Dennis Delzeit, City Engineer�1� DATE: April 8, 1987 SUBJECT: Issuance of Encroachment Permit For Tract 4037 (Calprop) BACKGROUND INFORMATION Currently Calprop does not have an encroachment permit for construction work in Moorpark Road adjacent to Tract 4037. Their previous encroachment permit was revoked due to the excessive length of time that traffic has been interrupted on Moorpark Road. As previously reported to the City Council, a new encroachment permit is not to be issued to Calprop until they have coordinated all remaining work to be done along Moorpark Road with the various affected agencies (including the City) and submitted a construction schedule for this remaining work to the City Engineer. The purpose of these requirements is to insure that the remaining work is properly coordinated and to minimize the interruption of traffic along Moorpark Road. A construction schedule for the remaining work along Moorpark Road has been submitted to the City Engineer by Calprop (copy attached). This schedule calls for a total construction time of 17 days, with no work to be performed on Monday and Friday due to high traffic volumes. The City Engineer feels that this estimated time of completion is excessive, and is still attempting to work with the developer's contractor to shorten the construction time. woo 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 Page -2- The new encroachment permit will contain the following: 1. A specified construction time period with time extensions allowed only for inclement weather. 2. A traffic control plan to be followed for work within the roadway. 3. A specific daily work period (8 :30 a.m. - 4 :00 p.m.) to avoid work in the roadway during peak traffic periods. 4. If the encroachment permit expires, any request for a new encroachment permit will be brought back to the Council. 5. Overlay. It has also been noted that the asphalt pavement patch for the underground utility trenches along Moorpark Road is inadequate. These trenches are located on the east side of the roadway and affect the entire driving surface of the northbound lane. Therefore, due to the poor condition of these trenches and the affect on the northbound travel lane, it is recommended that Calprop overlay Moorpark Road in the sections shown on the attached Exhibit. 6. New Striping The chevron striping in front of the church at the northeast corner of Peach Hill and Moorpark Roads has been extensively damaged by the storage of base and asphalt and related construction activity. Calprop should be required to restripe this area. Page -3- RECOMMENDED ACTION Authorize the City Engineer to issue an encroachment permit to Calprop for work along Moorpark Road, subject to the conditions stated above. Authorize the City Engineer to work with the developer's contractor to shorten the remaining construction time on Moorpark Road. Start sewer pipe attachment to bridge 5 days Ongoing sewer manholes in street 6 days - Prep work for hot mix and hot mix cuts in street, hy- hammer for 95% compaction, raise four (4 ) remaining sewer manholes to grade 5 days - Final tie -in concret. to encased sewer pipe to North manhole in street 1 day - Estimated time to complete project - not to include Mondays and Fridays due to severe traffic, inclement weather and sewer testing 17 days As we've discussed, our intention is to complete the work as quickly as possible. As Mr. Knipe explained, the City of Moorpark has decided to require Calprop Corporation to pave a portion of Moorpark Road as a new condition to the encroachment permit. You are aware that an encroachment permit was first issued in September, 1986 for Calprop's approved work in Moorpark Road. Recently the permit was revoked by the City Engineer. Prior to the issuance of a new encroach- ment permit, however, the City Engineer has made it clear to Calprop that as a new condition to this encroachment permit, Moorpark Road will be paved. We are very concerned that the tract conditions for this development did not address this newly- imposed condition. It is only now, mid - stream in progress of our tract that we are required to make additional improvements along Moorpark Road. In addition to the expense of approximately $50,000 to complete this work, we are not the only developer /body to disrupt the existing road. It is pointless to explain how many other neighborhood developments have accessed their property via Moorpark Road. We have already agreed to and constructed improvements along Peach Hill Road which were, again, not delineated in the Tract Conditions. More specifically, we cooperated with the City's request to make these improvements subsequent to our approved plans. To force Calprop to improve this heavily traveled thoroughfare individually, when clearly we are not the exclusive user of the road, is unreasonable. If Moorpark Road is to be widened in a short time, it is difficult to perceive that we have done any appreciable damage to warrant such a major improvement at this time. Finally, we object to a condition to repave Moorpark Road as you've requested, but we would consider paying a reasonable sum toward future improvement of Moorpark Road. Dear Mr. Delzeit : Pursuant to my conversation with John Knipe whereby he explained the City's revised request of Calprop regarding the new condition to the encroachment permit, we have considered this request and have continued concerns. Our understanding of the new request is for Calprop to pave the eastern half of Moorpark Road between the most northerly located manhole and the manhole at the bridge. Due to the amount of cut required into the existing overlay in order to allow feathering of the new layer of asphalt, the cost element remains extensive. As discussed previously, we have already constructed improvements along Peach Hill Road which were not included in our tract conditions. This additional improvement amounted to approximately $6,000. Additionally, we remain only one of the many who have accessed their property via Moorpark Road, and still maintain that this request to force Calprop to improve this heavily traveled thoroughfare individually is unreasonable. Again, I ask you to reconsider your request in light of the fact that tMoorpark Road is scheduled for improvement within the next two years. We still object to this new condition for the above - stated reasons and are willing to consider contributing reasonably toward the improvement of Moorpark Road.
