The item was continued to October 14, 1985. 7. On October 14, 1985, the Council conducted its hearing. 8. At its meeting of October 21, 1985, the Council adopted Resolution No. 85 -240, approving Tentative Tract No. TR- 4037 /Planned Development Permit No. PD -1044. GILLESPIE Chief of Police 67 single family homes and one triangular in shape and located Moorpark Road and Peach Hill Request to create a single parcel of approximately 3" acres in size. The stated intent is for a future Conditional Use Permit application for the construction of a Presbyterian church. Both of these applications have been reviewed and found to potentially have significant adverse environmental impacts. It is staff's recommendation to use the EIR prepared in 1981 by the County of Ventura for another subdivision in this area as the EIR for the present proposals. All site and cumulative development issues would not be greater than had previously been discussed. City procedures and State law require that the subsequent use of an EIR has a 30 day public review period during which a hearing on the adequacy of the document will be held by your Commission. Notice has been mailed and published indicating a review period from June 15 to July 15, 1985, for the EIR and a hearing on the EIR has been scheduled before your Commission on July 11, 1985. Your Commission's review of the projects are tentatively scheduled for July 25 with City Council action on August 19. Please review the report and retain it for your subsequent meetings. RESOLUTION NO. 85- 240 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING TENTATIVE TRACT NO. TR -4037 AND RESIDENTIAL PLANNED DEVELOPMENT PERMIT NO. RPD -1044, ON APPLICATION OF CARLSBERG CONSTRUCTION COMPANY. WHEREAS, at duly noticed public hearings on August 19 and September 12, 1985, the Moorpark Planning Commission considered the applica- tion of Carlsberg Construction Company for approval of Tentative Tract No. TR -4037 for subdivision of a 16.84 acre parcel and creation of 66 single family lots and a companion Residential Planned Development Permit No. RPD -1044 for 66 single family homes and recreational facilities, located northwest of and adjacent to the intersection of Peach Hill Road and Moorpark Road, within said City; and WHEREAS, after careful consideration, the Planning Commission reached its decision in the matter and adopted its Resolution No. PC- 85 -55, recommending approval of Tentative Tract No. TR -4037, and Resolution No. PC- 85 -56, recommending approval of Residential Planned Development Permit No. RPD -1044; and WHEREAS, public notice having been given in time, form and manner as required by law, the City Council of the City of Moorpark has held a public hearing, has received testimony regarding said project, has duly considered said proposed project, and has reached its decision; and WHEREAS, the City Council, after careful review and consideration, has determined that the proposed project will not have a significant effect on the environment, has reviewed and considered the information contained in the Environmental Document prepared for Tract 2964, and has approved the Subsequent Use EIR as having been completed in compliance with CEQA and the State CEQA Guidelines issued thereunder; NOW, THEREFORE, THE CITY COUNCIL OF THECITYOF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That the findings contained in the staff report dated August 29, 1985, are hereby adopted, and said report is incorporated herein by reference as though fully set forth. SECTION 2.
