GENOVESE City Treasurer At the City Council meeting of September 16, 1987, a letter from Mike and Jo Krasowski was read to the City Council detailing problems they were having with work being done by Warmington Homes as a part of Tract 3525. A copy of this letter is enclosed for your reference. Additional concerns were also expressed at this meeting by Mr. and Mrs. Richard Deas due to similar problems along Williams Ranch Road. The City Council then directed the City Engineer to investigate these problems and report back to the Council. Since this meeting, the public works observer has been in contact with each homeowner to further review their concerns. Also, Mr. Mike Walline of Warmington Homes was contacted c kerning these problems. Based on our review, it appears that, with one exception, the complaints concern items entirely on private property that originate from construction work performed on the property. This work was performed per a private agreement between the homeowner and Warmington Homes. Also, based on the attached letters, these concerns are being addressed by Warmington Homes. -- RECEIVED OCT 1 1987 CITY OF MOORPARK 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 Page -2- The one concern not on private property is the reconstruction of a driveway apron to the Deas' property. This matter is also addressed in the attached letter. These letters do not address the homeowner's concerns regarding the private storm drain through the rear yards of the existing six homes along Williams Ranch Road. This storm drain is private and has been installed and inspected per City Standards. Once the subdivision improvements are accepted by the City, the drains become the responsibility of the homeowners. Until that time, the storm drain is guaranteed by the bonds put up by Warmington Homes, with maintenance responsibilities remaining with Warmington. As far as the adequacy of the pipe to handle expected flows, the Hydraulic Report submitted by the developer's engineer indicates that the ten inch PVC pipe will handle the expected flows from the six yards. The Krasowski's letter also mentions a warning of non - compliance from the Waterworks District because their water meter is located behind a sixteen inch retaining wall. The wall was installed by Warmington, and Mike Walline indicated Warmington will remove the wall if required to remove the non - compliance warning. However, the homeowners along Williams Ranch Road are attempting to deal with the Waterworks District to allow their water meters to remain behind the sixteen inch wall. You agree to install your own drive, due to deviation from existing location. 2) You will agree to execute all documents pertaining to Lot Line Adjustment with boundrys as per revised Legal Description of Aug. 7, 1987. 3) No additional landscape, handscape or fencing shall be done on your lot in return for drive compensation. 4) Private drain in rear and side of your lot will be flushed and checked for any damage that may have occured during construction. Brick cap atop slough wall in front yard shall have corner brick removed and replaced with a mitre. 2.) Sod that was replaced at center of circular drive shall be removed and replaced with new material. 3.) Block Wall running parallel with side property line on the eastern portion of the property which is a length of approximately 20 to 25 feet perpendicular to the rear wall and ending with a 12" X 12" column shall be repaired, as minor damage has resulted from settlement. 4.) An illegal electrical line running from the pool equipment to a utility building in the rear yard was damaged during construction; this line will be abandoned and a new line will be installed per City of Moorpark applicable codes to and from the locations presently serviced. All of these items shall be completed in a timely manner, with completion of all anticipated by Sept. 25, 1987, barring any unforeseen delays from permit acquisition or any other acts uncontrollable by Warmington Homes. I am here tonight to make you aware of the concerns we have regarding work done on our property by Warmington Homes. We have been involved in numerous projects with Warmington regarding our property and have encountered problems with ever;" single one. These include: 1. Front yard landscaping and brickwork which has been redone several times and is still not satisfactory. 2. A grading problem in a neighbors ,yard which creates water pooling in our .yard. This appears to be damaging the wall installed by Warmington. 3. Portions of wire reinforced driveway removed and repoured without wire reinforcement. 4. Damage to underground electrical wire when workers misread plans and dug in the wrong places. We feel all of these problems are a result of negligence, incompetence and poor supervision by Warmington and their subcontractors. Also, all of these problems have been brought to the attention of several people at Warmington and have not as yet been resolved. With all of our experiences with this company we are very reluctant to accept responsibility for the drain installed in our backyard. I think it is important to note how mutt-, we will depend on this drain as our entire lot drains to the back. During heavy rains in February 1980 our house did flood - this is an experience that uie do not wish to repeat. Therefore, the homeowners on Williams Ranch Road would like to know exactly when Warmington's responsibility concerning this drain ends. Will there be any guarantee in the years ahead? If heavy rains occur, will this drain be able to handle the runoff for the 6 homes involved? RECEIVE D SEP 1.111987 WILLDAN ASSOCIATES VENTURA September 16, 1957 Moorpark City Council Page TWO Another interesting problem we have encountered is receiving a citation of non — compliance from the Public Works agency of Ventura County. The way we understand this is the PWA moved our water meter several months ago approximately 1 1/2 to 2 feet back on our property to comply with a planned 4 foot sidewalk. A 3 foot sidewalk was then installed leaving the meter box in the lawn portion of the yard. A 16 inch retaining wall was installed to rectify differences in height between the existing yard and the new lower sidewalk and street. The PWA then issued a citation of non — compliance to us for possible damage to the wall while servicing the meter. I might also note the inspector who issued the citation, Ken Shanes, was seen on sight at least 3 to 4 times a week by ourselves and neighbors and never mentioned a problem to Warmington or ourselves until the citation was received. As I said before, our main concern in bring here tonight i= to establish the need for Warmington to accept the responsibility of maintaining this drain until we can be assured that it is working properly. I mentioned the other incidents to give you insight to our frustration in dealing with this company and our lack of confidence in this project. Thank you for your attention.
