Approval of Warrant Register: - Prepaid Warrants No. 4341-4352 & 4289 $ 21,417.95 - Payable Warrants No. 4353 to 4387 $116,920.04 B. Approval of a City Manager -approved contract for a Recreation Leader III for the STAR CLUB, an after school program for children. 8. PUBL=C HEAR=NGS: A. Revision to the Grading Plan for Tract Nos. 4170 and 3070-4; U.S. Condo- minium Corporation. Adjustment to pad elevation grades causing 103,000 cubic yards to be readjusted on the subject site; adjacent to Campus Park Drive, Marquette Street and the future streets of Marymount, Queens Court, Cutter Circle, Loyola Street and Marquette Circle. Staff Recommenaation: Council uphold the Planning Commission's denial of the request. B. Proposed Area of Benefit for the improvement of Tierra Rejada Road, north and south of the proposed Tierra Rejada Bridge. Staff Recommendation: Establish an Area of Benefit pursuant to Government Code Section 66484 to include properties owned by Urban West Communities and Boething Family Trust. .hose who wish to address the City Council on any item are required to fill out a Speaker's Card, and present it to the City Clerk prior to the item being heard or they may not be City Council Agenda February 4, 1987 Page Two 9. ORDTNANCES / RESOLUT TOMS: A. Second Reading and Adoption of Ordinance No. 86 amending the zoning of certain properties located on the south side of Los Angeles Avenue east of Liberty Bell Road from Residential-1 (R-1) to Commercial Planned De- velopment (CPD) - Everett Braun (Zone Change ZC-2811). Staff Recommendation: Approve the ordinance for second reading and adoption. B. Ordinance No. Amending the Moorpark Municipal Code to provide for extending the time period in which zoning clearances, building permits, and time extensions on existing building permits are valid, from 180 days currently in effect to one (1) year. Staff Recommendation: Approve the ordinance for first reading and intro- duction. C. Resolution No. Request from LAFCO to amend the Tierra Rejada Greenbelt area so as to reduce the greenbelt by 18.6 acres and adjust the boundary by moving a 900 foot portion of the southerly boundary along Madera Road approximately 900 feet north. Staff Recommendation: Approve the requested amendment by approving the resolution presented. D. Special Election on June 2, 1987: 1. Resolution No. Calling and giving notice of the holding of a Special Election in the City of Moorpark on Tuesday, June 2, 1987. Staff Recommendation: Approve the resolution as presented. 2. Resolution No. _ Requesting the Board of Supervisors of Ventura County permit the County Clerk to render services to the City for the Special Election to be held June 2, 1987. Staff Recommendation: Approve the resolution as presented and instruct the City Clark to forward a copy of the resolution to the County Board of Supervisors for their approval. 10. COMMENTS FROM COUNCTLMEMBERS : A. Presentation by Councilmember Brown regarding the Bicentennial Ad Hoc Committee which was formed to celebrate the U.S. Constitution Bicentennial. B. Consideration of an interim appointment to the City Council. The appointment period would expire on June 2, 1987. 1 1 . STAFF REPORTS /RECOMMENDED ACTION TTEMS : A. Consider the City's Newsrack Ordinance regarding insurance requirements and current state of enforcement. Staff Recommendation: Uphold the requirement for insurance and receive and file the report. A report regarding eleven requests for General Plan Amendments in 1985, and the possible need to update the City's Land Use and Circulation Element. Staff Recommendation: Take action as deemed appropriate by Council. C. Consider the request of the Moorpark Historical Society to waive the development processing fees for a Conditional Use Permit (CUP) in the amount of $1,400. Staff Recommendation: Take action as deemed appropriate by the City Council. D. Proposed transfer of funding responsibility for the improvement of a portion of Tierra Rejada Road median north of Arroyo Simi and the traffic signal at Los Angeles Avenue, from Moorpark -Tierra Rejada Road Area of Contribution to Los Angeles Avenue Area of Contribution. Staff Recommendation: Approve the transfer of funding responsibility. E. Consideration of a time extension for the Cooperative Agreement between the City of Moorpark and CalTrans from June 1987 to