Location Assessor's Parcel Number: 513 -0- 050 -085 Size of Permit Area: 227.723 acres Number of Drill Pads: one Size of Drill Pad: 3/4 -acre General Plan Designation: Open Space 10 to 40 du /acre Existing Land Use: Cattle grazing Propos 41, Sun Exploration and Production Company is requesting approval of conditional use permit (CUP) 4502 to drill one (1) exploratory oil well (A. A. Vail #1). The 3/4 -acre site is located within the City of Moorpark (see Exhibit 1). The location of the drill site will be on an east facing slope, as illustrated in Exhibit 2. The site will be developed with an 18 -inch berm to capture any hazardous substances (hydrocarbons) that might spill. A drainage pipe (6 to 8 inches) with a valve will be placed at the low point of the site. If any hydrocarbons spill, a vacuum truck will drain the spilled material, then deposit it at an approved waste disposal site. The Honorable City Council January 30, 1986 Page 2 Access to the site will be provided along Tierra Rejada Road to the existing Apache Road, then along a dirt access road to be constructed. Before drilling operations commence, grading of both a drilling pad and the access road from Apache Road to the site will be necessary. The drilling pad will be 3/4 of an acre. The access road will be approximately 3,000 feet long. Approximately 5,000 cubic yards of earth will be removed to install the drilling pad, and 6,640 cubic yards of earth will be removed to provide access to the drill site. An excess -fill dump site located on approximately 1/4 -acre within the permit area will accommodate the earth removed for the drill site while earth removed for the access road will be bermed alongside the road. Drilling operations will require one drilling rig that is approximately 140 feet in height. Once the rig is in place, the drilling phase will take 30 days and activity will occur 24 hours a day. The depth of the well will not exceed 6,000 feet. During night time hours, the drill site will be lighted. After the 30-day drilling period, the applicant will require 45 days to test and complete the well, remove the rig and restore the drill site. During the drilling phase, an estimated 12 vehicles per day (24 round trips) will transport men and materials to and from the site. If oil is found on the drill site, the applicant will conduct tests to determine the quality of the discovered oil or gas. Gas flaring could occur. Additional exploration or any production activities would not be permitted by this Conditional Use Permit, such activities if determined b the a licant to be feasible would require an additional conditional use permit and additional environmental analysis prior to any permit approvals. Statement of Environmental Findimrs An initial study was conducted by the firm of Michael Brandman Associates, Inc. (MBA), under contract to the City of Moorpark. The initial study was conducted to evaluate the potential effects of the project on the environment. Based on the findings contained in the attached initial study, it has been determined that this project could have a significant effect on the environment. These potentially significant impacts can be satisfactorily mitigated through adoption of the following identified measures as conditions of approval. Adoption of these measures would ensure that the project would not impair the use of any adjacent properties and would not be detrimental to the public interest, health, safety, convenience and welfare. 1. If no oil is found and /or no future oil drilling permits are granted, the site shall be returned to its original land form if economically extractable hydrocarbons are not found. This would be accomplished, in part, by returning excess fill from the fill dump area (located on the project site) to the drill pad site. 2. The site shall be bermed with an 18 -inch berm to capture any hydrocarbons that might spill. Any spilled hydrocarbons shall be removed with a vacuum truck and disposed of at an approved waste disposal site. The Honorable City Council January 30, 1986 Page 3 3. No construction of access roads or the drill site shall take place within the dripline of any oak trees. 4. Lighting for nighttime operations shall be conducted with internally silvered globes, external opaque reflectors, or low- intensity lights, with all lighting directed away from offsite areas. 5. Flaring of natural gas shall be permitted for testing purposes only. 6. All operations shall comply with the standard conditions of the California Division of Oil and Gas regulations, the Ventura County Fire Department regulations and the Ventura County Air Pollution Control District regulations. 