Pacifica Reimbursement Agreement

Because Tract 2865 (Pacifica and Pardee) was approved by the
County before the Area of Contribution was established and
before it was policy to require full width improvements,
neither Pacifica nor Pardee were originally conditioned to
construct full paving and raised medians along Tierra Rejada
Road. As a result, the City entered into an agreement with
the Pacifica Corporation (see attached January 21, 1987
staff report) to reimburse Pacifica for construction of the
ultimate paving and raised medians. The source of the
funding will be a Lighting and Landscaping District
additional assessment for Tract 2865.
For reasons similar to those relating to the ultimate
paving, Tract 2865 was not conditioned to construct slough
walls adjacent to sidewalks. It is now standard policy to
condition a development to construct slough walls where
necessary. Accordingly, Pardee has been required to
construct slough walls along the southside of Tierra Rejada
Road in conjunction with its PD -851 Major Modification
(condition No. 14).
In consideration of the above information, it may now be
appropriate for the Council to approve the concept of
reimbursing Pacifica for construction of slough walls along
the south side of Tierra Rejada Road within Pacifica's
section of Tract 2865. If approved by the Council, it is

expected that the developer would immediately proceed with
construction of the slough walls. The very preliminary cost
estimate for construction of the slough walls is $42,000.
This amount would be added to the previous total
reimbursement amount of $27,834, all of which would be
funded from the Tract 2865 Lighting and Landscaping District
additional assessment.
RECOMMENDED ACTION
1. Approve the concept of reimbursing the Pacifica
Corporation for construction of slough walls along the
south side of Tierra Rejada Road within Pacifica's
section of Tract 2865 -4, 5, 6, 7.
2. Direct staff to negotiate with the Pacifica Corporation
to establish a mutually agreeable reimbursement amount
for construction of the slough walls.
