GENOVESE City Treasurer SUBJECT: PLANNED DEVELOPMENT PERMIT NO. 1051 - MINOR MODIFICATION (LINCOLN PROPERTY) BACKGROUND This 136 unit apartment project was approved by the City Council on June 16,1987 per Resolution No. 86 -317. Various conditions of approval were imposed upon the project under the resolution. DISCUSSION During the project review for occupancy clearance it was noted that some adjustments had been made in the actual construction. The project was required to construct a 3,000 square foot tot -lot where they now have a 2000 square foot area. Also, the barbeque were to be gas in lieu of the currently installed briquette type. Finally, the language of the conditions is unclear whether a paddle tennis court and tennis court were required. At this time only a tennis court exists. This memorandum is being forwarded to Council so as to advise you of the Director's intentions of approving a minor modification regarding the following: 1. Approve a reduction in the Tot Lot area; 2. Approve the use of briquette barbeques; 3. The expansion of the Tot lot does not appear necessary as the 2000 sq.ft. area supplies sufficient space to perform the desired function. 2. Barbeques using gas are a potential hazard unless locked. Locking is an inconvenience and long term maintenance problem. 3. A paddle tennis court may not be necessary inasmuch as a tennis and basketball court are provided on the site. RECOMMENDATION Staff recommends concurrence with the Director's determination to approve the minor modification request. If the Council concurs, no action is necessary on the part of the Council. Should the Council determine that this matter is significant, past policy has been to allow the Council to set this item for a public hearing. cc: Steven Kueny, City Manager MOORPARK, CALIFORNIA City Council of Meeting ` 7 -198_2 ACTION: t By o It PD1051 /CHRONI July 8, 1987 Mr. Pat Richards Director of Community Development City of Moorpark 799 Moorpark Avenue Moorpark, California 93021 RE: Request for Minor Modification PD -1051 Dear Pat: Enclosed please find an application for a minor modification to our Plan Development Permit 1051 and a check for $368.00. In reviewing the conditions of approval for our 136 unit apartment project on Moorpark Road, I am requesting minor modifications with respect to three items: 1. Permission to maintain briquette barbecues instead of gas barbecues. 2. Permission to maintain a a tot lot with an area less than the 3,000 square feet size specified in the conditions of approval. 3. Elimination of the paddle tennis requirement cited in Planning Department 23.A. Although the paddle tennis issue has not been discussed by either of us, I cannot recall the Parks and Recreation Department requesting a paddle tennis court, nor !incoln showihr. this feature . in its project at any time during its presentations to the City. As you will note, the Park and Recreation Department's conditions do not make reference to paddle tennis. With this letter, I am also agreeing with the City of Moorpark to install a wrought iron fence along the southern boundary of our property to a height of not less than six feet above the finish grade where and if practical and feasible. This wrought iron fence will be installed with the understanding that minor modifications requested will be granted by the City of Moorpark and will not be successfully appealed. I am currently working with a wrought iron fencing subcontractor and our structural engineer to determine what will be required to install a wrought iron fence along our southern boundary. I am also working with the Park Springs Homeowners Association in an attempt to secure their approval for this fence. --� 1,1nca1.n PwaPeAry camvaay 31 O NO. WESTLAKE BLVD- SUITE 200 WESTLAKE VILLAGE, CA 91362 (E305)373-0755 Mr. Pat Richards July 8, 1987 Page Two With regards to our fire entry and the availability of turf block as a base material, Jerry Dehrer, Lincoln's Vice President of Construction, spoke with Kevin Nester, a Fire Marshall with the Ventura County Fire Protection District (805- 388 - 4280), and was told that turf block is not an acceptable base material for an emergency access.