7. The site shall be open for inspection, at any time, by officials of the city of Moorpark, county of Ventura or other appropriate officials. These conditions apply only to the exploratory drilling operations for one (1) well. Any production operations requiring continued exploratory wells and /or the drilling of production wells, will require other permits and shall be required to satisfy additional environmental requirements. Response to Planning Commission Concerns At the public hearing of January 8, 1986, the City of Moorpark Planning Commission voted 5-0 to deny requested CUP 4502. At the Planning Commission hearing, approximately 20 residents of the Villa Del Arroyo Mobilehome Park came to the meeting to voice their opposition. The opposition was based on the concern that if a exploratory well was successful, the area would be full of pumping oil well wells and the noise, smell, and visual appearance would be highly detrimental to the area. Commissioners agreed with the Mobilehome Park residents and by unanimous vote denied the request. Staff Comment: Certainly, this action is a necessary first step if any oil wells are to be drilled for production. The proliferation of unsightly oil wells, especially in close proximity to residential areas is a very valid concern. With the modern techniques of slant drilling, quieter (electrical) pumps, and the ability through the Conditional Use Permit process to limit the number and location of wells as well as restrictions on hours of delivery, the provision of screening and landscaping, the detrimental effects can be alleviated. Any residual detrimental effects must be weighed against the property rights of the owner, the income to the residents of the City as well as contributing in some way to the energy needs of the county. The Honorable City Council January 30, 1986 Page 4 Recommendations Following the close of the public hearing on the requested conditional use permit, the City Council can take one of the following actions: 1. Find that the proposed project will not have a significant effect on the environment if the statement of environmental findings are adopted, and approve the attached Negative Declaration as having been completed in compliance with CEQA and State EIR Guidelines issued thereunder and that this body has reviewed and considered the information contained in the Negative Declaration, and; 2. Adopt the following findings (a through d) and approve Conditional Use Permit No. CUP 4502 subject to the recommended conditions. Specifi- cally, based on the information and findings set forth above, it is determined that this application, with the attached conditions, meets the requirements of Moorpark in that: a. The proposed use would be compatible with existing and future land uses within the zone and the general area in which the proposed use is to be located; b. The proposed use would not be obnoxious or harmful to adjacent properties; c. The proposed use would not impair the integrity and character of the zone in which it is to be located; and, d. The proposed use would not be detrimental to the public interest, health, safety, convenience or welfare. 3. Deny requested CUP 4502; or 4. The closest residents to the site — the Virginia Colony Mobile Home Park — are located approximately 3,500 feet to the northwest. A drainage pipe (6" -811) with a valve will be placed at the low point of the site. If any hydrocarbons spill, a vacuum truck will drain the spilled material, then deposit it at an approved waste disposal site. Access to the site will be provided along Tierra Rejada Road to the existing Apache Road, then along a dirt access road to be constructed to the site. Trucks using the access roads to the site will travel no closer than 2,000 feet from the Virginia Colony Mobile Home Park. Before drilling operations commence, grading of both a drilling pad and the access road from Apache Road to the site will be necessary. The drilling pad will be three - quarters of an acre in size. The access road will be approximately 3,000 feet long. Approximately 5,000 cubic yards of earth will be removed to install the drilling pad, and 69640 cubic yards of earth will be removed to provide access to the drill site. An excess fill dump site located about one quarter -acre within the permit area will accommodate the earth removed for the drill site while earth removed for the access road will be bermed along the road. All operations shall comply with the standard conditions of the California Division of Oil and Gas regulations, the Ventura County Fire Department regulations, and the Ventura County Air Pollution Control District regulations. 9. Determination (To be completed by the Lead Agency) On the basis of this initial evaluation: I find that the proposed project COULD NOT have a significant effect on the environment, and a NEGATIVE DECLARATION will be prepared. I find that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case X because the mitigation measures described on on attached sheet have been added to the project. A NEGATIVE DECLARATION WILL BE PREPARED. I find the proposed project MAY have a significant effect on the environ- ment, and an ENVIRONMENTAL IMPACT REPORT is required. J � Date Iza SigKoture For ENVIRONMENTAL IMPACTS 1. Earth a. Soil from the drilling pad area will be placed in an excess fill area located on about one - quarter acre. The soil will be spread evenly at a height of less