SUBJECT: Williams Ranch Road Sidewalk Widths
BACKGROUND INFORMATION
At the City Council meeting of October 7, 1987, an item was
brought before the Council regarding driveway ingress /egress
along Williams Ranch Road. During the discussion of this
item, a question arose as to how the three foot sidewalk
width was determined and whether this sidewalk width was to
be installed in front of all six existing homes.
City Engineer Condition Number 38 (attached) for Tract 3525
indicates that the 3 foot sidewalk will be constructed in
front of the existing six homes with a 5 foot sidewalk in
front of the remaining lots on Williams Ranch Road.
According to City Engineer records and City Council meeting
minutes (attached), the street and sidewalk design for
Williams Ranch Road in front of the existing homes was the
subject of much discussion. The discussion centered around
providing a safe street for traffic and pedestrians without
unduly encroaching on the front yards of the existing homes.
The City Engineer's recommendation to the Council was for a
40 foot pavement width since Williams Ranch Road is a
collector street. In order to reduce encroachment to the
six existing homes, only a 5 foot sidewalk adjacent to curb
was also proposed along the existing homes without a parkway
area.
In Council action taken on September 16, 1986, in response
to requests of the six existing homeowners, the width of the
sidewalk was modified to be 3 feet in front of the existing
homes and 5 feet wide in front of new construction.

There is no record of consideration given to installing the
3 foot wide sidewalk in front of only the eastern five
existing homes and a 5 foot sidewalk in front of the sixth
home on the western end, as stated by the Deas'.
RECOMMENDED ACTION
It is recommended that the City Council receive and file
this report.

RESOLUTION NO. 85- 224
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, APPROVING TENTATIVE TRACT
NO. TR -3525 AND RESIDENTIAL PLANNED DEVELOPMENT
PERMIT NO. RPD -941, ON APPLICATION OF WARMINGTON
HOMES.
WEREAS, at duly noticed public hearings on June 27, July 11, July 25,
August 8, August 15 and August 29, 1985, the Moorpark Planning Commission
considered the application of Warming-ton Homes for approval of Tentative
Tract No. TR -3525 for a 28.9 acre subdivision containing 87 single family lots,
and approval of Residential Planned Development Permit No. RPD -941, for 87
homes and recreational facilities, located adjacent to and south of Williams Ranch
Road ( Peach Hill Road) and west of and adjacent to Peach Hill Road; and
WHEREAS, after careful consideration, the Planning Commission reached
its decision in the matter and adopted its Resolution No. PC- 85 -51, recommending
approval of Tentative Tract No. TR -3525, and Resolution No. P:C- 85 -52, recommending
approval of Residential Planned Development Permit No. RPD -941; and
WHEREAS, public notice having been given in time, form and manner as
required by law, the City Council of the City of Moorpark has held a public
hearing, has received testimony regarding said project, has duly considered said
proposed project, and has reached its decision; and
WHEREAS, the City Council, after careful review and consideration,
has determined that the proposed project will not have a significant effect on the
environment, has reviewed and considered the information contained in the Mitigated .
Negative Declaration, and has approved the Mitigated Negative Declaration as having
been completed in compliance with CEQA and the State CEQA Guidelines issued
thereunder;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That the findings contained in the , staff report dated
August 29, 1985, are hereby adopted, and said report is incorporated herein by
reference as though fully set forth.
SECTION 2. The City Council hereby conditionally approves Tentative
Tract No. TR -3525 and Residential Planned Development Permit No. RPD -941,
subject to compliance with all the conditions attached hereto, and does hereby
find, determine and resolve that violation of any such conditions shall be grounds
for revocation of said permits.
SECTION 3. That this resolution shall take effect immediately.

SECTION 4. That the City Clerk shall certify to the passage and
adoption of this resolution.

