SUBJECT: INTERIM PLAN CHECK SERVICES FOR BUILDING & SAFETY
Background
At the City Council's meeting of February 3, 1988 staff provided a
report regarding the pending termination of Building and Safety
Services by the County and made several recommendations towards
transition methods to begin the detachment from the County. One
of staff's recommendations was the use of an interim plan check
service prior to awarding a full service (plan check and
inspections) contract. The Council concurred with staff's
recommendation and directed staff to solicit bids from at least two
firms, so as to award a contract and begin services on April 1,
1988. Per Council's direction staff sent out four (4) Request for
Proposals (RFP's) to contractors servicing the eastern Ventura
County area.
Discussion
Staff received only the following two responses regarding interim
plan check services.

Originally staff had planned to send out the RFP, receive
responses, conduct an evaluation and then make a recommendation
to the City Council at the March 16, 1988 meeting. That schedule
proved to be overly optimistic.
Staff has reviewed each of the two proposals and conducted
telephone interviews with cities currently using these firms. The
results of the interviews concluded that both firms were highly
recommended. The BSI Consultant firm generally serves cities
outside of Ventura County whereas the Jack DeJong & Associates
firm has been serving the cities of Filmore, Santa Paula and Ojai.
The BSI, Consultant firm is located in Thousand Oaks where as the
DeJong & Associates offices are in Ventura. Each firm includes the
required Registered Professional to accomplish the scope of work
under the contract.

As was identified early in this memorandum, there was an intent to
have interim plan check services in place by April 1st. Should the
City Council elect to authorize an award at their April 6th
meeting; the intent will be to have a contract signed no later than
April 15th.
It should be noted that the interim plan check contractor will
remain with a project up until the time plan check is completed.
What this means is the interim contractor will probably still be
conducting business with the City beyond the time the full service
contractor begins service for those projects entering plan check
between April 15 and June 30, 1988.
Recommended Action
That the City Council award interim plan check services to the firm of Jack
DeJong & Associates pursuant to their proposal and authorize the City Manager
to sign a contract on behalf of the City.

MOORPARK PLANCHECK SERVICES
Introduction
Jack DeJong and Associates (JDA) is pleased to respond to
the City of Moorpark and present this outline as a proposal
to provide total and complete plancheck review services of
proposed new construction and improvement projects within
the City limits.
Jack DeJong and Associates has 24 years experience in build-
ing department administration, including code adoptions ,
permit administration, planchecking, code enforcement, and
field inspections. The last 10 years we have assisted sev-
eral Ventura County cities in updating their building depart-
ments, and have also for five years , operated the building
departments in the cities of Ojai and Fillmore. We have
available experienced personnel, who are professionals, and
who are sensitive to providing courteous and reliable service.
We maintain membership in state and local professional code
and technical organizations , attend meetings with code writing
groups , and participate in various Ventura County industry
related activities. JDA knows the geographical area and is
dedicated to providing efficient and expedient plancheck ser-
vices.

SCOPE OF PLAN REVIEW SERVICES
1) Provide preliminary plan review of proposed new projects
to city staff and to applicants and their agents.
2) Perform plancheck reviews of development plans submitted
to determine compliance with all applicable state laws
and city ordinances , including, but not limited to:
• Uniform Building Code • Fire Protection Systems
• Uniform Mechanical Code • Health Regulations
• Uniform Plumbing Code • California Title 24 :
• National Electrical Code Energy Regulations
Handicapped Regulations
• Grading and Drainage Noise Regulations
• Local Ordinances
3) Provide rechecking of plans as necessary , and liaison with
the applicant and representatives to assure expedient com-
pletion of all plancheck projects.
4) Maintain close liaison with other City departments in order
that the appropriate requirements of those departments are
incorporated within such building plans.
5) Arrange reviews by other appropriate agencies having juris-
diction in such matters relative to the enforcement of the
Fire Codes , Sanitation Codes and Health Codes. When satis-
fied that the appropriate requirements of the City' s codes
have been met, firm shall advise the County Building and
Safety to issue permits as appropriately set forth in such
codes.
6) Provide professional assistance to City Community Develop-
ment Director and submit regular updates and status reports.

COMPENSATION
Compensation for interim plancheck review services will be at
60% of the plancheck fee of a project paid by the applicant
to the City of Moorpark.

JACK DEJONG and ASSOCIATES was the supervisory building inspection agency
on the recently completed OJAI VATJFY INN expansion and new construction pro-
ject. Complete inspection and services were provided to assure compliance
with all local and state safety codes, including the subject areas of grading
and foundations, structural frame, plumbing-mechanical-electrical work, health,
fire, and life safety.
The OJAI VAT,TFY INN project consisted of five new multi-story guestroan build-
ings, a new ballroom and convention facility, plus the reconstruction of sev-
eral existing buildings for a total project valuation of nearly $40,000,000.00.
JACK DEJONG and ASSOCIATES provided timely and excellent professional services
for the total project.

