Mr. Brodsky's concerns are expressed in his letter dated January 11, 1987 (attached as Exhibit "A ") . The main question is whether or not the slope to the rear of Mr. Brodsky' s residence was undercut by the grading operations. Attached is a copy of an August 8, 1986 letter (Exhibit "B ") from Gorian and Associates, the Soils and Foundation Engineers on the project. In summary, this letter discusses the preexisting situation of the slope in question. RECOMMENDED ACTION This material is presented for your information only and requires no action. Richards Director of Community Development 799 Moorpark Avenue Moorpark, Ca. 93021 Dear Mr. Richards: Per your request, this is a written follow -up of our conversations of January 5 and 6, 1987. The neighbors of Vista Del Valle Drive were notified as to Calprop's intention to fill in a drainage ditch behind our homes. Mr. Brown told us that if they ( Calprop) could fill in this ditch, they would give us 15 feet of land. Upon further examination, we discovered this extra 15 feet was really our property and certain simple questions posed to Calprop could not be answered, such as: 1. On whose property would the drainage ditch be? 2. What kind of fence or wall would be built and on whose property would it be located? 3. Would they extend our side fences to meet the new fence or wall? 4. Would the flow of drainage water from one yard drain across another? Neither Calprop or the prior Director of Community Development would answer these questions so the neighbors and I had no choice but to deny Calprop's proposal. By October 1986 we noticed Calprop had completed their drainage ditch but in doing so had cut away approximately three feet of our back bank to do the construction. We notified Calprop about this and their reply was that their engineers indicated to them that our slopes were greater than 1:1 and that they did not touch our land. In mid - November I made it known to City officials that I was concerned that our land would fall where Calprop had cut away our bank, and I was assured that the matter would be looked into. It never was. During the rains of November 1986 approximately 3/4 of an inch of rain fell and so did approximately one foot of my slope. During the rains of January 3 and 4 another three - four inches of additional soil loosened and began to break away. cfv uiovr 9 A 1 I understand that Calprop still claims that they did not touch our land. If this is true, then: 1. Why is approximately four feet of my land missing? 2. Why is my land now a vertical cliff? 3. Why are tree and plant roots exposed? 4. 'Why are there tractor cut marks on the soil that's left? S. How could the land survive seven years of exposed environment without any problems and since the creation of the ditch over a foot of land fall? I'm sure the Planning Commission realizes that the law is clear that if anyone creates a situation which causes an adjoining property to be unstable they are responsible to repair the damage. To rebut Calprop's accusation as to our land already being a greater than 1:1, a 1:1 slope is a 45° angle. Even a 46° or 47° angle is still not vertical. If this condition is allowed to continue any longer, my yard and the yards of my neighbors will be destroyed by the end of the rainy season. We need strong, high retaining walls to prevent this. Dear Susanne: This report addresses stockpiled fill soils and an existing off -site east facing ti slope along the western tract boundary. The area of concern was visually inspected by a soil engineer from this office on August 6, 1986. STOCKPILED FILLS A concrete lined 'Y' ditch was recently constructed along the westearn tract boundary behind Lots 43 to 45. During that construction, soils excavated from the ditch excavation were temporarily stockpiled on the west side of the ditch. The stock- piled soils have since been removed, based on a visual inspection of the area. Existing Off -Site Slope Along the west side of the prevously described 'Y' ditch, an ascending slope is present off -.site of Tract 4037. The lower 2 to 4 feet of this slope along the.toe is presently oversteepened to an approximate 1:1 gradient. It appears that.the slope was not maintained pro- perly and an improper-drainage condition exists on.the slope face. The exposed slope surface soils-are weathered to approximate depths of at least 18 inches. If the slope is, 1 eft. i n the present condition, i t . i s anticipated that continued erosion and or slumping will occur. There is always the risk that deeper slope failures could occur if the slope surface is not maintained properly. Continued erosion of this slope could cause slough to be deposited in the "V" ditch causing additional maintenance of:the area. The oversteepened slope condition could be corrected by laying back the slope '.ace to a uniform gradient of 2:1 or less. As an alternative, the slope could be reconstructed in accordance with the City of 1,11oorpark and County of Ventura grading standards. Please call if you have any questions.
