Knipe, Assistant City Engineer (� DATE: August 10, 1988 SUBJECT: Collins Drive Widening South of Tract 3963 (Griffin) BACKGROUND INFORMATION The conditions of development for Tract No. 3963 (Griffin) required that Collins Drive be constructed south of the tract boundary line to provide for two northbound through lanes and one southbound through lane. In order to construct this roadway, the developer was required to obtain right -of -way from the existing Mormon Church adjacent to the roadway. In addition to the right -of -way required to construct the road, an additional nine feet of right -of -way for possible future improvements was required to be obtained by the developer. On May 26, 1988, the City Council removed the requirement to obtain the additional nine feet of right -of -way. By removing the condition for the additional right -of -way, the church had indicated that it would be willing to give up the right -of -way required for the present improvements. This section of Collins Drive was originally required to be constructed prior to the issuance of a Certificate of Occupancy for the 70th unit of Tract 3963. The Council action of May 26, 1988 deferred this construction to September 1, 1988. Griffin Homes is in the process of obtaining the right -of -way for the Collins Drive improvements from the Mormon Church. However, the enclosed letter from the developer indicates that the right -of -way has not been granted as of this date, and the construction of Collins Drive cannot be completed by the September 1, 1988 deadline. 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 Page -2- It is felt that the developer is doing all within its power to obtain the necessary right -of -way and begin the construction of this section of Collins Drive. Bonding for this section of Collins Drive has been received by the City. Therefore it is felt that completion of Collins Drive can be delayed to January, 1989.
