SUBJECT: Agreement to Codify the City's Municipal Code

As you are aware, the City's municipal code is composed of various county
codes which have been adopted by reference, as well as an additional 90
ordinances which have been adopted since the City's incorporation. It is
becoming increasingly difficult to locate specific code sections due to the
large volume and varied formats which make up our municipal code.
Staff contacted the Cities of Thousand Oaks, Ventura and Santa Paula to
determine which company they used for the codification of their municipal
codes, and to also determine their satisfaction with the company they had
chosen. It was discovered that all three, in addition to the Cities of
Camarillo, Fillmore, Ojai, Port Hueneme, Simi Valley and the County of
Ventura, use Book Publishing Company and are very pleased with the level of
service rendered.
The Council approved $5,400 towards codification of the City's municipal
code during the last budget process. The codification process has two
primary steps: 1) analysis (which includes an examination of all
of our ordinances and existing codes to determine their applicability with
state statutes, and Supreme Court decisions), and report (which points out
any conflicts, inconsistencies or outmoded ordinances and codes); and 2)
final editing (which includes dividing the code into sections, and indexing
the disposition of all ordinances), printing and publication. Once this
process has been completed, our code will be up -dated through a
supplementation service provided by the same vendor.
Staff is ready to begin the first step of the codification process. A
proposed contract. with Book Publishing Company which covers both the
codification process and supplementation service has been received. Both
staff and the City Attorney have reviewed the attached contract which is now
presented to you for approval.

Of concern to the City Attorney was Section 22, Laws of Washington to
Govern. As it was previously written, if there were to be a contractual
dispute, the City would have to bear the expense of having our City Attorney
learn Washington state law or bear the expense of retaining a Washington
lawyer. However, after conferring with Book Publishing, Section 22 will be
amended to read, Laws of California to Govern.
It is recommended that all sections of the municipal code be codified except
the section which pertains to zoning. The Director of Community Development
has suggested that the City not codify this portion of our code until it has
been updated.
Upon completion of the codification, it is recommended that the City
purchase twenty -five (25) copies of the code. A proposed distribution list
is attached. Although the actual cost of the code will not be known until
it is determined how many pages the code will be, the base charge for a
190 -page code is $4,600. The charge for each page over 190 pages is $23.00
per page. The binders for the codes will be purchased at a cost of $17.00
each with tabbed divider pages for the main sections. Therefore, if the
code is 190 pages long, and if the City purchases twenty -five sets including
binders, the cost would be approximately $5,025.
Payment under the contract is accomplished in two stages. An initial
payment of $1,000 is due upon execution of the contract. An additional
$1,000 is due when the Ordinance Analysis and Report is submitted to our
City Attorney for review. The balance of the total cost of the code is due
on delivery of the code books to the City, which is expected to occur in
October 1988.
STAFF RECOMMENDATION:
Approve the contract and authorize the Mayor to sign the recommended
contract with Book Publishing Company on behalf of the City.