CITY ENGINEER CONDITIONS
35. That prior to recordation of each Phase, the developer shall
submit to the City of Moorpark, for review and approval, a
grading plan prepared by a Registered Civil Engineer; shall
obtain a Grading Permit; and shall past sufficient surety
guaranteeing completion.
36. That prior to recordation, the developer shall submit to the
City of Moorpark, for review and approval, a Final Geotech-
nical Report. The grading plan shall incorporate the
recommendations of the approved Geotechnical Report.
37. That prior to recordation, the developer shall submit to
the City of Moorpark, for review and approval, street
improvement plans prepared by a Registered Civil Engineer;
shall enter into an agreement with the City of Moorpark to
complete the improvements; and shall post sufficient surety
guaranteeing the construction of the improvements.
1 38. The improvements shall include concrete curb and gutter,
sidewalk, street lights, striping and signing, and paving in
accordance with the Ventura County Road Standards. The
applicable Road Standard Plates are as follows:

roadway on Williams Ranch Road and Madaline Braun again addressed
Council concerning the same matter.
Vicki Perez then addressed Council, stating that she appreciated the
time being spent on the width of the street and the sidewalk, but that
there are other issues of concern to the residents.

Wally Todd, 4240 Tecolote Court, Moorpark, addressed Council in
opposition to the Warmington projects in various aspects, particularly
questioning the process of providing notice of the public hearing
before the City Council.
The City Attorney responded, stating that notice of the hearing date
had been both published and mailed to the property owners within the
300 foot radius, as required by law, and that although the public
hearing had been continued by the City Council for three consecutive
meetings, in her opinion, that was not excessive, and that she felt
the Courts would uphold our noticing procedures, and that the notice
had riot lost its effectiveness.

10.A. Senior Citizens Agreement
By general consent this item was considered at this time.
The City Manager presented and reviewed his report dated September 12,
1985, recommending a modification of Paragraph 2.A to the Agreement
with the Seniors.
Mr. Dean Newman, 15750 Los Angeles Avenue, Moorpark, Space 120,
then addressed Council on behalf of the Senior Citizens, stating
that the operation of the Thrift Shop had exceeded expectations, and
that the Seniors now felt they could make it on their owry and would
not need assistance f.r_om the City.
Councilmember Yancv- S*atton spoke on behalf of the Council, wishiliq
the Seniors good luck in their Thrift Shop and complemented them on
doing a good job.

7.C: Tentative Tract No. Tr -3019 & Residential Planned
Development No. RPD -102 1; Warmington Homes, Applicant
Request approval of 39.5 acre subdivision containing 130
single family lots and a companion Residential Planned
Development.
Location: Adjacent to and south of Williams Ranch Road
(Peach Hill Road) and adjacent to and east of
the Southern California Edison Company
transmission line corridor.
An overview of the project and recommended conditions of approval
was given by Carl Rowley, from Hawks & Associaties, Consultant
retained by the City for staff services for the subject project.
--0 Discussion was held between members of the City Council and staff,
particularly with the City Engineer regarding traffic control and
street design.
Planning Commissioner James A. Hartley addressed Council and
explained the position of the Planning Commission in making recom-
mendations for conditions of approval.
The Mayor declared the public hearing open and the City Clerk
presented the following documents, which were ordered received and
filed by general consent:
1. Affidavit of Publication of Notice of this Hearing,
published in the Moorpark News on June 12, 1985;
2. Affidavit of Mailing of Notice of this Hearing, to
} property owners within the 300 foot radius, on
June 12, 1985.

The following persons addressed Council regarding the subject
projects:
Ronald A. Gallagher, 100 E. Thousand Oaks Boulevard,
Thousand Oaks, Applicant
Planning Commissioner James A. Hartley.
Discussion was held concerning the landscaping on "I" Street,
as well as the width of the street on Williams Ranch Road, with the
City Engineer re- affirming his recommendation for a 40 foot street —'
width.
After considerable discussion, the hearing was closed by general
consent, and it was moved by Councilmember Yancy- Sutton, seconded
by Councilmember Woolard and unanimously carried that the City
Council finds that the proposed project will not have a significant
effect on the environment and that the Council has reviewed and
considered the information contained in the Mitigated Negative
Declaration, and does approve the Mitigated Negative Declaration as
having been completed in compliance with CEQA and State CEQA
Guidelines issued thereunder.
It was then moved by Councilmember Yancy- Sutton, seconded by
Councilmember Woolard and unanimously carried that the City Council
does approve Tentative Tract No. TR -3525 and Residential Planned
Development No. RPD -941; does also approve Tentative Tract No.
TR -3019 and Residential Planned Development No. RPD -1021• that
said Tentative Tracts are approved subject to provisions for
sidewalks next to curbs (without parkway in between), 40 foot wide.