than one foot and compacted as necessary. Soil removed from the access road will be bermed adjacent to the roadway. After the project has been completed, the removal of soils can be mitigated by returning such soils to the drill pad site and returning the site to its original landform. b. The soil supports grassland used for grazing. The limited soil removal that will occur will not affect any agricultural lands and would not substantially increase erosion. Thus, the impacts from soil removal are not considered significant. c. The three - quarter -acre drill site is located on a 12.3 percent slope which will be leveled as part of the project. However, the site is not visible to any roadways and grade changes are not considered significant. d. Increased erosion in the project area will occur due to vegetation removal. However, the project will last only 2 to 3 months, after which the site will return, eventually, to its natural state. Erosion will not be significant during project operations and would further diminish after operations cease. 2. Air a. Drilling operations will result in air emissions, including NOx. However, the Ventura County Air Pollution Control District (APCD) staff has determined that the project's emissions estimate of 11.7 tons of NOx over the 30-day drilling period is below the 13.7 tons per year threshold established by the county. Thus, air emissions would not be significant. b. Because diesel fuel will be used for drilling operations, objectionable odors may be produced. However, due to the remoteness of the site, any odors produced from the project would be diluted in the ambient air, resulting in no detectable objectionable odors in 'Moorpark residential areas. 3. Water b. Drainage patterns may be slightly altered due to the proposed grading of the drill site and access road. However, this effect will only be temporary, and drainage patterns would return to their original pattern after project completion. Furthermore, the site does not drain directly into any water bodies, including the Arroyo Simi. e. There is a possibility that hazardous substances (hydrocarbons) may spill and enter surface drainages; however, an 18 -inch berm will be constructed to capture any hydrocarbons that might spill. A drainage pipe (6 -8 inch) with a valve will be placed at the low point of the drain site. If any hydrocarbons spill, a vacuum truck would remove the spill and deposit the spilled substances at an approved waste disposal site. 4. Plant Life a. The project site and access road cross through annual grassland and sage - scrub plant communities. No rare or endangered species of plants were found during a field survey and none are expected to be present on the site. However, there is the potential that 4 or 5 coast live oak trees could be impacted by construction of the access road. This will be mitigated by prohibiting the applicant from constructing any roadway segments within the dripline of oak trees. 5. Animal Life c. Lighting of the drill rig at night could result in disruptions to the light - dark rhythms of nocturnal animals. This would be a highly localized impact and is mitigable through the use of silvered globes and directing the lighting away from areas where drilling will not occur. 6. Noise a. The proposed project would result in increases in existing noise levels. Due to the remoteness of the drill site, however, project noise would not be significantly detectable in residential areas in Moorpark. 7. Light and Glare The project will use lighting sources to aid workers during drilling operations at night. The site would be visible at night due to such lighting. However, as the site is on the opposite side of a ridgeline that is visible to - Moorpark residents, lighting would be only minimally detectable. Flaring might also occur at the site, but would occur during only a short period of time. Both lighting and flaring would be temporary impacts lasting only as long as the project life. 8. Land Use While the proposal would alter the current land use of the site, due to the short time frame of the project (75 days), this alteration is not considered significant. After project operations cease, the project site would revert back to its current land use. 10. Risk of Upset a. Certain activities during the drilling and production phases are critical regarding well control, fire, explosion, oil spills, and other discharges or emissions. However, standard conditions would require the applicant to comply with California Division of Oil and Gas regulations, County Fire Department regulations and Air Pollution Control District regulations. Therefore, with the imposition of standard oil permit regulations, the risk of impact would be insignificant. 16. Utilities c. The applicant proposes to truck in all needed water to the site, estimated at 400 barrels per day. 18. Aesthetics One of the project components, a 140 -foot high drill rig, would be partially silhouetted above the ridgeline, and would be visible to certain residents of ?Moorpark to the north.
