Tract 3963 (Griffin) - Collins Drive Right -of -Way
Adjacent to Mormon Church
BACKGROUND INFORMATION
The conditions of development for Tract No. 3963 (Griffin)
require that Collins Drive be constructed per the enclosed
Exhibit "A" prior to the issuance of a certificate of
occupancy for the 70th unit of the project. Resolution
87 -395 deferred construction of these improvements to
Collins Drive south of the tract boundary to July 1, 1988.
In order to construct Collins Drive as conditioned, Griffin
Homes must obtain right -of -way between Benwood Drive and the
southern tract boundary from the existing Mormon Church.
This right -of -way consists of land required immediately in
order to construct Collins Drive as shown on Exhibit "A ",
plus an additional 9 feet of right -of -way for the
construction of a future southbound lane.
Griffin Homes has attempted to acquire the required right -
of -way from the Mormon Church. The church has refused to
dedicate any land for Collins Drive, but agreed to
reconsider the dedication if the City would waive the right
to require the additional 9 feet of right -of -way for the
future southbound lane. (Refer to the enclosed letter from
Mr. Robert Woods.) The purpose of the additional 9 feet of
right -of -way is to provide for a future 12 foot southbound
lane to Collins Drive, if required.

It would be possible to provide an additional southbound
lane along this section of Collins Drive without acquiring
the additional 9 feet of right -of -way if (see Exhibit "B ",
enclosed):
1. The 8 foot bike /parking lane on the west side of
Collins Drive is reduced to a 5 foot bike lane (no
parking permitted).
2. The 10 foot painted median is reduced to 5 feet in
width.
3. The proposed 12 foot travel lanes are reduced to
11 feet.
The developer's engineer has submitted a proposed striping
plan which shows that this proposed section is feasible and
compatible with the street sections to the north and south.
The advantages of using the reduced section shown in Exhibit
"B" is that eminent domain proceedings may be avoided. The
disadvantages include:
1. A dedicated southbound left turn lane adjacent to
the church is not feasible.
2. No parking will be permitted on Collins Drive
along the church frontage.
3. 11 foot travel lanes are acceptable but not as
preferrable as 12 foot lanes.
The major modification for Tract 3963 required these
improvements to be constructed by July 1, 1988. Because of
the difficulties encountered in obtaining right -of -way, this
schedule is no longer possible.
RECOMMENDED ACTION
1. In order to construct Collins Drive without undue delay
and to cooperate with the existing property owner:
Waive the required extra 9 feet of right -of -way
dedication.
- If a second southbound lane is required, construct
Collins Drive as shown in Exhibit "B" between the
southern tract boundary and Benwood Drive.

2. Require that Collins Drive between the southern tract
boundary and Benwood Drive be completed by September 1,
1988.

Dear Ms. Freeman:
We have carefully considered the request contained in your letter
of December 7, 1987 regarding the dedication of church property
for, (1) actual street improvements, and (2) a future right of way.
We do not believe that this action is in the best interest of the
Church and therefore must regretfully decline your proposal.
We are grateful for the cordial relationship that has existed
between the Church and Griffin Homes and appreciate the help that
you have given us in the past. May I suggest that the Church be
asked to reconsider the dedication of the actual improvement area
if the City of Moorpark would waive the right to require the
further dedication of any church property in the future.