BSI CONSULTANTS, INC. is pleased to respond to the City of
Moorpark' s Request for Proposal (RFP) for Building Plan Check
Services. BSI provides contract plan check services exclusively
to governmental agencies to avoid any potential conflict of
interest.
This letter serves to acknowledge the conditions of the City' s
RFP and BSI agrees to comply with said conditions. For
clarification, BSI retains insurance in the amount of one-million
dollars for Errors and Omissions in addition to over one-million

Coordination and processing of planchecks will be from BSI' s
office. Plan transmittal will be handled by mail. This has
proven to be an efficient method based on our experience with
other client agencies.
BSI proposes to provide review of the building code and ordinance
requirements, energy regulations and handicap regulations for an
( amount equal to eighty percent ( 80%) of the schedule now being
presented to the Ventura County Board of Supervisors.

Proposal Information
The purpose of this Request for Proposal is to select a firm to provide
plan check services as the city phases out the Building and Safety
services currently provided by the County of Ventura. A full service
Building and Safety firm will be selected by the city sometime during
the month of June 1988. The interim firm selected will either be the
full service firm or will then be phased out from June 1 through June
30, 1988

The plan check firm is responsible for any costs incurred by the firm,
in responding to the request for proposal.

1 . This RFP will be a part of the contract.
2. Documents to be construed together. The RFP, the vendor's
proposal, and all documents referred to in the specifications
and contract to be entered into between the firm and the
City, and . all the modifications of said documents, shall be
construed together as one document.

3. Assignment or Transfer of Contract. The firm shall not
assign, transfer, convey or otherwise dispose of his
contract, or his rights, title or interest in or to the same
without previous written consent of the City.
4. Indemnity. The firm must agree to indemnity, hold harmless
and defend the City, from any and all liability or loss,
resulting from any suits, claims or actions brought against
the City, which result directly or indirectly from the
wrongful or negligent actions of the firm in the performance
of the contract.

will be required to carry at least $2 million of General
Liability and Professional Liability insurance.
6. Compliance with Labor Laws. Firm will be required to comply
with all existing State and Federal Labor Laws .

Firm will be required to meet all State and Federal Laws
applicable to Disadvantaged and EEO.
J 8. Firm shall agree not to provide services for any others
within the City limits. -
1 Other City Requirements
The City reserves the right to reject any or all proposals without
qualifications. Proposals will be considered only in their entirety.
The City reserves the right to negotiate the specific requirements and
cost using the selected proposal as a basis.
The City also reserves the right to reject all proposals if they are
deemed unsuitable to the City's needs. Late or incompkto proposals
will not be considered, and the City reserves the right to determine
the completeness of all request for proposals.
Scope of Work
1 . The firm shall review the plans prepared by or on
behalf of the various private developers for compliance
i with the ordinances of the City.
J 2. The firm shall maintain close liaison with other City
i departments in order that the appropriate requirements
of those departments are incorporated within such
building plans,

3. The firm shall arrange reviews by other appropriate
agencies having jurisdiction in such matters relative to
the enforcement of the Fire Codes, Sanitation Codes and
Health Codes. When satisfied that the appropriate
requirements of the City's codes have been met, firm
shall advise the County Building and Safety to issue
permits as appropriately set forth in such codes.

CONTRACT FOR SERVICES
THIS AGREEMENT, made this day of , 198_

referred to as "City" and
an independent contractor, located at

WITNESSETH:
The Parties hereto do agree as follows :
Article 1 TERM OF CONTRACT
This agreement will become effective on

Article 2 SPECIFIC SERVICES
The Contractor agree to perform the services specified in the

Article 3 COMPENSATION

agreement may be assigned by Contractor without prior written

Article 5 OBLIGATIONS OF CITY
JCity agrees to comply with all reasonable requests of the
Contractor relative to, and provide access to all documents reasonably
necessary for, the performance of Contractors duties under this
agreement.

