Knipe, Assistant City Engineer �- L % DATE: October 23, 1987 SUBJECT: Grading within Tract 3963 -2 (Griffin) to Construct Collins Drive BACKGROUND INFORMATION Tract 3963 is located in the northeast section of the City of Moorpark adjacent to Moorpark College. A location map is enclosed for your reference. The tentative map and development conditions for Tract 3963 were approved by the City Council on February 1986. On June 17, 1987, a major modification for this tract was approved. Conditions 2, 3, and 8 of this major modification deal with Collins Drive construction and grading restrictions. In order to comply with. the timing requirements found in conditions 2 and 3 of the major modification, the grading for Collins Drive must begin in the near future. The developer has submitted a proposed grading plan, copies of which are included with this report. As a minimum, the developer is required to grade Collins Drive and the adjacent slopes. The limits for this minimum grading would be approximately 15 feet outside the Collins Drive right -of -way, as shown on the attached grading plan. 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 Page -2- In order to collect the large amount of storm water directed toward Collins Drive from the north, the developer has submitted a grading plan requesting that a larger amount of grading be done north of Collins Drive than would be necessary under the minimum grading scheme. The limits of this expanded grading plan are shown in brown on the attached drawing. This proposed plan also includes the construction of permanent debris basins and storm drains north of Collins Drive. This expanded plan will: 1. Reduce the amount of storm water and debris in the immediate vicinity of Collins Drive. 2. Provide an efficient disposal of the storm water. 3. Not set final grade for either building pads or street elevations. Although the proposed grading scheme will result in a larger area being graded, it is felt that the proposed plan will better handle the storm flows from the north. RECOMMENDED ACTION Approve the expanded grading plan developer to allow for the grading increased drainage facilities, as drawing. JFK: CL: jg Encl. RPD -1041 AND TENTATIVE TRACT NO. 3963 ON THE APPLICATION OF GRIFFIN DEVELOPMENT COMPANY. WHEREAS, on February 18, 1986, the City Council the City of Moorpark adopted Resolution No. 86 -275 entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING THE LAND USE ELEMENT OF THE GENERAL PLAN OF SAID CITY BY APPROVING GENERAL PLAN AMENDMENT NO. GPA -85 -1; APPROVING TENTATIVE TRACT NO. TR -3963; AND APPROVING RESIDENTIAL PLANNED DEVELOPMENT PERMIT NO RPD -1041, ON THE APPLICATION OF GRIFFIN DEVELOPMENT COMPANY. WHEREAS, Griffin Development Company has submitted an application for a major modification to said Residential Planned Development Permit No. 1041 and Tentative Tract Map, designated as TR -3963 the subject property being located north of Penwood Drive and between Pecan Avenue and Collins Drive. WHEREAS, at duly noticed public hearings held on April 6, and April 20, 1987, the Planning Commission of the City of Moorpark considered said application for a major modification and said proposed Tentative Tract No. 3963, and by its Resolution No. PC -87 -134 recommended approval thereof, subject to certain conditions; and WHEREAS, on June 3, 1987 and June 10 , 1987, the City Council of said City held a duly noticed public hearing on said major modification application, and did also consider the recommendations of the Planning Commission in the matter; and WHEREAS, at said public hearing oral testimony was gi.ven regarding said application; and WHEREAS, the City Council is now full informed in the matter; has given careful consideration thereto; has determined that the-major modification requested do not necessitate the preparation of a subsequent environmental document because the modifications and revisions contained therein will not result in new significant environmental impacts; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA DOES RESOLVE AS FOLLOWS: SECTION 1. That the original findings contained in the staff reports dated October 10, and December 2, 1985, are hereby adopted, and said reports are incorporated herein by reference as though fully set forth. F SECTION 2. That insofar as the same pertain to this Major Modification application the amendments to Resolution No. 86 -275 attached as Exhibit "A ". SECTION 3. That in all other respects, Resolution No. 86 -275 shall remain in full force and effect. SECTION 4. That the major modification to Residential Planned Development No. 1041, and Tentative Tract No. 3963, are hereby conditionally approved, subject to compliance with all conditions attached hereto, and the City Council does hereby find, determine and resolve that violation of any such conditions shall be grounds for revocation of said permits. SECTION 5. That this resolution shall take effect immediately. SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution. PASSED AND ADOPTED this 17th day of June, 1987. .�� Mayor of the City of Moorpark, California APPROVED AND ADOPTED BY RESOLUTION NO. 87 -395 June 17, 1987 TRACT NO. 3963 and PLANNED DEVELOPMENT PERMIT NO. 1041 - Major Modification 1. Condition No. 58 of Resolution No. 86 -275 is amended to read: That Pecan Avenue from the southern tract boundary to Monroe Avenue (formerly "B" Street) and Monroe Avenue to Hearon Drive (formerly "C" Street) shall be constructed and open to the public no later than July 1. 