SUB.TECT : TRACT WALL /FENCE PLAN - FRONT ELEVATION WALLS
At issue is whether or not Calprop received approval to
install wrought iron fencing at slopes along the front
elevations of lots.
The City Council considered an appeal of the Planning Commission
decision from Calprop at their meeting of March 4, 1987. At
that time, Calprop was appealing the Planning Commission decision
to require all walls and wrought iron fences to be six (6)
feet in height; walls to be built along the front elevations,
in lieu of wood fences,and the use of slumpstone on up- slopes
at rear yards,in lieu of wrought iron fences.
It is staff's opinion that the Council only addressed two of
the three requests made by Calprop at the March 4, 1987 meetinb.
In not taking any specific action on the front elevation issue,
the Planning Commission's decision to require slumpstone walls
remained.
Attached is a copy of the March 4, 1987 minutes and several
letters from City staff and Calprop regarding the matter.
RECOMMENDATION
Uphold the action of the Director of Community Development and
require the use of slumpstone walls on slopes at front elevations.

AT THIS POINT IN THE MEETING, it was the concurrence of Council to reorder the
agenda. The following items were heard with the remaining items continued to
March 11, 1987.
10. COMMENTS FROM COUNCILMEMBERS:
10.A. Councilmember Brown gave a brief report concerning bicentennial
activities and requested that Council appoint a Bicentennial
Committee. She also asked if it was possible to publish the Planning
Commission agenda any sooner, and commented on the lack of bus benches
available for public use.
10.C. By consensus the Council appointed Councilmembers Brown and Perez and
the City Manager to an ad hoc committee to review the Rules of
Procedure for City Council Meetings.
10.0 -1. Mr. Joseph Latunski, 289 Casey Road, asked that the Council not limit
citizen's access to speak at Council Meetings.
AT THIS POINT the Council recessed, the time being 12:20 a.m. The full
Council reconvened at 12:30 a.m.
11. STAFF REPORTS /RECOMMENDED ACTION ITEMS:
11.A. Consideration of Appeal No. 12, a request to appeal the Planning
Commission's action on the approval of the wall plan for Tract No.
4037 /RPD -1044 ( Calprop). The applicant is appealing the decision of
the Commission to require a wall height of six feet. Staff's
Recommendation was for Council to deny the appeal.
Mike Rubin gave the staff report.
11.A -1. Robin N. Stone, 5456 McConnell, Los Angeles, representing Calprop
Corporation, asked the Council to uphold their appeal.
11.A -2. Steven Brodsky, 4572 Vista Del Valle, supported the Planning
Commission's decision, urged the Council to deny the appeal, and also
asked for a solid plaster or block perimeter wall at the project site,
not wrought iron fencing.
Councilmember Perez voiced his support of the Planning Commission's
decision. Mayor Harper felt the 6' height was preferred, and felt
wrought iron fencing could be used between the houses.
MOTION: Councilmember Perez moved to uphold the Planning
Commission's action pertaining to all requests of the applicant. The
motion failed for lack of a second.
MOTION: Councilmember Galloway moved and Councilmember Ferguson
seconded a motion to allow a wall height of 5', and to permit wrought
iron fencing on upslope portions of side yard fencing rather than
continuous use of slumpstone block. The motion was approved with
Councilmember Perez and Mayor Harper voting no. Mayor Harper
commented he could not support the 5' wall height.

RE: PLANNED DEVELOPMENT 1044 - Wall /Fence Plan
In response to your May 7, 1987 letter; please be advised that your review of
the recorded meeting on March 4, 1987 centered on a discussion dealing with
the use of wrought iron fence on an up slope at the rear of a property not
the wall between homes at the front of the lots. The City Council took no
action regarding your interest to change from block wall to wooden fence or
wrought iron along the front of the lots. (Please refer to my April 7, 1987
letter to you on this subject.)
Once again I am telling you not to consider any other material between houses
at the front other than slumpstone block. Until directed by the City Council
I will continue to advise you to meet the conditions of approval and adhere to
the approved fence /wall plan.

In response to your April 3, 1987 letter regarding the action of the City
Council on March 24, 1987, please be advised that the Council took action to
grant your appeal on two issues (height of walls and iron fence on side yard
up slopes at the rear). They did not want to take any action to allow the
use of wrought iron across the front elevations. No action by the Council
is a denial of that portion of your appeal.
Do not construct any product material other than the approved block wall
along the front elevations within the project.

Re: PD -1044 - Wall /Fencing Plan Appeal
Dear Mr. Rubin:
With reference to your letter dated March 24, 1987 whereby you summarized
the City Council's action on our above - referenced appeal, you accurately
addressed the approval of our overall height as well as the use of wrought
iron up the sideyard slopes. The additional approval received by the
Council which was not addressed in your letter, however, involves the use
of wrought iron fencing along the front elevations of the houses. This
third issue was also addressed at the Council meeting and acted on by the
Council with an approval for its use.
Concerning the slough wall along Moorpark Road and with reference to
tract condition No. 16, the wall is presently being erected as agreed to.
Should you have any additional comments concerning this matter, please
feel free to call me.
