SUBJECT: Agreement to Construct Improvements and Approval
of the Final Map for Tract 3049 (A&R Development)
BACKGROUND INFORMATION
The subject tract is located in the Campus Park area of the
City. A location map is attached for your reference.
The final map represents a subdivision of 62 .82 acres into
97 lots for the development of 93 single family units.
The tentative map was approved by the City of Moorpark
Planning Commission on September 24, 1986 and was subse-
quently approved by the City Council on November 31, 1986.
The conditions of approval for the tentative map have been
satisfied and all of the requirements precedent to
recordation have been fulfilled, except as noted below.
Prior to recordation, the developer is required to pay in
lieu Los Angeles area of contribution fees at the rate of
$2,228. 00 per dwelling unit. Based on 93 dwelling units,the
required Los Angeles A.O.C. Fee is $207,204. The developer
has indicated that this fee will be paid after final map
approval but prior to recordation. This fee has not been
paid at this time.

The developer is also required to purchase a parcel of land
within the tract boundary currently owned by the City. This
transfer of land is to take place prior to recordation of
the final map. The developer has indicated that the
required fee for this parcel shall be deposited into escrow
after final map approval. This fee has not been paid at
this time. The developer is also to work with the City and
the title company to effect the property transfer.
The Council should note that an easement for a storm drain
between lots 18 and 19, carrying non-public water, is being
offered to the City. This storm drain easement is similar
in nature to the Tract 2865-3 (Pardee) easement. No action
has been taken as of this date on the Pardee storm drain,
but the result of this action may affect whether the City
wishes to accept this storm drain easement between lots 18
and 19.
Condition Number 66 (enclosed) requires the offer of an
access easement from "A" Street (College Heights Drive) for
a potential future access to Happy Camp Regional Park. The
City Engineer has determined that this access is not
realistic due to the topography between "A" Street and Happy
Camp Park. It is also felt that access to the park through
residential streets is not appropriate. Therefore, it is
felt that the requirement for an easement between "A" Street
and Happy Camp Park should be deleted.
There are some minor questions regarding the CC&R's that
still need to be resolved. The developer is working with
City staff to resolve these questions. The CC&R's should be
ready for approval within a few days.
The tract is being developed by A & R Development Co.
(formerly U.S. Condo) , and will be provided water and sewer
services by the Ventura County Waterworks District No. 1.
Included in this submittal are the following items:
1. Final map for Tract 3049 (on file in the Office of the
City Clerk) .
2. Agreement for Construction of Subdivision Improvements.
3. Subdivision Sewer Agreement.

RECOMMENDED ACTION
- Approve the final map for tract 3049 and authorize the
Mayor to sign the title sheet accepting for public use
the right-of-way for all streets, the necessary rights
for ingress and egress, and the easements for public
service purposes and storm drain purposes as shown on
the map.
- Authorize the Mayor to sign the Agreement for
Construction of Subdivision Improvements and the
Subdivision Sewer Agreement for the subject tract and
direct the City Clerk to retain the original agreement
and return an executed copy to the developer and surety
company.
- Direct the City Clerk not to release the subject map
for recordation until the Los Angeles Avenue area of
contribution fees have been paid, the City owned parcel
of land has been transferred to the developer, and the
CC&R's have been approved by the Director of Community
Development.
- Delete the easement dedication required by Condition
Number 66.

63 . Requirement for in lieu fee payment.
SHERIFF'S DEPARTMENT CONDITIONS
64 . That a licensed security guard or fencing of the
construction area be provided during the construction
phase .
65 . That for the purpose of providing security for the
homeowners , the use of perimeter fencing be evaluated
by the Director of Planning and the Sheriff' s
Department and an administrative determination be made
as to whether to require perimeter fencing. This
determination shall be made in writing by the Director
of Planning prior to the issuance of building permits.
CITY COUNCIL CONDITION (Worded by City Engineer)
66 . On the tract map, the developer shall irrevocably offer
an easement for public street and highway purposes for
a potential future access to Happy Camp Regional Park.
This access shall also include right of way for a
connection to "A" Street. Said easements are subject
to the approval of the City Engineer.
