Richards, Director of Community Development' DATE : February 25, 1987 (CC meeting of 3/4/87) SUBJECT : REVISION TO GRADING PLAN TRACTS 4170/3070 -4 U.S. CONDOMIMIUM CORPORATION BACKGROUND This matter has been continued twice since February 4, 1987 at the applicants request. To date no new information has been submitted or reviewed by staff. In an effort to communicate with the applicant staff made a contact on February 24th and was advised that U.S. Condominium was was still working out details to resolve the matter. RECOMMENDATION 1. Hold the public hearing on this matter and receive testimony from the public and applicant. 2. Uphold or reject the recommendation of the Planning Commission. We believe we have come up with a solution that will allow us to complete the grading pursuant to the approved plans. Thus, we would expect that we will be rescheduled for the next City Council meeting which will occur on Wednesday, March 18, 1987. We will keep you posted as to our progress on resolving this issue. Condominium Corporation to amend their grading plan for Tracts 4170/3070 -4 on November 17, 1986. At that time the City council referred the matter to the Planning commission so that they could review the various issues at a public hearing. The original proposal submitted to the Council included extensive fill along Campus Park Drive and the raising of pads as much as five feet. Since the November 17th council meeting, U.S. Condominium has been working with staff to revise their proposal to be more consistent with the original plan. The current request is to relocate 10.3,000 cubic yards within and adjacent to the subje`t site. 'A majotity, 69,000 cubic yards, will be relocated into County land to the north,which is ofd site. There are three areas in the County which are currently ravines extending in a north -south direction. These fill areas will be contour graded so as to reduce the impact of man made slopes. After filling these areas they will be planted with orchard trees as is presently existing north of the site. The revised grading plan will raise the pad of three feet. The Planning Commission reviewed the revised grading plan at their January 19, 1987 meeting. A-public hearing was conducted but no one spoke on this matter other than a representative of U.S. Condominium. The Planning Commission recommended that the City Council deny the request to modify the grading plan. Their reason was centered around the following: 1. The City is under no responsibility to resolve an error made by the developer. 2. The developer should adhere to the original grading plan without modification. 3. There is no benefit to the City in approving the modification. 4. The proposed plan would impact the canyon adjacent to Happy Camp Park. RECOMMENDATION 1. Hold the public hearing on this matter and receive testimony from the public and applicant. 2. Uphold or reject the recommendation of the Planning Commission. Attachment: Revised Grading Plan. Richards, Director of Community Development D AT E = January 13, 1987 S U B J E C T : TRACTS 3070 -4 and 4170 (U.S. CONDOMINIUM CORPORATION) - REQUEST TO REVISE GRADING PLAN R A rVCRn1Twn Pursuant to the City Council policy regarding changes to approved grading plans (see Exhibit A, item 3), the attached (Exhibit B) request is being transmitted to the Planning Commission for its review prior to consideration by the City Council. The request is to distribute approximately 103,000 cubic yards within or adjacent to the site. The applicant has provided a grading plan with the revisions shown in red. The original pad elevations are shown in a box within each lot. Their proposed revisions are indicated below each box. An area to the north of the project site will receive most of the surplus dirt. This area is located in the County. One receiver area is within the project site. None of the receiver areas are near existing developed areas, including the pads proposed to be raised. The benefit of this proposal of dealing with the surplus dirt is that no export of dirt would be required from the site, and no truck traffic would be generated on City streets. The City Engineer has also addressed this request (see Exhibit C). RECOMMENDED ACTION Recommended that the requested grading plan revision be approved by the City Council. The projects have been graded simultaneously to ensure a balance of dirt. As we have come to the end of the fob a grading surplus has occured. We have strived to come up with a plan for relocating the excess dirt (approximately 103,000 yards), which will result in the least impact on the project and surrounding neighborhoods. Our original proposal, presented to the City Council, required constructing new slopes and raising pads up to five (5) feet. The impact of this plan was considered too dramatic. Subsequently, we have completely redesigned this relocating plan, which significantly decreases the impact of the work -. - To this end, we are proposing that the excess dirt be placed in the following manner. 1. Approximately 69,000 yds of dirt will be relocated into county land in three (3) areas, which are contiguous to our current project. The dirt will be placed in these pockets, utilizing undulating slopes to minimize any impact. The three (3) pockets are all located on County of Ventura property and have been tentatively approved by the County, contingent upon the City of Moorpark approval. The most significant of the three (3) pocket locations in the County is in one of the more desireable areas per the Moorpark City Council. 2. Of the 156 lots in the two phases 34, will be raised a maximum of 3 ft. 3. With the approval of this new plan, it is the intent that there should be no export of dirt. GENOVESE City Treasurer MEMORANDUM TO: Pat Richards, Community Development D 7,t FROM: John Knipe, Assistant City Engineer DATE: January .12 , 1987 SUBJECT: Revised Grading for Tract 4.170 In reviewing the recent submittal of the subject revised grading plan, it is our understanding that the developer plans to utilize four different areas to., dispose of approximately 100,200 cubic yards of excess dirt. It is our understanding that the first area is located in lots 30 through 66 and would be raised approximately two to three feet. This would dispose of approximately 32,000 cubic yards. - The second through fourth areas are off -site fill areas north of the project, outside of the City limits. The three sites, consisting of 68,200 cubic yards are within the County of Ventura's jurisdiction and will require a separate grading permit from the County. Comments on the eastern most fill site were sent to the developer after receiving this submittal on December 29, 1986 asking that they contour grade the fill. area more to match with existing ground contours. As of this date we have not received a response to our request. In concept, we have no problem with what they have shown on the marked up bluel ines that were submitted to our office, except for the previously mentioned area which needed contour grading. EXHIBIT "C" 799 Moorpark Avenue Moorpark, Califomia 93021 (805) 529 -6864 Page -2- Because the developer is planning on raising a number of lots more than two feet from the original elevation shown on the tentative map, it will be necessary to obtain approval from the City Council prior to the approval of this plan (per the recently adopted City Council Grading Policy).
