GILLESPIE Chief of Police In July, the City Council reviewed a revised grading plan for the Kavl ico Project. This revised grading plan addressed the extension of the parking lot to the west of the building, the incorporation of the reinforced concrete storm drain box and the grading of the entire southerly portion of the property. At that time, it was pointed out by the City Engineer that due to the problems experienced with this project during the last rainy season, the approval stipulated that all grading work on the borrow site be completed prior to October 15, 1986. As of this date, this work has not been completed. Since the developer has not complied with the requirements of this grading permit, the City Engineer, under Section 7303 of the Standard Land Development Specifications, is requiring the developer to place all necessary erosion control measures for the proper disposal of storm waters from the borrow site. As stipulated in this section, all such facilities must be in place and operational on or prior to November 1st of each year. The developer has been notified of this requirement by letter (a copy attached). Should the developer fail to comply, it shall be deemed that a default has occurred under the conditions of his grading permit bond. IG8b5) �29 -6c�64 Page -2- With regard to this developer's work within the Ventura County Flood Control District Channel (Happy Camp Drain), the City Engineer is also concerned with the potential of flooding. Due to these concerns, the City Engineer has discussed this matter with the Flood Control officials and they have ordered that Kavlico open up the Happy Camp drain as soon as possible. The County Flood Control has also stated that if this work is not done expeditiously that County crews and equipment will be used to open up the drain with all costs to be charged to the developer. In recent discussions with the developer, he has stated that the storm drain box should be completed on October 13th with backfill operations to begin on October 15th. with this schedule, the channel should be open, according to the developer, within approximately one week. An exact time frame for both of the above items is not known at this time. An update will be provided at the City Council Meeting of October 20, 1986. RECOMMENDED ACTION It is recommended that the City Council receive and file this report. GILLESPIE Chief of Police On July 30, 1986, a grading plan change order for your site was approved by the City Engineer. On sheet 1 of these plans, note 1 specified that "all grading shall be completed and slopes hydroseeded and irrigated prior to the rainy season (October 15,.1986)". A recent site check indicates that this has not been completed. Also, according to paragraphs "B ", and "E" of Section 7303 of the City's grading ordinance, erosion control plans for the site should have been submitted to our office by September 15, 1986 with installation of the erosion control devices by November 1, 1986. Due to the failure to perform either of the above measures, we are requiring immediate action as follows: 1. All graded slopes shall be covered with plastic and sandbagged as well as. sandbagging of all of the toe of slopes. Desilting basins shall be constructed so as to eliminate mud and debris from clogging the Happy Camp drain or entering public right -of -way along Los Angeles Avenue. Grading shall be done adjacent to Los Angeles Avenue along the frontage of the property such that all sheet flows from Los Angeles Avenue shall be carried off of the public right -of -way, transmitted along a graded ditch adjacent to the road and eventually emptied into the Happy Camp channel. i 799 Moorpark Avenue Moorpark, California 9302 1 (805) 529 -5364 Page -2- Further refinement of this plan can be done in the field with the inspector (Ron Wilson) or John Knipe in the City Engineer's office. 2. Nothing less than measurable progress on the grading operation and the good faith effort on your part will enable us to rescind our directive that your project is in default of the conditions that have been stated on the plan. If an immediate effort to begin work to finalize the grading is not begun, we have no choice but to contact the bonding company and notify them of the default. Your immediate attention to the above items is requested and if there should be any questions, please contact either R. Dennis Delzeit or myself at (805) 653 -6597.