1988. Prior to September 1, 1987, the developer shall construct a footpath from the present terminus of Pecan Avenue to the school site and a paved area at the west end of the improvements on Monroe Avenue to the satisfaction of the City Engineer anu miner+++ � UCUdr'l.rllCrlL. 2. Condition Nos. 38 and 60 of Resolution No. 86 -275 are amended to read that Collins Drive within the boundary of Tract No. 3963 shall be constructed to final grade and width pursuant to the approved plans and Ventura County Road Standards less the top one inch of pavement with the installation of approximately _30 feet of pavement extending from the east curb line and opened to the public no later than April 1, 1988. The full improvement of Collins Drive within Tract No. 3963 pursuant to the aforementioned Condition Nos. 38 and 60 is deferred until April 1, 1989 or one (1) year from the date of the awarding of the seventy (70) allocations under the City's Residential Development Management System, whichever occurs first. An extension up to 90 days may be approved by the City Manager based upon written documentation of circumstances beyond the control of the applicant. 3. The improvements to Collins Drive south of the southerly tract boundary pursuant to "c." and "d." of Condition No. 38 and Condition No. 60 of Resolution No. 86 -275 are hereby deferred until no later than July 1, 1988 4. Prior to September 10, 1987 Griffin Homes shall construct a sidewalk on the north side of Campus park Drive from the east side of the intersection with College View Avenue to Collins Drive along with any modifications of the existing curb and gutter as determined necessary by the City Engineer consistent with Ventura County Road Standards. 5. If within the next five (5) years (by October 1991) the Moorpark Unified School District or the City requests and City approves a crossing guard at either Collins Drive or College View Avenue at Campus Park Drive, Griffin - Homes shall deposit with the City the then estimated five (5) year cost of a crossing guard. 6. Within six (6) months after opening of Collins Drive with the partial improvement described in No. 2 above, Griffin Homes shall cause to be conducted a traffic signal warrant study pursuant to standards established by the City at the intersection of Collins Drive and Campus Park Drive. 7. The Campus Park Drive median strip, located between Julliard Street and approximately 200 feet east of Marquette Street shall be -landscapesL and irrigated consistent with the median strip completed on Campus Park Drive between Collins Drive and the east boundary of Tract No. 2851. Areas of the median 3 -feet wide and less to a transition not to exceed 5 -feet shall be paved with terra cotta color stamped concrete. The balance of the areas within the median strip shall receive ground cover and trees in the same proportional quantities and species as presently contained in the completed area cited above. ADOPTED AND APPROVED BY RESOLUTION NO. 87 -395 June 17, 1987 TRACT NO. 3963 and PLANNED DEVELOPMENT PERMIT NO. 1041 - Major Modification 7. (continued) Irrigation controller shall be electrically operated and located in the median at a location convenient to the power source. Before installation the City shall consider approval of the proposed landscape and irrigation plans. Said improvements shall be installed no later than July 1, 1988. The City shall begin and be perpetually responsible for all required maintenance of the median strip landscaping provided for herein upon the expiration of one year following acceptance of the work by the City, which acceptance shall not be unreasonably withheld. The parties may mutually agree to turn the maintenance responsibility over to the City upon the payment of a mutually agreed upon amount by Griffin to the City for a one (1) year maintenance period. 8. Grading in Phase II and III of Tract 3963 shall be approved by the City Engineer provided that: a Said grading is consistent with the conceptual grading plan previously approved with the tentative tract map approval. The extent of such grading is determined, by the City Engineer and Director of Community Development, in writing, to be consistent with the purpose and intent of Measure F as follows: - Protects open space; - Does not to overtax any existing public facility. - Preserves the semi rural quality and character of the area. - Does not cause a deleterious impact on the physical and /or aesthetic environment. - Keeps man -made slopes to a minimum and where required shall be heavily contoured. Cutting or intrusion into natural areas shall be kept to an absolute minimum. C. Only those building pad(s), as determined by the City Engineer, as necessary to construct Pecan Avenue, Monroe Avenue and Collins Drive shall be permitted. Any borrowed site used for said construction shall be left with natural contours and seeded with California native grass after removal of sufficient soil to construct Pecan Avenue, Monroe Avenue and Collins Drive. d. Any building pads created by "c." above shall not be certified until which time a residential permit allocation has been awarded for such building pad(s). 0 STATE OF CALIFORNIA ) COUNTY OF VENTURA ) SS.