December 1987 for the Princeton Avenue Traffic Signal. Staff Recommendation: Approve the extension, and authorize the Mayor to execute the extension on the City's behalf. F. Regarding the Los Angeles Avenue Widening Project, consideration of a one year time extension on the Los Angeles Avenue improvements relating to PM-3828. Staff Recommendation: Approve the time extension. G. Consider the acceptance of an access Easement Deed from West American Construc- tion Corporation in accordance with the condition of their approved project (DP-305). Staff Recommendation: Accept the 15' easement, and authorize the Mayor to execute the necessary documents on behalf of the City. H. Consider the acceptance of a Right -of -Way Dedication from Urban West for a portion of land between Mountain Trail and the bridge in conjunction with the Tierra Rejada Road work. Staff Recommendation: Accept the right-of-way dedication and authorize the Mayor to execute the necessary document(s) on behalf of the City. Consideration of a possible vehicle weight limit on Peach Hill Road in an effort to prevent construction traffic from traveling Peach Hill Road. Staff Recommendation: Approve the weight limitation of 3,000 pounds. J. Authorize staff and the Senior Citizens Ad Hoc Committee to proceed with the Senior Citizen Center Construction Project. Staff Recommendation: Staff and the Ad Hoc Committee are requesting Council approve the 'Gelco/Dial" approach. Request to send the Planning Commissioners to the Annual League of Califor- nia Cities 1987 Planning Commissioners Institute in Sacramento, March 11-13, 1987. Staff Recommendation: Take action as deemed appropriate by the Council. L. Consideration of a report from staff regarding research done on a computerized traffic model. Staff Recommendation: Instruct staff and Public Works Committee to terminate all activities associated with this matter. M. Consideration of Appeal No. 12, a request to appeal the Planning Commission's action on the approval of the wall plan for Tract No. 4037/RPD-1044 (Calprop). The applicant is appealing the decision of the Commission to require a wall height of six feet. Staff Recommendation: Council deny the appeal. N. Consideration of Planning Commission resolutions regarding the City's Land Use and Circulation Elements and traffic use. Staff Recommendation: Take action as deemed appropriate by the Council. 0. Consideration of a new liquor license being issued to Golden Crust Pizza. Staff Recommendation: Forward a letter to the Alcoholic Beverage Control outlining Council's concerns. P. Request by the Committee for Managed Growth to retain outside legal counsel for defense against the Building Industry Association suit. Staff Recommendation: Take action as deemed appropriate by the Council. O. Consideration of a vacancy on the Parks and Recreation Commission. Staff Recommendation: Take action as deemed appropriate by the Council. R. Further consideration of holding Town Hall Meeting(s) in the City of Moorpark. Staff Recommendation: Take action as deemed appropriate by the Council. S. Consider directing the City Attorney to initiate Eminent Domain proceedings for property needed for the extension of the Tierra Rejada Road, north of Arroyo Simi (Boething Family Trust). Staff Recommendation: Direct the City Attorney to take appropriate action. T. Consider approving an extension of the Observation Agreement for the Landscape Construction Contract for Peach Hill Park. Report by the City Engineer's office regarding slope failure concerns in Tract 4037 (Calprop) near Mr. Brodsky's property. B. Expense and Revenue Report for Fiscal Year 1986/87 covering the period of July to December. C. Report regarding a Special Use Permit that would be needed by Century 21, Valenza Realty, in order to conduct a 5K Run on April 5, 1987. D. Progress report on the implementation and phasing of the Freeway Call Box System for Ventura County. E. Presentation of the 1986 Annual Police Report, F. Traffic enforcement report for Peach Hill Road in the Marlborough Tract for January 1987. C. Addition of Urban West Tracts 3864, 3274 and 3855 to the existing street - sweeping agreement with Emard Power Sweeping. The 1986/87 Fiscal Budget anticipated the addition of these areas, and funds have already been appropriated. 13 . FUTURE AGENDA STEMS : 14 . CLOSED SESS SON : A.