Article 6 TERMINATION

Termination by either party may be accomplished upon
written notice.
,I Article 7 GENERAL PROVISIONS
Independent Contractor
Contractor is and at all times shall remain as to the City a
wholly independent contractor. Contractor shall not, at any time
or in any manner, represent that he is an officer, employee or agent
of the City. Contractor shall comply with all applicable provisions
of the Workers ' Compensation Insurance and Safety Acts and Labor
code of the state of California.
Ownership of Documents
Upon completion of any writing required to be provided by
i Contractor in the course of performing any of the above described
services , or upon sooner termination of this agreement, all original
— documents prepared by Contractor shall become the sole property of
the City and may be used, reused or otherwise disposed of by the
City without the permission of the Contractor.
iHold Harmless
Contractor agrees to indemnify , save, keep and hold harmless
City and all of its officers and employees from all claims, actions,
suits, damages, costs or expenses in law or equity, including costs
of suit and expenses for legal services, that may at any time arise
or be set up because of damage to property or injury or death to
persons received or suffered by reason of , or arising out of , any act
on the part of the Contractor in regard to any function or activity
carried out by contractor on behalf of the City pursuant to the
terms of this agreement.
Notices
Any notice to be given hereunder by either party to the other
shall be effected either by personal delivery in writing or by
certified mail, postage prepaid, return receipt requested. Mailed
notices shall be addressed to the City in care of City Manager,
799 Moorpark Avenue, Moorpark, California 93021 , and to the
Contractor at
j but each party may change the address by written notice in
accordance with this section. Notices- delivered personally will be
deemed served as of actual receipt; mailed notices will be deemed

Entire Agreement of Parties
This agreement supersedes any and all agreements, either oral
-1 or written, between the parties hereto with respect to the
rendering of services by Contractor to the City, and contains all
of the covenants and agreements between the parties with respect
to the rendering of such services in any manner whatsoever. Each
I party to this agreement acknowledges that no representatives,
inducements , promises , or agreements, oral or otherwise, have been
made by any party or anyone acting on behalf of any party, which are
not embodied herein, and that no other agreement, statement or promise
i not contained in this agreement shall be valid or binding. Any
modification of this agreement shall be effective if it is in
lwriting signed by the party to be charged.
Governing Law -
i This agreement shall be governed by and construed in accordance
with the laws of the State of California .
IAttorney' s Fees
Should either party hereto institute any action or proceeding
of any nature whatsoever in a court of law, equity , or otherwise
to enforce any provisions of this Agreement or for a declaration of
such party ' s rights or obligations hereunder or for any other
i remedy, the prevailing party shall be entitled to receive from the
losing party, its costs , includiag _such amount as the Court or
arbitration panel may adjudge to be 'reasonable attorney' s fees for the
I services rendered the party finally prevailing in any such action -
or proceeding . Unless judgement goes by default, the attorney fee
award shall not be computed in accordance with any court schedule,
but shall be such as t fully reimbruse the prevailing party for all
J its/their attorney ' s tees actually incurred in good faith , regardless
of the amount of such judgement, it being the intention of the parties
to fully compensate the prevailing party for all attorney' s fees
Ipaid or incurred in good faith.
Venue
This agreement is made, entered into, executed and is to be
performed in Moorpark, Ventura County, California, and any action
1 filed in any court or for arbitration for the interpretation,
enforcement and/or otherwise of the terms , covenants and
conditions referred to herein shall be filed in the applicable
court in Ventura County, California .
City ' s Agent
l The Moorpark City Manager, or his designee shall have .the right
to .review, coordinate and approve all work to be performed by the
Contractor pursuant to this agreement, and shall be the City' s

GENERAL INFORMATION
The City of Moorpark is a new community situated in the eastern .
portion of Ventura County. It is adjacent to the cites of Thousand
Oaks and Simi Valley. Its current population is 20,500.
The City is characterized by rapid growth, in a rural setting. In
addition, the 23 and 118 Freeways will eventually connect in the City.
Research and development companies as well as office buildings are also
under construction in the City at this time.
Moorpark was incorporated in July, 1983 as a general law city, and
operates under the Council/Manager form of government. The five (5)
City Council members are elected at large by the residents, for
staggered four-you terms, and serve as the City's legislative, policy
making body. The Mayor is selected annually from among the Council
members. The City Council holds bimonthly public meetings at which
views of interested residents may be expressed. The City Manager is
responsible for directing City affairs as prescribed by the City
Council . Moorpark is considered a contract city.
Cif uve ubee 4. i953 by initiative action the voters of Moorpark
adopted Measure F which is a residential growth limitation regulation.
Under Measure F the City may issue only 250 residential building
permits in a calendar year with certain exceptions.

Proposal Information
The purpose of this Request for Proposal is to select a firm to provide
plan check services as the city phases out the Building and Safety
services currently provided by the County of Ventura. A full service
Building and Safety firm will be selected by the city sometime during
the month of June 1988. The interim firm selected will either be the
full service firm or will then be phased out from June 1 through June
30, 1988
Right of Refusal
The City of Moorpark reserves the right to refuse any or all proposals.
Cost of Proposal Preparation
The plan check firm is responsible for any costs incurred by the firm,
in responding to the request for proposal.
Each proposal shall be considered valid and binding on the proposer for
a period of ninety (90) days after the proposal due date.
All proposals and documents submitted will become the property of the
City of Moorpark. Anything considered to be proprietary shall be so
designated by the proposer.
